The determination of the support and guidance, as referred to in Article 15, paragraph 1, subparagraph b, shall be such that the municipal executive (college) has sufficient insight into the progress of the fulfillment of the civic integration obligation by the person subject to the civic integration obligation.
When the municipal executive (college) is of the opinion that there is insufficient progress or greater progress than was to be expected on the basis of the personal integration and participation plan, referred to in Article 15, the municipal executive may, within a period to be determined by administrative order, re-establish the learning route to be followed by the person subject to the integration requirement.
When, after substantial efforts by the person integrated under a statutory obligation who follows the learning route referred to in Article 7, it appears from the relevant facts and circumstances that this person is unable to achieve level B1 of the Common European Framework of Reference for Languages within the period referred to in Article 11, paragraph 1, the period extended pursuant to Article 12, or the new period established pursuant to Article 25, paragraph 2, the municipal executive (college) may determine that the oral and written skills in the Dutch language, in deviation from Article 7, paragraph 1, part a, shall be examined in whole or in part at level A2.
By or pursuant to an Order in Council (algemene maatregel van bestuur), rules shall be established regarding the third paragraph, whereby in any event rules shall be established regarding the substantial efforts.
De vaststelling van de ondersteuning en begeleiding, bedoeld in artikel 15, eerste lid, onderdeel b, is zodanig dat het college voldoende zicht heeft op de voortgang van het voldoen aan de inburgeringsplicht door de inburgeringsplichtige.
Wanneer het college van oordeel is dat er sprake is van onvoldoende voortgang of een grotere voortgang dan op grond van het persoonlijke plan inburgering en participatie, bedoeld in artikel 15, was te verwachten, kan het college op een bij algemene maatregel van bestuur te bepalen termijn de door de inburgeringsplichtige te volgen leerroute opnieuw vaststellen.
Wanneer, na aanzienlijke inspanningen van de inburgeringsplichtige die de leerroute, bedoeld in artikel 7 volgt, uit de relevante feiten en omstandigheden blijkt dat deze inburgeringsplichtige niet in staat is het niveau B1 van het Gemeenschappelijk Europees Referentiekader voor Moderne Vreemde Talen te behalen binnen de termijn, bedoeld in artikel 11, eerste lid, de op grond van artikel 12 verlengde termijn, of de op grond van artikel 25, tweede lid, vastgestelde nieuwe termijn, kan het college bepalen dat de mondelinge en schriftelijke vaardigheden in de Nederlandse taal, in afwijking van artikel 7, eerste lid, onderdeel a, geheel of gedeeltelijk op het niveau A2 worden geëxamineerd.
Bij of krachtens algemene maatregel van bestuur worden regels gesteld over het derde lid waarbij in ieder geval regels worden gesteld over de aanzienlijke inspanningen.
