A person is considered a suspect before the commencement of prosecution if, based on facts or circumstances, a reasonable suspicion of guilt regarding a criminal offence arises with respect to that person.

From that moment on, the person against whom the prosecution is directed shall be designated as the suspect.

The rights accruing to the suspect shall also accrue to the official who, in the performance of his duties, has used force and in respect of which use of force a fact-finding investigation as referred to in Article 511a has been instituted, and to the convicted person against whom a criminal financial investigation has been instituted or in respect of whom a claim by the public prosecutor as referred to in Article 36e of the Criminal Code has not yet been irrevocably decided.

The suspect who does not master the Dutch language, or does not master it sufficiently, is entitled to be assisted by an interpreter.

Als verdachte wordt vóórdat de vervolging is aangevangen, aangemerkt degene te wiens aanzien uit feiten of omstandigheden een redelijk vermoeden van schuld aan een strafbaar feit voortvloeit.

Daarna wordt als verdachte aangemerkt degene tegen wie de vervolging is gericht.

De aan de verdachte toekomende rechten komen tevens toe aan de ambtenaar die in de uitoefening van zijn functie geweld heeft gebruikt en ten aanzien van welk geweldgebruik een feitenonderzoek als bedoeld in artikel 511a is ingesteld en de veroordeelde tegen wie een strafrechtelijk financieel onderzoek is ingesteld of te wiens aanzien op een vordering van het openbaar ministerie als bedoeld in artikel 36e van het Wetboek van Strafrecht niet onherroepelijk is beslist.

De verdachte die de Nederlandse taal niet of onvoldoende beheerst, is bevoegd zich te laten bijstaan door een tolk.
