The hearing of the case shall be held in public. From the moment the case is called, the court may order that the proceedings be held in camera, in whole or in part. This order may be issued in the interest of public morality, public order, or the security of the state, as well as if the interests of minors, or the protection of the private life of the defendant, other participants in the proceedings, or other persons involved in the case so require. Such an order may also be issued if, in the opinion of the court, publicity would seriously prejudice the interests of the proper administration of justice.

An order as referred to in the first paragraph shall be issued by the court of its own motion, upon the claim of the public prosecution service, or upon the petition of the suspect or other procedural participants. The court shall not issue the order until it has heard the public prosecution service, the suspect, and other procedural participants regarding this matter, if necessary in camera. Article 22, paragraph 4, shall apply mutatis mutandis.

The decision to issue the order referred to in the first paragraph shall be stated, with reasons, in the official record of the court hearing.

The presiding judge may grant special access to attend the closed court hearing.

Unless in special cases at the discretion of the presiding judge, persons who have not yet reached the age of twelve years shall not be admitted as spectators to attend a public court hearing. The presiding judge has the authority to refuse admission to spectators who have not yet reached the age of eighteen years, with the exception of victims between the ages of twelve and eighteen of the charged offence as referred to in Article 51e, paragraph 1, who wish to attend the court hearing.

Het onderzoek ter terechtzitting geschiedt in het openbaar. Vanaf het uitroepen van de zaak kan de rechtbank gehele of gedeeltelijke behandeling met gesloten deuren bevelen. Dit bevel kan worden gegeven in het belang van de goede zeden, de openbare orde, de veiligheid van de staat, alsmede indien de belangen van minderjarigen, of de eerbiediging van de persoonlijke levenssfeer van de verdachte, andere procesdeelnemers of anderszins bij de zaak betrokkenen dit eisen. Een dergelijk bevel kan ook worden gegeven, indien de openbaarheid naar het oordeel van de rechtbank het belang van een goede rechtspleging ernstig zou schaden.

Een bevel als bedoeld in het eerste lid, wordt door de rechtbank ambtshalve, op vordering van het openbaar ministerie of op het verzoek van de verdachte of andere procesdeelnemers gegeven. De rechtbank geeft het bevel niet dan na het openbaar ministerie, de verdachte en andere procesdeelnemers, zo nodig met gesloten deuren, hieromtrent te hebben gehoord. Artikel 22, vierde lid, is van overeenkomstige toepassing.

De beslissing tot het geven van het bevel, bedoeld in het eerste lid, wordt met redenen omkleed in het proces-verbaal van de terechtzitting vermeld.

Tot bijwoning van de niet openbare terechtzitting kan de voorzitter bijzondere toegang verlenen.

Tot bijwoning van een openbare terechtzitting worden, tenzij in bijzondere gevallen ter beoordeling van de voorzitter, als toehoorders niet toegelaten personen die de leeftijd van twaalf jaar nog niet hebben bereikt. De voorzitter heeft de bevoegdheid om toehoorders niet toe te laten, indien deze de leeftijd van achttien jaar nog niet hebben bereikt, met uitzondering van slachtoffers van twaalf tot achttien jaar van het tenlastegelegde feit als bedoeld in artikel 51e, eerste lid, die de terechtzitting wensen bij te wonen.
