By way of derogation from Article 8:104, paragraph 1, of the General Administrative Law Act (Algemene wet bestuursrecht), no appeal shall lie against a judgment of the court or of the relief judge (voorzieningenrechter) of the court:
concerning a decision or act on the basis of Article 6, paragraph 1, Article 6a, paragraph 1, Chapter 4 or Chapter 5;
concerning a visa for a stay of 90 days or less;
after application of Article 78, or
on the award of the compensation referred to in Article 106.
In afwijking van artikel 8:104, eerste lid, van de Algemene wet bestuursrecht staat geen hoger beroep open tegen een uitspraak van de rechtbank of van de voorzieningenrechter van de rechtbank:
over een besluit of handeling op grond van artikel 6, eerste lid, artikel 6a, eerste lid, hoofdstuk 4 of hoofdstuk 5;
over een visum voor een verblijf van 90 dagen of minder;
na toepassing van artikel 78, of
over de toekenning van de vergoeding, bedoeld in artikel 106.

By decision of 13 February 2025, the Minister of Asylum and Migration has detained the appellant.
Decision on rechtspraak.nlBy decision of 8 February 2025, the Central Agency for the Reception of Asylum Seekers (Centraal Orgaan opvang asielzoekers) transferred the person concerned to the Enforcement and Supervision Location (Handhavings- en Toezichtlocatie (HTL)) in Hoogeveen. The COA transferred the person concerned to the HTL on 8 February 2025 because, according to the COA, she was involved in an incident with a ‘very high impact’ as referred to in paragraph 4.1 of the COA Measures Policy of November 2024 (Maatregelenbeleid COa). The COA based that transfer on the following. On 5 February 2025, COA staff informed the person concerned during a measures interview that the COA would impose a so-called ROV measure on her following an incident on 3 February 2025, where ROV stands for: regulations on the withholding of provisions (reglement onthouding verstrekkingen). That measure entailed that the person concerned had to go to a so-called time-out location and had to leave the reception location where she was staying at that time within one hour. During that interview, the COA staff established that the person concerned smelled strongly of alcohol and spoke with a thick tongue.
