Regulations shall only be established with regard to subjects for which this Act prescribes regulation or further regulation by ordinance.
Regulations shall not contain any obligations or requirements that are not strictly necessary for the achievement of the objective pursued by the regulation, and shall not unnecessarily restrict the functioning of the market.
Proposals for regulations shall be submitted to the members' council by the board or by at least five members of the members' council. Before submitting a draft regulation to the members' council, the board may invite the chambers for the civil-law notary profession to express their opinion. The KNB shall obtain the advice of the Bureau regarding a draft regulation.
The regulations of the KNB are binding only upon its members and its bodies.
A regulation may grant the board of the KNB the authority to issue further rules regarding the subject matter addressed in the regulation. These shall be sent to Our Minister for information.
Verordeningen worden slechts vastgesteld met betrekking tot onderwerpen waarvan deze wet regeling of nadere regeling bij verordening voorschrijft.
Verordeningen bevatten geen verplichtingen of voorschriften die niet strikt noodzakelijk zijn voor verwezenlijking van het doel dat met de verordening wordt beoogd en beperken niet onnodig de marktwerking.
Voorstellen van verordeningen worden aan de ledenraad gedaan door het bestuur of door ten minste vijf leden van de ledenraad. Alvorens een ontwerp-verordening bij de ledenraad in te dienen kan het bestuur de kamers voor het notariaat uitnodigen hun oordeel kenbaar te maken. Over een ontwerp voor een verordening wint de KNB het advies in van het Bureau.
De verordeningen van de KNB zijn slechts verbindend voor haar leden en haar organen.
Een verordening kan aan het bestuur van de KNB de bevoegdheid toekennen tot het geven van nadere regels betreffende het in de verordening behandelde onderwerp. Deze worden ter kennisname toegezonden aan Onze Minister.
