Performing artists who are nationals of a state that is not a member state of the European Union or a state party to the Agreement on the European Economic Area of 2 May 1992, and which is not a party to the Rome Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organisations, and broadcasting organisations whose head office is established in a state as referred to above, may not invoke the rights granted by this Act if the duration thereof has already expired under national legislation.
The provisions of the first paragraph shall apply mutatis mutandis to
producers of phonograms who are nationals of a state, other than a Member State of the European Union or a state that is a party to the Agreement on the European Economic Area of 2 May 1992, which is not a party to the Convention referred to in the first paragraph or to the Convention for the Protection of Producers of Phonograms Against Unauthorized Duplication of Their Phonograms;
producers of the first fixation of films who are nationals of a state, other than a member state of the European Union or a state that is a party to the Agreement on the European Economic Area of 2 May 1992, whose national legislation provides for a shorter term of protection than that referred to in Article 12, paragraph 4.
Uitvoerende kunstenaars die onderdaan zijn van een staat, niet zijnde een lid-staat van de Europese Unie of een staat die partij is bij de overeenkomst betreffende de Europese Economische Ruimte van 2 mei 1992, die geen partij is bij het Verdrag van Rome inzake de bescherming van uitvoerende kunstenaars, producenten van fonogrammen en omroeporganisaties, en omroeporganisaties, waarvan het hoofdkantoor is gevestigd in een staat als hiervoor bedoeld, kunnen geen beroep doen op de door deze wet verleende rechten, indien de duur daarvan ingevolge de nationale wetgeving reeds is verstreken.
Het in het eerste lid bepaalde is eveneens van toepassing op
producenten van fonogrammen die onderdaan zijn van een staat, niet zijnde ene lid-staat van de Europese Unie of een staat die partij is bij de overeenkomst betreffende de Europese Economische Ruimte van 2 mei 1992, die geen partij is bij het in het eerste lid bedoelde Verdrag of bij de Overeenkomst ter bescherming van producenten van fonogrammen tegen het ongeoorloofd kopiëren van hun fonogrammen;
producenten van eerste vastlegging van films die onderdaan zijn van een staat, niet zijnde een lid-staat van de Europese Unie of een staat die partij is bij de overeenkomst betreffende de Europese Economische Ruimte van 2 mei 1992, waarvan de nationale wetgeving in een kortere beschermingstermijn voorziet dan die bedoeld in artikel 12, vierde lid.
