If, for the implementation of the Directive, a special negotiating body or an SCE works council or another information and consultation procedure is established in a Member State other than the Netherlands, Articles 2:11, paragraphs two up to and including eight, and 2:24, paragraph four, shall apply mutatis mutandis to the election or appointment of the Dutch members.
If, for the implementation of the directive, the right referred to in Article 2:34, paragraph 3, can be exercised by Dutch employees in a Member State other than the Netherlands, Article 2:11, paragraphs 2 up to and including 8, shall apply mutatis mutandis to the exercise of that right.
Indien ter uitvoering van de richtlijn in een andere lidstaat dan Nederland een bijzondere onderhandelingsgroep dan wel een SCE-ondernemingsraad of een andere informatie- en raadplegingsprocedure wordt ingesteld, zijn op de verkiezing of aanwijzing van de Nederlandse leden de artikelen 2:11, tweede tot en met achtste lid, en 2:24, vierde lid, van overeenkomstige toepassing.
Indien ter uitvoering van de richtlijn in een andere lidstaat dan Nederland door Nederlandse werknemers het recht, bedoeld in artikel 2:34, derde lid, kan worden uitgeoefend, is op de uitoefening van dat recht 2:11, tweede tot en met achtste lid, van overeenkomstige toepassing.
