Article 80
in forceJURISDICTION AND PROCEDURE IN LEGAL ACTIONS RELATING TO COMMUNITY DESIGNS
1. The Member States shall designate in their territories as limited a number as possible of national courts and tribunals of first and second instance (Community design courts) which shall perform the functions assigned to them by this Regulation.
2. Each Member State shall communicate to the Commission not later than 6 March 2005 a list of Community design courts, indicating their names and their territorial jurisdiction.
3. Any change made after communication of the list referred to in paragraph 2 in the number, names or territorial jurisdiction of the Community design courts shall be notified without delay by the Member State concerned to the Commission.
4. The information referred to in paragraphs 2 and 3 shall be notified by the Commission to the Member States and published in the Official Journal of the European Communities.
5. As long as a Member State has not communicated the list as stipulated in paragraph 2, jurisdiction for any proceedings resulting from an action covered by Article 81 for which the courts of that State have jurisdiction pursuant to Article 82 shall lie with that court of the State in question which would have jurisdiction ratione loci and ratione materiae in the case of proceedings relating to a national design right of that State.
1. De lidstaten wijzen op hun grondgebied een zo gering mogelijk aantal nationale rechterlijke instanties van eerste en tweede aanleg aan, de "rechtbanken voor het Gemeenschapsmodel", die de hun bij deze verordening opgedragen taken vervullen.
2. Uiterlijk 6 maart 2005 deelt elke lidstaat aan de Commissie een lijst mee van rechtbanken voor het Gemeenschapsmodel met hun naam en territoriale bevoegdheid.
3. Elke verandering betreffende het aantal, de namen of de territoriale bevoegdheid van de rechtbanken voor het Gemeenschapsmodel, die na de in lid 2 bedoelde mededeling plaatsvindt, wordt door de betrokken lidstaat onverwijld aan de Commissie gemeld.
4. De in de leden 2 en 3 bedoelde gegevens worden door de Commissie aan de lidstaten meegedeeld en in het Publicatieblad van de Europese Gemeenschappen bekendgemaakt.
5. Zolang een lidstaat de in lid 2 bedoelde mededeling niet heeft gedaan, wordt elke procedure die het gevolg is van de in artikel 81 bedoelde vorderingen en waarvoor de rechterlijke instanties van die lidstaat krachtens artikel 82 bevoegd zijn, ingesteld bij de rechterlijke instantie van die staat die absoluut en relatief bevoegd zou zijn indien het procedures inzake een nationaal modelrecht van die staat zou betreffen.
