The Provincial Executive may issue a directive to the boards of water boards to adopt and implement, within thirteen weeks, a traffic order with a content to be specified therein, regarding roads located outside built-up areas for which those bodies are authorised to adopt traffic orders.
The first paragraph may be applied if:
on a road located outside the built-up area, which is under the management of several bodies, in the opinion of the Provincial Executive one or more uncoordinated traffic regulations are in force, which require such coordination with a view to the interests described in Article 2, paragraph 1, points (a), (c) and (d), and paragraph 2, or
the Provincial Executive is of the opinion that the adoption of a traffic order is necessary for the protection of the interests referred to in Article 2, paragraph 2.
Prior to issuing an instruction as referred to in the first paragraph, the Provincial Executive (Gedeputeerde staten) shall consult with the administrative body concerned.
The relevant administrative body is obliged to comply with and implement an instruction as referred to in the first paragraph.
If a directive as referred to in the first paragraph is not complied with or implemented, the Provincial Executive shall proceed to adopt the traffic order at the expense of the administrative body concerned and, if necessary, to the implementation thereof.
Rules regarding the formation and content of the instructions referred to in the first paragraph, as well as regarding any other matters necessary for the implementation of this article, shall be established by Order in Council.
Gedeputeerde staten kunnen aan besturen van waterschappen de aanwijzing geven om op buiten de bebouwde kom gelegen wegen, ten aanzien waarvan die organen bevoegd zijn tot het nemen van verkeersbesluiten, binnen dertien weken een verkeersbesluit van een daarbij aan te geven inhoud te nemen en uit te voeren.
Het eerste lid mag worden toegepast, indien:
op een buiten de bebouwde kom gelegen weg, die bij meerdere organen in beheer is, naar het oordeel van gedeputeerde staten een of meerdere niet op elkaar afgestemde verkeersbesluiten van kracht zijn, die zodanige afstemming behoeven met het oog op de belangen, omschreven in artikel 2, eerste lid, onderdelen a, c en d, en tweede lid, of
gedeputeerde staten van oordeel zijn dat het nemen van een verkeersbesluit noodzakelijk is ter bescherming van de belangen, bedoeld in artikel 2, tweede lid.
Gedeputeerde staten dienen voorafgaande aan het geven van een aanwijzing als bedoeld in het eerste lid overleg te voeren met het betrokken bestuur.
Het betrokken bestuur is verplicht een aanwijzing als bedoeld in het eerste lid op te volgen en uit te voeren.
Indien een aanwijzing als bedoeld in het eerste lid niet wordt opgevolgd of uitgevoerd, gaan gedeputeerde staten op kosten van het betrokken bestuur tot het nemen van het verkeersbesluit en zo nodig tot de uitvoering daarvan over.
Bij algemene maatregel van bestuur worden regels vastgesteld over de totstandkoming en de inhoud van de in het eerste lid bedoelde aanwijzingen alsmede over hetgeen verder voor de uitvoering van dit artikel noodzakelijk is.
