As soon as possible after receipt of a timely submitted notice of objection, the court shall examine whether the public prosecution service, upon weighing the interests involved, could reasonably have arrived at its decision.
Pending the court's decision on the petition, the convicted person shall not be released on parole.
If the court finds the objection well-founded, it shall determine the time at which the convicted person is to be released on parole. In doing so, the court may provide advice regarding the special conditions to be imposed.
Zo spoedig mogelijk na ontvangst van een tijdig ingediend bezwaarschrift onderzoekt de rechtbank of het openbaar ministerie bij afweging van de betrokken belangen in redelijkheid tot zijn beslissing heeft kunnen komen.
Hangende de beslissing van de rechtbank op het bezwaarschrift wordt de veroordeelde niet voorwaardelijk in vrijheid gesteld.
Acht de rechtbank het bezwaarschrift gegrond, dan bepaalt zij het tijdstip waarop de veroordeelde voorwaardelijk in vrijheid wordt gesteld. De rechtbank kan daarbij adviseren omtrent de te stellen bijzondere voorwaarden.
