If, for the implementation of the Directive, a special negotiating body or a European Works Council as referred to in the annex to the Directive is established in a Member State other than the Netherlands within a Community-scale undertaking or group, Articles 10 and 17 shall apply mutatis mutandis to the Dutch establishments or undertakings of that Community-scale undertaking or group.
Indien ter uitvoering van de richtlijn in een andere betrokken staat dan Nederland bij een communautaire onderneming of groep een bijzondere onderhandelingsgroep dan wel een Europese ondernemingsraad als bedoeld in de bijlage bij de richtlijn wordt ingesteld, zijn op de Nederlandse vestigingen of ondernemingen van die communautaire onderneming of groep de artikelen 10 en 17 van overeenkomstige toepassing.
