On the basis of a comparison of files to be designated by ministerial regulation, the CAK shall verify which persons subject to the insurance obligation are not insured under a health insurance policy, notwithstanding their insurance obligation.
The CAK shall send an insured person as referred to in the first paragraph a written demand to, within a period of three months, calculated from the date of dispatch of the demand, still effect or have effected insurance on the basis of such insurance.
The formal notice shall contain an overview of the consequences in the event that the person concerned is not insured within the term referred to in the second paragraph.
The CAK is authorised to process personal data of the insured person, as referred to in the first paragraph, which are necessary for the implementation of this section.
The CAK is the controller for the processing referred to in the fourth paragraph.
Het CAK gaat op basis van vergelijking van bij ministeriële regeling aan te wijzen bestanden na welke verzekeringsplichtigen in weerwil van hun verzekeringsplicht niet krachtens een zorgverzekering verzekerd zijn.
Het CAK zendt een verzekeringsplichtige als bedoeld in het eerste lid een schriftelijke aanmaning om zich binnen een termijn van drie maanden, te rekenen vanaf de datum van verzending van de aanmaning, alsnog op grond van zo'n verzekering te verzekeren of te laten verzekeren.
De aanmaning bevat een overzicht van de gevolgen indien betrokkene niet binnen de in het tweede lid genoemde termijn verzekerd zal zijn.
Het CAK is bevoegd tot het verwerken van persoonsgegevens van de verzekeringsplichtige, bedoeld in het eerste lid, die noodzakelijk zijn voor de uitvoering van deze paragraaf.
Het CAK is de verwerkingsverantwoordelijke, voor de verwerking, bedoeld in het vierde lid.
