Market participants are prohibited from acting in contravention of the articles of an EU regulation or directive specified by ministerial regulation in connection with the type-approval of motor vehicles, which relate to the making available on the market or the placing on the market of vehicles and systems, components, separate technical units, vehicle parts, equipment and facilities for such vehicles and their trailers, or facilities for the protection of vehicle occupants and vulnerable road users:
without such approval having been granted, or if the impression of approval is created by means of documents, certificates of conformity, prescribed plates or approval marks which have been forged;
if the requirements set for approval are not met;
without it having been approved by the Netherlands Vehicle Authority (Dienst Wegverkeer) by means of a dispensation, exemption, or without a permit having been granted for that purpose, or while acting in violation of the regulations or restrictions attached to a dispensation, exemption, or permit; or
which are provided with forged or incorrect certificates of conformity, plates or approval marks with the intent to mislead others.
Market participants are prohibited from acting in contravention of the articles of an EU regulation referred to by ministerial regulation in connection with the type-approval of motor vehicles, which relate to the offering for sale or placing on the market, without certificates of conformity or without prescribed plates or approval marks, of vehicles and systems, components, separate technical units, vehicle parts, equipment and facilities for such vehicles and trailers, or facilities for the protection of vehicle occupants and vulnerable road users.
Market participants are prohibited from acting in contravention of the articles of an EU regulation or directive specified by ministerial regulation in connection with the type-approval of motor vehicles that relate to:
the use of defeat devices or strategies or the falsification of test results for type-approval or market surveillance;
the making of false statements during approval procedures or procedures that lead or could lead to a recall, or while corrective or restrictive measures are in force;
the withholding of data or technical specifications which could lead to the refusal or withdrawal of the approval or to a recall;
refusal of access to information; or
obligations incumbent upon market operators in connection with the approval process, market surveillance, or in connection with the making available on the market or the placing on the market of vehicles, systems, components, separate technical units, vehicle parts, equipment and features for such vehicles and trailers, or features for the protection of vehicle occupants and vulnerable road users.
Het is marktdeelnemers verboden in strijd te handelen met de bij ministeriële regeling genoemde artikelen van een EU-verordening of -richtlijn in verband met de goedkeuring van motorvoertuigen, die betrekking hebben op het op de markt aanbieden of in de handel brengen van voertuigen en systemen, onderdelen, technische eenheden, voertuigdelen, uitrustingsstukken en voorzieningen voor dergelijke voertuigen en aanhangwagens daarvan of voorzieningen ter bescherming van inzittenden van voertuigen en kwetsbare weggebruikers:
zonder dat daarvoor goedkeuring is verleend of indien de indruk van goedkeuring wordt gewekt met documenten, certificaten van overeenstemming, voorgeschreven platen of goedkeuringsmerken, die zijn vervalst;
indien niet aan de voor goedkeuring gestelde eisen wordt voldaan;
zonder dat het door de Dienst Wegverkeer is goedgekeurd met een ontheffing, vrijstelling, of zonder dat een vergunning daarvoor is verleend of terwijl in strijd met de aan een ontheffing, vrijstelling of vergunning verbonden voorschriften of beperkingen wordt gehandeld; of
die zijn voorzien van vervalste of onjuiste certificaten van overeenstemming, platen of goedkeuringsmerken met het doel anderen te misleiden.
Het is marktdeelnemers verboden in strijd te handelen met de bij ministeriële regeling genoemde artikelen van een EU-verordening in verband met de goedkeuring van motorvoertuigen, die betrekking hebben op het zonder certificaten van overeenstemming of zonder voorgeschreven platen of goedkeuringsmerken op de markt aanbieden of in de handel brengen van voertuigen en systemen, onderdelen, technische eenheden, voertuigdelen, uitrustingsstukken en voorzieningen voor dergelijke voertuigen en aanhangwagens of voorzieningen ter bescherming van inzittenden van voertuigen en kwetsbare weggebruikers.
Het is marktdeelnemers verboden in strijd te handelen met de bij ministeriële regeling genoemde artikelen van een EU-verordening of -richtlijn in verband met de goedkeuring van motorvoertuigen die betrekking hebben op:
het gebruik van manipulatie-instrumenten of -strategieën of het vervalsen van testresultaten voor typegoedkeuring of markttoezicht;
het afleggen van valse verklaringen tijdens goedkeuringsprocedures of procedures die tot terugroeping leiden of zouden kunnen leiden dan wel terwijl er corrigerende of beperkende maatregelen gelden;
het achterhouden van gegevens of technische specificaties die tot weigering of intrekking van de goedkeuring of tot terugroeping zouden kunnen leiden;
het weigeren van toegang tot informatie; of
op marktdeelnemers rustende verplichtingen in verband met het goedkeuringsproces, het markttoezicht of in verband met het op de markt aanbieden of in de handel brengen van voertuigen, systemen, onderdelen, technische eenheden, voertuigdelen, uitrustingsstukken en voorzieningen voor dergelijke voertuigen en aanhangwagens of voorzieningen ter bescherming van inzittenden van voertuigen en kwetsbare weggebruikers.
