The self-risk bearer (eigenrisicodrager) may, in connection with the execution of Article 42, refuse the WGA benefit partially and permanently, entirely and temporarily, or partially and temporarily if:
the insured person, as referred to in Article 82, has failed to comply or failed to properly comply with obligations as referred to in Article 27, paragraph 2 in conjunction with paragraph 6 and paragraph 4, Article 28, paragraph 1, Article 29, or Article 30;
the insured person, referred to in Article 82, has failed to comply with the obligation, referred to in Article 27, paragraph 1 in conjunction with paragraph 6, within the period established for that purpose by the self-risk bearer (eigenrisicodrager).
If the insured has failed to comply with the obligation referred to in Article 28, 29 or 30 as referred to in Article 88, paragraph 2, the first paragraph shall not apply.
If, on the basis of the first paragraph, the allowance is refused in its entirety, Article 84, third paragraph, shall not apply.
The self-risk bearer (eigenrisicodrager) is authorised to apply Article 67, paragraph 2, subparagraph (c), for a duration of at most eight weeks, whereby the payment may also be partially suspended (opgeschort) or stayed (geschorst).
Further rules may be laid down by or pursuant to an order in council (algemene maatregel van bestuur) with respect to this Article.
De eigenrisicodrager kan in verband met de uitvoering van artikel 42 de WGA-uitkering gedeeltelijk en blijvend, geheel en tijdelijk of gedeeltelijk en tijdelijk weigeren indien:
de verzekerde, bedoeld in artikel 82, verplichtingen als bedoeld in artikel 27, tweede juncto zesde lid en het vierde lid, 28, eerste lid, 29, of 30 niet of niet behoorlijk is nagekomen;
de verzekerde, bedoeld in artikel 82, de verplichting, bedoeld in artikel 27, eerste juncto zesde lid, niet binnen de door de eigenrisicodrager daarvoor vastgestelde termijn is nagekomen.
Indien de verzekerde de verplichting, bedoeld in artikel 28, 29 of 30, niet heeft nageleefd als bedoeld in artikel 88, tweede lid, is het eerste lid niet van toepassing.
Indien op grond van het eerste lid de uitkering geheel wordt geweigerd is artikel 84, derde lid, niet van toepassing.
De eigenrisicodrager is bevoegd artikel 67, tweede lid, onderdeel c, toe te passen voor de duur van ten hoogste acht weken, waarbij de betaling ook gedeeltelijk kan worden opgeschort of geschorst.
Bij of krachtens algemene maatregel van bestuur kunnen nadere regels worden gesteld met betrekking tot dit artikel.
