in forceSURRENDER AND INVALIDITY OF THE REGISTERED COMMUNITY DESIGN
1. If the Office finds that the application for a declaration of invalidity is admissible, the Office shall examine whether the grounds for invalidity referred to in Article 25 prejudice the maintenance of the registered Community design.
2. In the examination of the application, which shall be conducted in accordance with the implementing regulation, the Office shall invite the parties, as often as necessary, to file observations, within a period to be fixed by the Office, on communications from the other parties or issued by itself.
3. The decision declaring the registered Community design invalid shall be entered in the register upon becoming final.
1. Indien het Bureau vaststelt dat de vordering tot nietigverklaring ontvankelijk is, onderzoekt het of de in artikel 25 genoemde nietigheidsgronden een beletsel vormen voor de instandhouding van het ingeschreven Gemeenschapsmodel.
2. Bij het onderzoek van de vordering overeenkomstig de uitvoeringsverordening verzoekt het Bureau zo dikwijls als nodig de partijen binnen een door het Bureau te stellen termijn te antwoorden op mededelingen van de andere partijen of van het Bureau zelf.
3. De beslissing tot nietigverklaring van het ingeschreven Gemeenschapsmodel wordt in het register ingeschreven, wanneer ze onherroepelijk is geworden.
