The court may, by a reasoned decision, waive the summoning of witnesses who have not appeared as referred to in Article 287, paragraph 3, if it is of the opinion that:
it is implausible that the witness will appear in court within a reasonable period of time;
there is a well-founded suspicion that the health or well-being of the witness or expert will be endangered by giving a statement at the hearing, and the prevention of this danger outweighs the interest in being able to examine the witness or expert at the hearing;
it can reasonably be assumed that the Public Prosecution Service is not prejudiced in its prosecution, nor the suspect in their defence, as a result thereof.
If the public prosecutor, pursuant to Article 264, paragraph 2, under b, has refused to have a witness summoned who was specified by the suspect, or has refused to execute an order given by the court to summon a witness, and no order pursuant to Article 226a, paragraph 1, or 226n, paragraph 1, has been issued with respect to that witness, the court shall place the documents in the hands of the examining magistrate for the purpose of having the witness examined. In the case of a witness specified by the suspect, the preceding sentence shall not apply if the court, by a reasoned decision, is of the opinion that the suspect has not been reasonably prejudiced in his defence by the omission of the examination. The public prosecutor shall, immediately after the documents have been placed in the hands of the examining magistrate, submit the motion referred to in Article 226a, paragraph 1, or Article 226m, paragraph 1. Article 316 shall apply mutatis mutandis.
The court may furthermore refrain from summoning or re-summoning witnesses who have not appeared, if the public prosecutor and the suspect expressly consent or have consented thereto.
Article 226 shall apply mutatis mutandis.
De rechtbank kan van de oproeping van niet verschenen getuigen als bedoeld in artikel 287, derde lid, bij met redenen omklede beslissing afzien, indien zij van oordeel is dat:
het onaannemelijk is dat de getuige binnen een aanvaardbare termijn ter terechtzitting zal verschijnen;
het gegronde vermoeden bestaat dat de gezondheid of het welzijn van de getuige of deskundige door het afleggen van een verklaring ter terechtzitting in gevaar wordt gebracht, en het voorkomen van dit gevaar zwaarder weegt dan het belang om de getuige of deskundige ter terechtzitting te kunnen ondervragen;
redelijkerwijs valt aan te nemen dat daardoor het openbaar ministerie niet in zijn vervolging of de verdachte in zijn verdediging wordt geschaad.
Indien de officier van justitie op grond van artikel 264, tweede lid, onder b, heeft geweigerd een door de verdachte opgegeven getuige te doen oproepen of een door de rechtbank gegeven bevel tot oproeping van een getuige ten uitvoer te leggen en ten aanzien van die getuige geen beschikking op grond van artikel 226a, eerste lid, of 226n, eerste lid, is gegeven, stelt de rechtbank de stukken in handen van de rechter-commissaris teneinde de getuige te doen verhoren. In geval van een door de verdachte opgegeven getuige blijft de vorige volzin buiten toepassing, indien de rechtbank bij met redenen omklede beslissing van oordeel is dat door het achterwege blijven van het verhoor de verdachte redelijkerwijs niet in zijn verdediging is geschaad. De officier van justitie dient onmiddellijk nadat de stukken in handen van de rechter-commissaris zijn gesteld, de vordering, bedoeld in artikel 226a, eerste lid, of artikel 226m, eerste lid, in. Artikel 316 is van overeenkomstige toepassing.
De rechtbank kan voorts van de oproeping of hernieuwde oproeping van niet verschenen getuigen afzien, indien de officier van justitie en de verdachte daarmee uitdrukkelijk instemmen of hebben ingestemd.
Artikel 226 is van overeenkomstige toepassing.
