3.1 General
3.1.1 Assessment of facts and circumstances
The IND shall assess the application for an asylum residence permit with due observance of Article 4 of the Qualification Regulation and Article 34 of the Procedures Regulation.
3.1.2 Acts of persecution
Article 9 of the Qualification Regulation describes what is understood by acts of persecution.
3.1.3 Actors of persecution and serious harm
Article 6 of the Qualification Regulation describes what is understood by actors of persecution or serious harm.
3.1.4 Application of Article 5 of the Qualification Regulation (sur place need for international protection)
Pursuant to Article 5 of the Qualification Regulation, the IND may grant an asylum residence permit to the foreign national who has demonstrated a well-founded fear of persecution or a real risk of suffering serious harm due to:
events that have taken place after the petitioner has left the country of origin; or
activities performed by the petitioner after leaving his or her country of origin, in particular when it is established that the activities concerned constitute the expression and continuation of beliefs, views or orientations held by the person concerned in the country of origin.
The need for international protection is designated as having arisen sur place.
The IND assesses, on the basis of generally available information, statements made by the foreign national and any supporting evidence, whether the foreign national faces problems upon return and whether those problems are so serious that they must be considered acts of persecution or give cause to assume a real risk of serious harm. Regarding the question of whether the foreign national may be expected to exercise restraint, reference is made to what is described below with respect to political opinion, religion, and sexual orientation and gender aspects.
Even if the activities of the foreign national, which the foreign national has undertaken after his departure from the country of origin, do not follow from activities that the foreign national had already undertaken in the country of origin prior to his departure, the foreign national may have a need for protection arising sur place (see also Article 5, paragraph 1, opening words and under (b), Qualification Regulation). This may be the case if the foreign national satisfies the following conditions:
the authorities in the country of origin are aware of, or the foreign national has made it plausible that the authorities in the country of origin will become aware of, the activities of the foreign national; and
the activities give rise to a well-founded fear of persecution or a real risk of serious harm.
3.1.5 Abuse of right
The foreign national who is deemed to have a well-founded fear of persecution or to face a real risk of serious harm may be denied an asylum residence permit if the foreign national has himself created the circumstances on which the risk of persecution or serious harm is based after he has left the country of origin with the sole or main purpose of creating the conditions for qualifying for international protection (see Article 5, second paragraph, Qualification Regulation).
The IND must state the reasons based on which facts and circumstances it follows that the objective and subjective requirements have been met, whereby it is plausible that the foreign national has artificially created the conditions for himself, solely with the single or principal aim of thus qualifying for international protection. The mere circumstance that the events take place after leaving the country of origin does not in itself constitute a reason to apply Article 5, paragraph 2, of the Qualification Regulation.
The application of Article 5, paragraph 2, of the Qualification Regulation and the resulting withholding of an asylum residence permit cannot prejudice the principle of non-refoulement as laid down in Article 3 ECHR and Articles 4 and 19, paragraph 2, of the EU Charter.
3.1.6 Application for an asylum residence permit at a Dutch diplomatic or consular representation
The IND shall not process an application for an asylum residence permit from a foreign national who presents himself for protection at a Dutch diplomatic or consular representation in his country of origin or a third country. The foreign national shall be referred by the official of the Dutch diplomatic or consular representation to the authorities of the third country where the foreign national is located or to the UNHCR or UNDP.
3.2 Granting of a residence permit for asylum on the basis of Article 29, first paragraph (refugee status)
3.2.1 General
Article 3, paragraph 5, of the Qualification Regulation governs what is understood by a ‘refugee’.
Article 13 of the Qualification Regulation in conjunction with Article 24 of the Qualification Regulation stipulates that a residence permit must be granted as long as a foreign national holds refugee status. Article 14, paragraph 2, of the Qualification Regulation provides that the IND may, in certain situations, decide not to grant refugee status. The granting of an asylum residence permit is regulated in Article 29 of the Aliens Act (Vw).
3.2.2 The grounds for exclusion of the Refugee Convention
A foreign national shall be excluded from recognition as a refugee on the basis of Article 12 of the Qualification Regulation in the following cases:
if Article 1D of the Refugee Convention applies (Article 12, paragraph 1, opening words and under (a), Qualification Regulation);
if Article 1E of the Refugee Convention applies (Article 12, paragraph 1, opening words and subparagraph (b), Qualification Regulation); or
if Article 1F of the Refugee Convention is applicable (Article 12, paragraphs 2 to 5 inclusive, Qualification Regulation).
