The place where a person resides and the place where a legal entity is established shall be determined according to the circumstances.
For the application of the first paragraph, ships that have their home port in the Netherlands shall, in relation to the crew, be considered as part of the Netherlands.
A person who has left the Netherlands with the intention of establishing residence elsewhere and who returns to establish residence within one year thereafter, without having resided in the meantime in Aruba, Curaçao, Sint Maarten, the public bodies of Bonaire, Sint Eustatius and Saba, or in the territory of another Power, shall also be deemed to have resided in the Netherlands for the duration of their absence.
Waar iemand woont en waar een lichaam gevestigd is, wordt naar de omstandigheden beoordeeld.
Voor de toepassing van het eerste lid worden schepen welke in Nederland hun thuishaven hebben, ten opzichte van de bemanning als deel van Nederland beschouwd.
Hij die Nederland metterwoon heeft verlaten en binnen een jaar nadien metterwoon terugkeert zonder inmiddels in Aruba, Curaçao, Sint Maarten, de openbare lichamen Bonaire, Sint Eustatius en Saba, of op het grondgebied van een andere Mogendheid te hebben gewoond, wordt ook voor de duur van zijn afwezigheid geacht in Nederland te hebben gewoond.
