By way of derogation from Article 8, the service provider who posts a posted driver to the Netherlands is obliged to submit a posting declaration to Our Minister via the IMI at a time prior to the commencement of the activities, containing the following information:
the identity of the service provider;
the contact details of the contact person;
the identity, the place of residence and the driving licence number of the posted driver;
the commencement date of the employment agreement of the posted driver and the law applicable thereto;
the presumed duration of the secondment;
the registration plates of the motor vehicles; and
the nature of the transport services performed.
The service provider shall keep the posting declarations up to date in the IMI.
In afwijking van artikel 8 is de dienstverrichter, die een gedetacheerde bestuurder detacheert naar Nederland, verplicht om op een tijdstip voor aanvang van de werkzaamheden een detacheringsverklaring in te dienen bij Onze Minister via het IMI, met de volgende informatie:
de identiteit van de dienstverrichter;
de contactgegevens van de contactpersoon;
de identiteit, de verblijfplaats en het nummer van het rijbewijs van de gedetacheerde bestuurder;
de aanvangsdatum van de arbeidsovereenkomst van de gedetacheerde bestuurder en het daarop toepasselijke recht;
de vermoedelijke duur van de detachering;
de kentekenplaten van de motorvoertuigen; en
de aard van de verrichte vervoersdiensten.
De dienstverrichter houdt de detacheringsverklaringen actueel in het IMI.