The IND shall not grant a residence permit for asylum to the foreign national if one of these grounds for exclusion occurs.
3.2.2.1 Article 1D Convention relating to the Status of Refugees
The IND shall not grant the foreign national an asylum residence permit on the basis of Article 29, paragraph 1, of the Aliens Act (Vreemdelingenwet), if he falls within the scope of Article 1D of the Refugee Convention. The IND shall, however, proceed to assess the application against Article 29a, paragraph 1, of the Aliens Act.
Article 1D of the Refugee Convention is applicable in current practice to the (stateless) Palestinian refugee who falls under the mandate of UNRWA. The mandate of UNRWA is applicable to five areas: Lebanon, Jordan, Syria, the West Bank, and the Gaza Strip.
To be eligible for assistance from UNRWA, a person must:
meet the definition of a Palestine refugee under the mandate of UNRWA; and
be present in one of these five areas.
For the foreign national who does not fall under the mandate of UNRWA, the regular asylum policy is applicable.
In two consecutive steps, the IND assesses whether a Palestinian refugee, originating from one of the five UNRWA mandate areas, is excluded from refugee status. These steps are:
the Palestinian refugee has actually called upon (or enjoyed) the assistance provided by UNRWA immediately prior to or shortly before submitting the asylum application; and
the assistance has ceased for reasons beyond the influence and independent of the will of the foreign national.
Ad 1
Article 1D must be interpreted so strictly that it does not relate to persons who were or are eligible for protection or assistance from UNRWA, but who have not invoked it.
It is also of importance to assess whether the foreign national actually invoked or enjoyed the protection or assistance of the UNRWA shortly before submitting the asylum application. Only these foreign nationals fall within the scope of Article 1D.
The assessment of whether and to what extent the foreign national has enjoyed assistance from the UNRWA is an individual assessment, whereby it is relevant what the protection or assistance from the UNRWA consisted of in the individual case of the foreign national.
For the assumption of previously enjoyed (or invoked) protection or assistance, registration with UNRWA is not a requirement. It is, however, a strong indication that the foreign national falls within the scope of that article.
Ad 2
It is relevant whether the foreign national has left the mandate area voluntarily or by compulsion, but also whether the circumstances have changed in the meantime.
There are two conceivable situations in which the protection or assistance is considered to have ceased outside the influence of the foreign national:
UNRWA cannot fulfill the mandate: if there is a dissolution of the body providing protection or assistance, or if there is a situation in which the body concerned is in a position of impossibility to fulfill its mission; and
the foreign national is compelled to leave the mandate area: if there are circumstances beyond the control of the person concerned, which force him to leave the area in which UNRWA operates.
The assessment concerns an ex-nunc examination. Therefore, an assessment of the situation at the time of departure from the country of habitual residence shall not suffice.
Ad a
The assessment of whether UNRWA can fulfil its mandate is, in principle, an individual one. The protection or assistance must notably be deemed to have ceased when UNRWA is unable to guarantee a specific applicant (verzoeker) dignified living conditions and a minimum level of security, taking into account any vulnerabilities. This refers to living conditions that do not guarantee the foreign national that, in accordance with UNRWA's mission, basic needs in the areas of healthcare, education, and subsistence are met.
In addition, a situation is conceivable in which UNRWA is unable to guarantee humane living conditions or minimum safety to any (stateless) Palestinian. This is the case if, in the relevant area of operations, every stateless Palestinian would end up in a situation of extreme material deprivation that renders them unable to provide for their most basic needs, such as food, hygiene, and access to housing.
It is in principle for the foreign national to demonstrate that he cannot once again invoke the protection or assistance he has previously received.
Ad b
The primary issue here is whether the foreign national has left the territory voluntarily. If the foreign national has not been compelled to leave the territory against his will, it is not plausible that the protection or assistance has ceased beyond the influence of the foreign national.
Forced departure may occur, inter alia, if the foreign national:
has grounds to fear persecution on the basis of individual circumstances;
fears serious harm, for example due to a situation as referred to in Article 15, introductory wording and under (c), of the Qualification Regulation.
Even if circumstances have arisen after departure from the country of origin as a result of which the foreign national cannot proceed to the mandate area, it may be assumed that the protection or assistance has ceased for reasons beyond the control of the foreign national. In the case of voluntary departure, it is for the foreign national to provide a prima facie case for this.
