If the case has been brought before the court by a summons containing a brief description of the charged offence, the Public Prosecution Service shall, at the commencement of the trial, submit the written further specification of the charged offence to the subdistrict court judge (kantonrechter) and to the suspect upon their request.
The further statement of particulars shall serve as the summons with regard to the grounds for further prosecution.
Indien de zaak aanhangig is gemaakt door een oproeping die een korte aanduiding van het telastegelegde feit bevat, legt het openbaar ministerie bij de aanvang van het onderzoek ter terechtzitting de schriftelijk nadere opgave van het telastegelegde feit over aan de kantonrechter en aan de verdachte op diens verzoek.
De nadere opgave geldt voor wat betreft de grondslag voor de verdere vervolging als dagvaarding.
