Article 279

The defendant who has not appeared may be represented at the hearing by a lawyer who declares that they have been expressly authorised to do so. The court shall consent to this, without prejudice to the provisions of Article 278, paragraphs two and three.
The hearing of the case against the defendant who has authorised his counsel for his defence shall be deemed to be adversarial proceedings.
De verdachte die niet is verschenen, kan zich ter terechtzitting laten verdedigen door een advocaat die verklaart daartoe uitdrukkelijk te zijn gemachtigd. De rechtbank stemt daarmee in, onverminderd het bepaalde in artikel 278, tweede en derde lid.
De behandeling van de zaak tegen de verdachte die zijn advocaat tot zijn verdediging heeft gemachtigd, geldt als een procedure op tegenspraak.