If there is a case of involuntary departure, but subsequently the living conditions in the relevant mandate area have improved, this may also be taken into account in the assessment. This may (still) lead to exclusion on the basis of Article 1D of the Convention. The burden of proof lies with the IND.
Factual accessibility
In the context of the application of Article 1D of the Refugee Convention, the IND, when assessing the asylum application, is not required to assess whether the foreign national can gain access to the UNRWA area where he previously resided.
In determining whether the foreign national can obtain protection or assistance from UNRWA in a mandate area other than the mandate area where he had his habitual residence, factual accessibility does play a role. If the foreign national is not admitted to the other mandate area, it cannot be held against him that he can invoke the protection or assistance of UNRWA there.
Residence permit for the purpose of asylum (verblijfsvergunning asiel)
The IND grants an asylum residence permit on the basis of Article 29, first paragraph, of the Aliens Act (Vw) if the foreign national:
actually called upon (or enjoyed) the assistance provided by UNRWA shortly before submitting the asylum application; and
assistance has ceased due to reasons beyond the influence and independent of the will of the foreign national, as mentioned above.
The IND shall not grant an asylum residence permit if the foreign national:
possesses a nationality; and
can invoke the protection of his own authorities.
The IND shall not grant an asylum residence permit if the (stateless) Palestinian foreign national has been guilty of acts as referred to in the exclusion clause of Article 1F of the Refugee Convention.
3.2.2.2 Article 1E of the Refugee Convention (Article 12, paragraph 1, opening words and under (b), Qualification Regulation)
This article relates to foreign nationals who would otherwise qualify for refugee status and who have been received in a country where they have been granted most of the rights usually enjoyed by nationals, but where they do not have formal citizenship.
3.2.2.3 Article 1F of the Refugee Convention (Article 12, paragraphs 2 through 5, Qualification Regulation)
Article 12, paragraph 2, of the Qualification Directive stipulates that a third-country national or a stateless person shall be excluded from recognition as a refugee if there are serious grounds for considering that a foreign national has committed war crimes or other serious crimes. This corresponds to the text of Article 1F of the Refugee Convention. For this reason, the Aliens Circular (Vreemdelingencirculaire) continues to refer to Article 1F of the Refugee Convention (or simply 1F).
The IND shall in that case not grant the foreign national an asylum residence permit (see paragraph C4/3.6.2 Vc).
3.2.3 Group persecution
There is a case of group persecution if, in a country of origin, a group of foreign nationals is systematically subjected to persecution on one of the grounds of Article 10 of the Qualification Regulation.
The Minister may designate a group for which there is a case of group persecution. Situations in which there is a case of group persecution shall be included in the country-specific policy.
The individualisation requirement also applies to the foreign national who relies on group persecution. The foreign national must demonstrate that he belongs to the group of foreign nationals for whom group persecution is assumed.
3.2.4 Risk profiles
As set out in paragraph C3/2.4 Vc, the Minister may designate risk profiles in connection with the situation in a country.
3.2.5 Principles for the assessment of the grounds for persecution within the meaning of Article 10 of the Qualification Regulation
The IND assesses an application for an asylum residence permit with due observance of Article 10 of the Qualification Regulation. The grounds for persecution are further elaborated below.
The IND grants an asylum residence permit pursuant to Article 29, paragraph 1, of the Vw, if there are acts of persecution as referred to in Article 9 of the Qualification Regulation.
In the paragraphs below, the following grounds from Article 10 of the Qualification Regulation are further elaborated:
race;
religion;
nationality
social group;
political conviction
For the assessment of the grounds of race, which specifically includes the aspects of skin colour, descent or belonging to a particular ethnic group, and nationality, no separate framework is elaborated. The assessment follows the general systematic approach.
3.2.5.1 Religion (Article 10, paragraph 1, opening words and under (b), Qualification Regulation)
The concept of ‘religion’ encompasses a wide range of beliefs, in particular theistic, non-theistic and atheistic (religious) beliefs. The circumstance that the foreign national cannot practice his religion in his country of origin in the same manner as in the Netherlands constitutes insufficient grounds to grant the foreign national an asylum residence permit on the basis of Article 29, paragraph 1, of the Aliens Act (Vreemdelingenwet).
