The works council shall draw up standing orders in which the subjects are regulated that are assigned or left to the works council for regulation by or pursuant to this Act. The standing orders shall not contain any provisions that are contrary to the law or that impede the proper application of this Act. Before adopting the standing orders, the works council shall provide the entrepreneur with the opportunity to make their position known. The works council shall provide the entrepreneur with a copy of the adopted standing orders without delay.
The Council may, by regulation, lay down further rules regarding the content of the regulations for all or a group of enterprises. In the latter case, the relevant industrial committee (bedrijfscommissie) shall be heard. A regulation of the Council requires the approval of Our Minister. An approved regulation shall be published in the Government Gazette (Staatscourant).
If the Council adopts a regulation as referred to in the second paragraph, the works councils concerned shall, within one year after the publication of the approved regulation in the Government Gazette (Staatscourant), bring the provisions in their regulations that are in conflict with this regulation into conformity therewith.
De ondernemingsraad maakt een reglement waarin de onderwerpen worden geregeld die bij of krachtens deze wet ter regeling aan de ondernemingsraad zijn opgedragen of overgelaten. Het reglement bevat geen bepalingen die in strijd zijn met de wet of die een goede toepassing van deze wet in de weg staan. Alvorens het reglement vast te stellen, stelt de ondernemingsraad de ondernemer in de gelegenheid zijn standpunt kenbaar te maken. De ondernemingsraad verstrekt onverwijld een exemplaar van het vastgestelde reglement aan de ondernemer.
De Raad kan ten aanzien van de inhoud van het reglement bij verordening nadere regelen stellen voor alle of een groep van ondernemingen. In het laatste geval wordt de betrokken bedrijfscommissie gehoord. Een verordening van de Raad behoeft de goedkeuring van Onze Minister. Een goedgekeurde verordening wordt in de Staatscourant bekend gemaakt.
Indien de Raad een verordening als bedoeld in het tweede lid vaststelt, brengen de betrokken ondernemingsraden binnen een jaar na de bekendmaking van de goedgekeurde verordening in de Staatscourant, de bepalingen in hun reglement die in strijd zijn met deze verordening daarmee in overeenstemming.
