The examining magistrate (rechter-commissaris) shall swear in the witness or expert if:
if, in its judgment, there is a well-founded suspicion that this person will be unable to appear at the hearing or that their health or well-being would be endangered by giving a statement at the hearing, and the prevention of this danger outweighs the interest of questioning them at the hearing,
the submission of sworn statements is necessary to obtain the extradition of the suspect;
an agreement pursuant to Article 226h, paragraph 3, or Article 226k, paragraph 1, has been judged to be lawful.
Without prejudice to the swearing-in of a witness pursuant to the first paragraph and Articles 226c, second paragraph, and 226n, second paragraph, the examining magistrate may, if he deems it necessary in connection with the reliability of the statement to be given by the witness, proceed to swearing-in.
If the examining magistrate deems it necessary outside the cases referred to in the first paragraph, under (a) and (b), he may swear in the expert at his examination.
De rechter-commissaris beëdigt de getuige of deskundige indien:
er naar zijn oordeel gegrond vermoeden bestaat dat deze niet op de terechtzitting zal kunnen verschijnen of dat diens gezondheid of welzijn door het afleggen van een verklaring ter terechtzitting in gevaar wordt gebracht, en het voorkomen van dit gevaar zwaarder weegt dan het belang om hem ter terechtzitting te ondervragen,
de overlegging van beëdigde verklaringen noodzakelijk is om de uitlevering van de verdachte te verkrijgen;
een afspraak ingevolge artikel 226h, derde lid, of artikel 226k, eerste lid, rechtmatig is geoordeeld.
Onverminderd de beëdiging van een getuige op grond van het eerste lid en de artikelen 226c, tweede lid, en 226n, tweede lid, kan de rechter-commissaris, indien hij dat noodzakelijk acht in verband met de betrouwbaarheid van de door de getuige af te leggen verklaring, overgaan tot beëdiging.
Indien de rechter-commissaris dit buiten de gevallen bedoeld in het eerste lid, onder a en b, noodzakelijk oordeelt, kan hij de deskundige bij zijn verhoor beëdigen.
