Both the public prosecutor and the defendant may, following the notification regarding the legal remedy available against the judgment, waive the right to exercise such legal remedy at the hearing. The defendant shall be alerted to his right to do so.
A waiver of legal remedies made during the hearing shall be recorded in the official report of that hearing.
If the drawing up of the official report of the court hearing has been omitted, the statement that a waiver of legal remedies has been made shall be included in the record referred to in Article 378a, paragraph 1.
Zowel de officier van justitie als de verdachte kunnen na de mededeling betreffende het rechtsmiddel dat tegen het vonnis openstaat, ter terechtzitting afstand doen van de bevoegdheid om dat rechtsmiddel aan te wenden. Op zijn recht daartoe wordt de verdachte opmerkzaam gemaakt.
Afstand ter terechtzitting van rechtsmiddelen wordt in het proces-verbaal dier terechtzitting vermeld.
Indien het opmaken van het proces-verbaal van de terechtzitting achterwege is gebleven, geschiedt de vermelding, dat afstand van rechtsmiddelen is gedaan, in de aantekening, bedoeld in artikel 378a, eerste lid.