Not every infringement of the right to freedom of religion will therefore constitute an act of persecution within the meaning of Article 10 of the Qualification Regulation. In assessing whether an infringement of the right to freedom of religion constitutes an act of persecution, the IND must, having regard to the personal situation of the foreign national against the background of what is known from general information, examine whether the foreign national runs a real risk of being persecuted in his country of origin for reasons of the exercise of that freedom.
The IND shall, in the assessment of the application for an asylum residence permit, in any event take into account that:
the foreign national, who adheres to a religious conviction, is not required to conceal the expressions of his religious conviction in his country of origin, including in the situation where the foreign national has concealed his religious conviction prior to his departure from the country of origin; and
it is not expected of the foreign national that he refrains from religious acts, which are of particular importance to him personally for the preservation of his religious identity, in order to avoid persecution.
The IND assesses whether the measures and sanctions that will be taken against the foreign national if, upon return to his country of origin, he performs certain acts – which are of particular importance to his religious identity – are sufficiently serious to constitute persecution.
Even if the foreign national makes it plausible that upon return he feels compelled to exercise his religious belief with restraint due to the risks he would otherwise face, this may constitute persecution within the meaning of Article 10 of the Qualification Regulation.
3.2.5.2 Social group (Article 10, paragraph 1, opening words and subparagraph (d), Qualification Regulation)
In the assessment of the grounds within the meaning of Article 10 of the Qualification Regulation, account shall be taken of the circumstance that a social group is concerned. A group shall be deemed to form a social group if members of a group satisfy at least two cumulative conditions.
Firstly, the members of a social group must satisfy at least one of the following conditions:
exhibit a congenital characteristic;
have a common background that cannot be changed; or
share a characteristic or belief that is so fundamental to the identity of the persons concerned that they may not be required to renounce it.
Secondly, the social group in the country of origin must have a distinct identity because it is perceived as being different by the surrounding society.
The individualisation requirement as set out in paragraph C3/2.3 Vc is applicable. In addition, paragraph C3/4 Vc (assessment of the asylum application) is also applicable.
3.2.5.2.1 Women
Women in general, as well as a limited group of women sharing a specific common characteristic, may, depending on the circumstances in the country of origin or in a specific area within that country, be identified as a social group.
The following elements may be of particular relevance for the assessment of whether women constitute a social group:
cultural, religious or traditional norms (such as female genital mutilation, forced sterilisation or forced abortion);
withdrawal of women from or refusal of a forced marriage or the dissolution of marriage; or
the existence of domestic, sexual and/or honour-related violence.
In this regard, it shall be assessed whether the group to which the woman belongs possesses its own identity in the country of origin, because this group is regarded as distinct in its immediate environment.
The Minister may, in the context of specific country policy, determine whether (a group of) women belongs to a social group. If such is the case, this shall also be included in the country policy of Chapter C9 Vc.
Insofar as (a specific group of) women belong to a social group, gender-based violence against these women may, among other things, lead to the conclusion that there is a case for recognition as a refugee as referred to in Article 13 of the Qualification Directive, if that violence can be qualified as an act of persecution as referred to in Article 9 of the Qualification Directive. Regarding the question of whether a woman, as a member of a social group, qualifies for an asylum residence permit on the basis of Article 29, first paragraph, of the Aliens Act (Vreemdelingenwet), the individualisation requirement as described in paragraph C3/2.3 of the Aliens Circular (Vreemdelingencirculaire) applies in full. It shall be assessed on an individual basis whether she actually has a well-founded fear of acts of persecution due to belonging to a social group.
Identification with the fundamental value of equality between women and men
Women who actually identify with the fundamental value of equality between women and men (hereinafter: identification) may, depending on the circumstances in the country of origin, belong to a ‘social group’. In this regard, it is important that the provisions of paragraph C3/3.2.5.2 Vc are also applicable to the question of whether a woman who invokes identification belongs to a social group.
Membership of this social group may constitute a ground for assuming that there is a case for recognition as a refugee as referred to in Article 13 of the Qualification Regulation. It is for the woman who invokes identification to make it plausible that this is the case in her personal situation.
The IND assesses, on the basis of a ‘three-stage assessment’, whether a woman has made it plausible that there is a well-founded fear of persecution due to belonging to a social group on account of identification:
determination of the identification in the individual case;
determine whether the group to which the woman claims to belong has its own identity in the country of origin, because this group is regarded as distinct in her immediate environment; and
determine whether there is a well-founded fear of acts of persecution as a result thereof.
