An approval as referred to in Article 21, paragraph 1, or a dispensation, exemption or permit as referred to in Article 21, paragraph 3, may be granted by the Netherlands Vehicle Authority (Dienst Wegverkeer) upon application.
A national type-approval or individual approval issued by an approval authority of another Member State of the European Union shall be deemed equivalent by the Netherlands Vehicle Authority (Dienst Wegverkeer) to a national type-approval or individual approval, provided that the conditions for equivalence set out in the relevant EU regulation concerning the approval of motor vehicles are met.
The second paragraph shall apply mutatis mutandis to a national type-approval or individual approval granted by the competent authority of another state that is a party to the Agreement on the European Economic Area or granted by the authority competent for that purpose in Switzerland, if this follows from the Agreement between the European Community and the Swiss Confederation on mutual recognition in relation to conformity assessment, concluded in Luxembourg on 21 June 1999 (OJ EC L 114).
An EU type-approval or individual EU approval, as referred to in Article 21, paragraph 2, point (a), or an exemption, waiver or permit, as referred to in Article 21, paragraph 3, point (a), may also have been granted by an approval authority of another Member State of the European Union as referred to in an EU regulation in connection with the approval of motor vehicles.
A UN/ECE approval may also have been granted by the competent authority in a State that is a party to the 1958 Agreement.
Een goedkeuring als bedoeld in artikel 21, eerste lid, of een ontheffing, vrijstelling of vergunning, bedoeld in artikel 21, derde lid, kan op aanvraag door de Dienst Wegverkeer worden verleend.
Een nationale typegoedkeuring of -individuele goedkeuring die is afgegeven door een goedkeuringsinstantie van een andere lidstaat van de Europese Unie wordt door de Dienst Wegverkeer gelijkgesteld met een nationale typegoedkeuring of -individuele goedkeuring indien wordt voldaan aan de voor gelijkstelling gestelde voorwaarden in de betreffende EU-verordening in verband met de goedkeuring van motorvoertuigen.
Het tweede lid is van overeenkomstige toepassing op een nationale typegoedkeuring of -individuele goedkeuring die is verleend door het bevoegd gezag van een andere staat die partij is bij de Overeenkomst betreffende de Europese Economische Ruimte of die is verleend door het daartoe bevoegde gezag in Zwitserland indien dit voortvloeit uit de op 21 juni 1999 te Luxemburg tot stand gekomen Overeenkomst tussen de Europese Gemeenschap en de Zwitserse Bondsstaat inzake de wederzijdse erkenning van de overeenstemmingsbeoordeling (PbEG L 114).
Een EU-typegoedkeuring of individuele EU-goedkeuring, als bedoeld in artikel 21, tweede lid, onderdeel a, of een ontheffing, vrijstelling of vergunning, bedoeld in artikel 21, derde lid, onderdeel a, kan ook zijn verleend door een goedkeuringsinstantie van een andere lidstaat van de Europese Unie als bedoeld in een EU-verordening in verband met de goedkeuring van motorvoertuigen.
Een VN/ECE goedkeuring kan ook zijn verleend door het daartoe bevoegde gezag in een Staat die partij is bij de Overeenkomst van 1958.
