The admission body may suspend the admission of an instrument for quality assurance for a term to be determined by it.
The admission of an instrument for quality assurance shall in any event be suspended if the instrument provider is in a moratorium on payments (surseance van betaling).
The accreditation organisation shall state in the decision to suspend:
the grounds for suspension;
the period within which established defects must have been remedied, and
the consequences of the failure to effectuate a remedy.
The quality assurance instrument may be applied during the period of suspension in cases where the quality assurance using that instrument had commenced prior to the date on which the decision to suspend was issued. The admission body may set a shorter period or determine that the application shall be terminated immediately if the quality assurance using the relevant instrument leads to non-compliance with the regulations established pursuant to Section 4.3, first paragraph, opening words and under a, or fourth paragraph, of the Environment and Planning Act (Omgevingswet), or Section 120.
De toelatingsorganisatie kan de toelating van een instrument voor kwaliteitsborging schorsen voor een door haar vast te stellen termijn.
De toelating van een instrument voor kwaliteitsborging wordt in ieder geval geschorst, indien de instrumentaanbieder in surseance van betaling verkeert.
De toelatingsorganisatie vermeldt in de beschikking tot schorsing:
de reden van schorsing;
de termijn waarbinnen geconstateerde tekortkomingen moeten zijn hersteld, en
de gevolgen van het achterwege blijven van herstel.
Het instrument voor kwaliteitsborging kan gedurende de termijn van schorsing worden toegepast in de gevallen waarin de kwaliteitsborging met toepassing van dat instrument voor de datum waarop de beschikking tot schorsing is gegeven, is aangevangen. De toelatingsorganisatie kan een kortere termijn vaststellen of bepalen dat de toepassing terstond wordt beëindigd, indien de kwaliteitsborging met toepassing van het betreffende instrument leidt tot strijdigheid met de voorschriften, die zijn gesteld op grond van artikel 4.3, eerste lid, aanhef en onder a, of vierde lid, van de Omgevingswet, of artikel 120.
