In cases where it has been irrevocably established that the enforcement of a foreign judicial decision in the Netherlands should not take place, the court that heard the case may, upon the petition of the convicted person, award him compensation at the expense of the State for damage suffered and costs incurred as a result of provisional deprivation of liberty ordered pursuant to this Act. Damage includes non-pecuniary loss.
Articles 533, paragraphs 3, 4 and 6, 529, 530, and 534 up to and including 536 of the Code of Criminal Procedure shall apply mutatis mutandis.
In gevallen waarin onherroepelijk is vastgesteld dat tenuitvoerlegging van een buitenlandse rechterlijke beslissing in Nederland niet behoort plaats te vinden kan de rechtbank, die de zaak heeft behandeld, op verzoek van de veroordeelde hem een vergoeding ten laste van de staat toekennen voor schade die hij heeft geleden en kosten die hij heeft gemaakt ten gevolge van voorlopige vrijheidsbeneming bevolen krachtens deze wet. Onder schade is begrepen het nadeel dat niet in vermogensschade bestaat.
De artikelen 533, derde, vierde en zesde lid, 529, 530, 534 tot en met 536 van het Wetboek van Strafvordering zijn van overeenkomstige toepassing.
