1. Within the Member State whose courts have jurisdiction under Article 79(1) or (4), those courts shall have jurisdiction for actions relating to Community designs other than those referred to in Article 81 which would have jurisdiction ratione loci and ratione materiae in the case of actions relating to a national design right in that State.
2. Actions relating to a Community design, other than those referred to in Article 81, for which no court has jurisdiction pursuant to Article 79(1) and (4) and paragraph 1 of this Article may be heard before the courts of the Member State in which the Office has its seat.

Aanvullende bepalingen inzake de bevoegdheid van andere nationale rechterlijke instanties dan de rechtbanken voor het Gemeenschapsmodel
1. In de lidstaat waar de rechterlijke instanties volgens artikel 79, lid 1 of lid 4, bevoegd zijn, worden andere rechtsvorderingen betreffende Gemeenschapsmodellen dan de in artikel 81 bedoelde ingesteld bij de rechterlijke instanties die absoluut en relatief bevoegd zouden zijn indien het rechtsvorderingen inzake een nationaal modelrecht van die lidstaat zou betreffen.
2. Indien op grond van artikel 79, leden 1 en 4, en lid 1 van dit artikel geen rechterlijke instantie bevoegd is voor een andere rechtsvordering betreffende een Gemeenschapsmodel dan de in artikel 81 bedoelde rechtsvorderingen, kan deze rechtsvordering worden ingesteld bij de rechterlijke instanties van de lidstaat waar het Bureau is gevestigd.