Ad 1.
The IND must first determine whether the woman has, in her individual case, made it plausible that the identification can be traced back to the fundamental value that the woman attaches to the equality between women and men.
In determining whether there is a case of identification, consideration may be given to the making of autonomous and independent choices that are decisive for her identity in the fields of education and professional career, the possibility of becoming economically independent by working outside the home, the decision to live alone or in a family context, and the choice of partner.
In assessing whether there is a case of identification (vereenzelviging), the IND shall, in any event, take into account:
whether the woman has made it plausible that the identification is fundamental to the identity or moral integrity of the woman;
it has been made plausible that this identification is so fundamental that she cannot be required to renounce it;
the manner in which the wife gives effect thereto in her daily life and has given effect thereto in the past; and
the manner in which the wife wishes to give effect thereto upon return to the country of origin.
In this regard, it applies that if the woman gives or has given little to no practical expression to the identification, it may be expected of the woman that she can explain why this is the case and why the identification is nevertheless fundamental to her identity.
For the woman who invokes identification, the alleged identification need not stem from political or religious motives. Insofar as this does occur in practice, reference is made to paragraphs C3/3.2.5.1 and C3/3.2.5.3 Vc.
If the IND has ruled that a credible identification has occurred, the next step in the assessment shall be proceeded to.
Ad 2.
Subsequently, the IND shall assess whether the woman, as a result of the identification, can belong to a social group. In order to be designated as a social group, the woman must demonstrate that she belongs to a group which, as a result of the identification, possesses a distinct identity because it is perceived as being different in the immediate environment in the country of origin.
This in particular as a result of the social, moral or legal norms prevailing in the country of origin.
The IND assesses the plausibility of the woman's statements regarding why the group is considered deviant, in conjunction with the available country information.
Ad 3.
Subsequently, the IND shall assess whether there is a well-founded fear of persecution on account of (imputed) membership of a social group due to identification. The IND shall assess the fear of persecution on the basis of statements and evidence provided by the woman regarding what she claims to fear upon return to the country of origin.
The fact that a reason to be persecuted on account of imputation could be avoided by adopting a reserved attitude shall not be held against the woman in this context. Indeed, the woman may not be required to renounce an imputation that is fundamental.
Female genital mutilation
The IND grants a woman, who invokes a fear of female genital mutilation, an asylum residence permit on the basis of Article 29, paragraph 1, of the Aliens Act (Vw), if all of the following conditions are met:
there is a well-founded fear of genital mutilation;
Article 7 of the Qualification Regulation is not applicable; and
Article 8 of the Qualification Regulation is not applicable.
The IND assesses, on the basis of the individual statements of the foreign national, whether the foreign national is eligible for an asylum residence permit pursuant to Article 29, first paragraph, of the Vw (Aliens Act) due to a well-founded fear of female genital mutilation.
The IND shall take into account the general information regarding female genital mutilation in the country of origin. This may be evidenced, for example, by an official report (ambtsbericht) from the Minister of Foreign Affairs.
Insofar as the parent of a girl or woman who has reason to fear female genital mutilation claims to be eligible for protection on the basis of an (attributed) conviction, it may be assessed whether the parent independently qualifies for an asylum residence permit on the basis of a religious conviction, membership of a social group and/or a political conviction.
The IND shall in any event not grant an asylum residence permit on the basis of Article 29, first paragraph, of the Aliens Act (Vreemdelingenwet), on the grounds of an invoked fear of female genital mutilation (of a family member), to the parent who performs the genital mutilation themselves or facilitates the performance thereof.
3.2.5.2.2 Sexual orientation
The IND may designate a foreign national as a member of a particular social group if he belongs to a group that has (imputed) sexual orientation as a common characteristic.
Sexual orientation concerns, in any event, a person's sexual and/or emotional and/or intimate attraction to another person. In this regard, the IND shall assess whether this group has a distinct identity in the country of origin, because this group is perceived in the immediate environment as deviating from the heterosexual norm.
The IND investigates the sexual orientation of the foreign national and the expression thereof on the basis of the assessment framework of paragraphs C3/4.3 and C3/4.4 Vc. The circumstance that the foreign national cannot express his sexual orientation in his country of origin in the same manner as in the Netherlands does not, in itself, constitute sufficient grounds to assume that there is a well-founded fear of persecution. Not every infringement of the right to express sexual orientation constitutes an act of persecution within the meaning of the Refugee Convention. For the assessment of whether an infringement of this right constitutes an act of persecution, the IND must investigate whether the foreign national has a well-founded fear of being persecuted in his country of origin.
