The special negotiating body may decide:
for the approval of an agreement as referred to in Article 2:12, paragraph 1;
to refrain from entering into negotiations or to terminate negotiations already commenced.
The decision referred to in the first paragraph, point (b), terminates the procedure for concluding an agreement and has the effect that the rules regarding the information and consultation of employees apply, which are in force in the Member States where the SCE has employees. Following this decision, Section 3 of this Chapter shall not apply.
De bijzondere onderhandelingsgroep kan besluiten:
tot goedkeuring van een overeenkomst als bedoeld in artikel 2:12, eerste lid;
af te zien van het openen van onderhandelingen of tot het beëindigen van reeds geopende onderhandelingen.
Het besluit, bedoeld in het eerste lid, onderdeel b, beëindigt de procedure tot sluiting van een overeenkomst en heeft tot gevolg dat de regels op het gebied van informatie en raadpleging van werknemers van toepassing zijn, die gelden in de lidstaten waar de SCE werknemers heeft. Na dit besluit is afdeling 3 van dit hoofdstuk niet van toepassing.
