The following persons are employed at the Functional Public Prosecutor's Office (functioneel parket):
a chief public prosecutor;
a deputy chief public prosecutor;
public prosecutors;
deputy public prosecutors;
prosecutors sitting in single-judge sessions
deputy public prosecutors in single-judge sessions
other officials.
The following persons may be employed at the functional public prosecutor's office (functioneel parket):
senior public prosecutors A;
senior public prosecutors
deputy public prosecutors;
officers in training
At the head of the Functional Public Prosecutor's Office stands the Chief Public Prosecutor with the title of Head of the Functional Public Prosecutor's Office. He may issue general and specific instructions to the officials working at his office regarding the exercise of the tasks and powers of the office. In the event of the absence, impediment, or vacancy of the Head of the Functional Public Prosecutor's Office, he shall be replaced by the Deputy Chief Public Prosecutor.
The chief public prosecutor, deputy chief public prosecutor, senior public prosecutors A, senior public prosecutors, public prosecutors, assistant public prosecutors and deputy public prosecutors, as well as single-judge session prosecutors and deputy single-judge session prosecutors, respectively, are by operation of law deputy public prosecutors or deputy single-judge session prosecutors, respectively, at the district public prosecutor's offices, at the national public prosecutor's office, at the public prosecutor's office for central processing of the public prosecution service, and at the office of the public prosecutor general.
The single-hearing public prosecutor and the deputy single-hearing public prosecutor have the powers and obligations that are granted to the public prosecutor by or pursuant to the law, with the exception of the authority to appear at the hearing of a multiple-judge chamber of the court.
Bij het functioneel parket zijn werkzaam:
een hoofdofficier van justitie;
een plaatsvervangend hoofdofficier van justitie;
officieren van justitie;
plaatsvervangende officieren van justitie;
officieren enkelvoudige zittingen;
plaatsvervangende officieren enkelvoudige zittingen
andere ambtenaren.
Bij het functioneel parket kunnen werkzaam zijn:
senior officieren van justitie A;
senior officieren van justitie;
substituut-officieren van justitie;
officieren in opleiding.
Aan het hoofd van het functioneel parket staat de hoofdofficier van justitie met de titel hoofd van het functioneel parket. Hij kan algemene en bijzondere aanwijzingen geven aan de bij zijn parket werkzame ambtenaren betreffende de uitoefening van de taken en bevoegdheden van het parket. In geval van afwezigheid, belet of ontstentenis van het hoofd van het functioneel parket wordt hij vervangen door de plaatsvervangend hoofdofficier van justitie.
De hoofdofficier van justitie, plaatsvervangend hoofdofficier van justitie, senior officieren van justitie A, senior officieren van justitie, officieren van justitie, substituut-officieren van justitie en plaatsvervangende officieren van justitie onderscheidenlijk officieren enkelvoudige zittingen en plaatsvervangende officieren enkelvoudige zittingen zijn van rechtswege plaatsvervangend officier van justitie onderscheidenlijk plaatsvervangend officier enkelvoudige zittingen bij de arrondissementsparketten, bij het landelijk parket, bij het parket centrale verwerking openbaar ministerie en bij het parket-generaal.
De officier enkelvoudige zittingen en de plaatsvervangende officier enkelvoudige zittingen hebben de bevoegdheden en verplichtingen die bij of krachtens de wet aan de officier van justitie worden toegekend, met uitzondering van de bevoegdheid om op te treden ter terechtzitting van een meervoudige kamer van de rechtbank.
