As long as the hearing in court has not yet commenced, Our Minister of Security and Justice may withdraw the granting of a petition for criminal prosecution if it appears from the preliminary investigation or otherwise that there are circumstances which, had they been known at the time of the decision on the petition, would have led to its rejection.
The granting of a petition for criminal prosecution may also be revoked if the sentence to which the suspect has been convicted cannot be executed.
Zolang het onderzoek op de terechtzitting nog niet is aangevangen, kan Onze Minister van Veiligheid en Justitie de inwilliging van een verzoek tot strafvervolging intrekken, indien uit het vooronderzoek of anderszins blijkt van omstandigheden die, waren zij bekend geweest ten tijde van de beslissing op het verzoek, tot afwijzing daarvan zouden hebben geleid.
De inwilliging van een verzoek tot strafvervolging kan eveneens worden ingetrokken, indien de straf waartoe de verdachte is veroordeeld niet ten uitvoer kan worden gelegd.
