The SCE shall inform the SCE works council as soon as possible regarding all extraordinary circumstances and intended decisions that have significant consequences for the interests of the employees, in particular concerning the relocation or closure of establishments or undertakings or collective redundancy.
If the SCE works council or, if it decides to do so for urgent reasons, the select committee, so requests, it shall meet with the SCE or another more appropriate management level within the SCE having its own decision-making authority regarding the subjects to be discussed, in order to be further informed and consulted on the circumstances referred to in the first paragraph. Upon conclusion of the meeting or within a reasonable period after the meeting, an opinion may be issued by the SCE works council or the select committee.
If the SCE decides not to follow the advice of the SCE works council, the council or the limited committee shall be given the opportunity to meet with the SCE once more in order to attempt to reach an agreement.
The meeting referred to in the second and third paragraphs shall take place at such a time that such information and consultation may still be effective. This meeting shall not prejudice the powers of the SCE.
The members of the SCE works council who have also been elected by the employees of the establishments or undertakings that are directly affected by the measures shall also be invited to a meeting with the limited committee.
De SCE licht zo spoedig mogelijk de SCE-ondernemingsraad in over alle buitengewone omstandigheden en voorgenomen besluiten die aanzienlijke gevolgen hebben voor de belangen van de werknemers, in het bijzonder betreffende verplaatsing of sluiting van vestigingen of ondernemingen of collectief ontslag.
Indien de SCE-ondernemingsraad of, indien hij daartoe om spoedeisende redenen besluit het beperkt comité, dat verzoekt, komt deze met de SCE of een ander geschikter bestuursniveau binnen de SCE met een eigen beslissingsbevoegdheid op het gebied van de te behandelen onderwerpen in vergadering bijeen, om over de in het eerste lid genoemde omstandigheden nader te worden geïnformeerd en geraadpleegd. Na afloop van de vergadering of binnen een redelijke termijn na de vergadering kan een advies door de SCE-ondernemingsraad of het beperkt comité worden uitgebracht.
Indien de SCE besluit om het advies van de SCE-ondernemingsraad niet te volgen, wordt de raad of het beperkt comité in de gelegenheid gesteld om nogmaals met de SCE in vergadering bijeen te komen om te trachten tot overeenstemming te komen.
De in het tweede en derde lid bedoelde vergadering vindt plaats op een zodanig tijdstip dat die informatie en raadpleging nog zinvol is. Deze vergadering doet geen afbreuk aan de bevoegdheden van de SCE.
Voor een vergadering met het beperkt comité worden mede uitgenodigd de leden van de SCE-ondernemingsraad die mede gekozen zijn door de werknemers van de vestigingen of ondernemingen die door de maatregelen rechtstreeks worden geraakt.
