Unless otherwise prescribed, the proceedings in chambers shall not be held in public.
If a public hearing is prescribed, the court in chambers (raadkamer) may order that the hearing be held in whole or in part in camera. This order may be issued in the interest of public morality, public order, or the security of the state, as well as if the interests of minors, or the protection of the private life of the suspect, other participants in the proceedings, or other persons involved in the case so require. Such an order may also be issued if, in the opinion of the court, publicity would seriously prejudice the interests of the proper administration of justice.
An order as referred to in the second paragraph shall be issued by the court in chambers (raadkamer) of its own motion, upon the demand of the Public Prosecution Service, or upon the petition of the suspect or other procedural participants. The court in chambers (raadkamer) shall not issue the order until it has heard the Public Prosecution Service, the suspect, as well as other procedural participants regarding this matter, if necessary in camera.
The court in chambers (de raadkamer) is authorised to establish the identity of the suspect in the manner referred to in Article 27a, paragraph 1, first sentence, and paragraph 2, and of the witness in the manner referred to in Article 27a, paragraph 1, first and second sentence, if there is doubt regarding the identity of the suspect or witness. Article 29c, paragraph 2, applies mutatis mutandis with respect to the witness.
The presiding judge may grant special access to attend the closed hearing.
De behandeling door de raadkamer vindt, tenzij anders is voorgeschreven, niet in het openbaar plaats.
Indien behandeling in het openbaar is voorgeschreven, kan de raadkamer gehele of gedeeltelijke behandeling met gesloten deuren bevelen. Dit bevel kan worden gegeven in het belang van de goede zeden, de openbare orde, de veiligheid van de staat, alsmede indien de belangen van minderjarigen, of de eerbiediging van de persoonlijke levenssfeer van de verdachte, andere procesdeelnemers of anderszins bij de zaak betrokkenen dit eisen. Een dergelijk bevel kan ook worden gegeven indien openbaarheid naar het oordeel van de rechtbank het belang van een goede rechtspleging ernstig zou schaden.
Een bevel als bedoeld in het tweede lid wordt door de raadkamer ambtshalve, op vordering van het openbaar ministerie, dan wel op het verzoek van de verdachte of andere procesdeelnemers gegeven. De raadkamer geeft het bevel niet dan na het openbaar ministerie, de verdachte alsmede andere procesdeelnemers, zonodig met gesloten deuren, hieromtrent te hebben gehoord.
De raadkamer is bevoegd de identiteit van de verdachte vast te stellen op de wijze, bedoeld in artikel 27a, eerste lid, eerste volzin, en tweede lid, en van de getuige op de wijze, bedoeld in artikel 27a, eerste lid, eerste en tweede volzin, indien over de identiteit van de verdachte of getuige twijfel bestaat. Artikel 29c, tweede lid, is ten aanzien van de getuige van overeenkomstige toepassing.
Tot bijwoning van de niet openbare behandeling kan de voorzitter bijzondere toegang verlenen.
