in forceGENERAL PROVISIONS
1. An SCE shall be governed:
(a) by this Regulation;
(b) where expressly authorised by this Regulation, by the provisions of its statutes;
(c) in the case of matters not regulated by this Regulation or, where matters are partly regulated by it, of those aspects not covered by it, by:
(i) the laws adopted by Member States in the implementation of Community measures relating specifically to SCEs;
(ii) the laws of Member States which would apply to a cooperative formed in accordance with the law of the Member State in which the SCE has its registered office;
(iii) the provisions of its statutes, in the same way as for a cooperative formed in accordance with the law of the Member State in which the SCE has its registered office.
2. If national law provides for specific rules and/or restrictions related to the nature of business carried out by an SCE, or for forms of control by a supervisory authority, that law shall apply in full to the SCE.
1. Op de SCE zijn van toepassing:
a) de bepalingen van deze verordening;
b) wanneer deze verordening dit uitdrukkelijk toestaat, de bepalingen van de statuten van de SCE;
c) voor de aangelegenheden die niet bij deze verordening worden geregeld, of, wanneer een aangelegenheid hierbij slechts gedeeltelijk is geregeld, voor de aspecten die niet onder deze verordening vallen:
i) de door de lidstaten ter uitvoering van communautaire maatregelen vastgestelde wettelijke voorschriften die specifiek op SCE's gericht zijn;
ii) de wetten van de lidstaten welke zouden gelden voor een coöperatie die is opgericht overeenkomstig het recht van de lidstaat waar de SCE haar statutaire zetel heeft;
iii) de bepalingen van de statuten van de SCE, onder dezelfde voorwaarden als die welke gelden voor een coöperatie die is opgericht overeenkomstig het recht van de lidstaat waar de SCE haar statutaire zetel heeft.
2. Indien de nationale wetgeving voorziet in specifieke voorschriften en/of beperkingen met betrekking tot het soort bedrijf dat een SCE uitoefent, of in enigerlei toezicht van een toezichthoudende autoriteit, is die wetgeving ten volle van toepassing op de SCE.
