If, as a result of the investigation, circumstances have become known which, not having been stated in the summons, provide grounds for an increase of the penalty under the law, the public prosecutor is authorised to charge these orally.
Indien uit het onderzoek omstandigheden zijn bekend geworden die, niet in de dagvaarding vermeld, volgens de wet tot verzwaring van straf grond opleveren, is de officier van justitie bevoegd deze alsnog mondeling ten laste te leggen.
