in forceOur Minister is authorised to revoke the declaration of binding effect at any time.
If Our Minister contemplates revoking the declaration of general binding force of provisions of a collective labour agreement, he shall notify the parties to the collective labour agreement thereof and shall afford them the opportunity to make their objections thereto known in writing or orally. Furthermore, Our Minister may enter into consultation regarding this matter with the Labour Foundation (Stichting van de Arbeid).
The withdrawal of the declaration of binding effect shall have no retroactive effect.
A record of the withdrawal shall be kept in the register referred to in Article 5, paragraph 3.
Onze Minister is bevoegd te allen tijde de verbindendverklaring in te trekken.
Indien Onze Minister overweegt de verbindendverklaring van bepalingen van eene collectieve arbeidsovereenkomst in te trekken, geeft hij daarvan kennis aan hen, die bij de collectieve arbeidsovereenkomst partij zijn en stelt hen in de gelegenheid hunne bezwaren daartegen schriftelijk of mondeling kenbaar te maken. Voorts kan Onze Minister ter zake in overleg treden met de Stichting van de Arbeid.
Intrekking van de verbindendverklaring heeft geen terugwerkende kracht.
Van de intrekking wordt aanteekening gehouden in het register, bedoeld in artikel 5, derde lid.