The IND shall, with due observance of Article 9 of the Qualification Directive, grant an asylum residence permit on the basis of Article 29, paragraph 1, of the Aliens Act (Vreemdelingenwet) to a foreign national on the basis of their sexual orientation, in any case if at least one of the following situations occurs:
the foreign national has demonstrated that he is at risk of being subjected to acts of violence on account of his (imputed) sexual orientation, which are of such severity that these acts of violence constitute a serious violation of fundamental human rights;
in the country of origin, criminal provisions based on sexual orientation apply, these criminal provisions are actually enforced by the authorities in practice, and the criminal provision is of a certain weight; or
the authorities of the country of origin carry out measures on the basis of (imputed) sexual orientation that are discriminatory or are carried out in a discriminatory manner. These measures are, in themselves or in combination (cumulatively), sufficiently serious.
In the assessment of whether there is a case of penal provisions and/or discriminatory measures relating to sexual orientation, the IND shall, in any event, take into account:
the scale on which criminal prosecution due to sexual orientation occurs;
the application of imposed (prison) sentences;
the (prior) police and criminal procedural investigation; and
the consequences of the criminalisation for the social position of this group.
If the sexual orientation or sexual acts is/are punishable in the country of origin, the foreign national is not expected to invoke or be able to invoke protection in accordance with Article 7 of the Qualification Regulation.
In the assessment of the individual situation of the foreign national, the starting point is that the foreign national is not required to conceal his sexual orientation in his country of origin, including in the situation where the foreign national concealed his sexual orientation prior to his departure from the country of origin. The IND shall investigate the manner in which the foreign national expresses his sexual orientation in the Netherlands and how the foreign national intends to express it in his country of origin. The foreign national must demonstrate that it is plausible that this expression will lead to an act of persecution.
The IND does not require the foreign national to exercise restraint in the expression of their sexual orientation and, for that reason, consistently applies a certain ‘lower limit’ (ondergrens) when assessing the risk of persecution. The lower limit entails the factual expression of one's own orientation and entering into relationships in a manner that is not substantially different from what is accepted for heterosexuals in the relevant country of origin. The IND expects no restraint in such expression. In those cases, when assessing the risk of persecution, the IND assumes in principle that the immediate social environment, as mentioned above, is aware or may become aware of the sexual orientation. The IND subsequently assesses whether the expression in accordance with the lower limit would lead to persecution.
If the foreign national indicates a desire to express their sexual orientation in a manner that goes beyond this ‘lower limit’, the IND shall assess the credibility of this expression and the IND shall assess the manner in which the foreign national intends to express their sexual orientation in their country of origin. In the situation where the sexual orientation is deemed credible but the further-reaching manner in which the foreign national wishes to express it is not, the IND shall examine whether giving effect to the sexual orientation in accordance with the ‘lower limit’ would lead to persecution. In that situation, the foreign national may be eligible for an asylum permit, even if a part of the statement (the expression of the orientation in a manner that goes beyond the ‘lower limit’) is considered not plausible.
The IND shall include in its assessment whether there is discriminatory treatment in the country of origin on the grounds of sexual orientation, measured against the norms and customs prevailing there. If sexual orientation or sexual acts are criminalised in the country of origin, the IND shall assess how this is dealt with in practice and measure this against the personal situation of the foreign national.
If the foreign national relies on both their sexual orientation and their gender identity and/or gender expression, paragraph C3/3.2.5.2.3 Vc shall also apply.
3.2.5.2.3 Gender identity and gender expression
The IND may designate a foreign national as a member of a social group if he belongs to a group that has as a common characteristic that the deeply felt, personal experience of his gender and/or his body does not, or does not unambiguously, correspond to the sex he was assigned at birth, or if this is attributed to him. This may also concern gender expression. Gender expression refers to the manner in which the foreign national presents his gender by means of physical appearance – including but not limited to clothing, hairstyles, accessories, cosmetics – and manners, speech, patterns of behaviour, names and personal references. This does not necessarily have to correspond to the gender identity. In addition, the IND shall assess whether this group has a distinct identity in the country of origin because this group is perceived as being different by the surrounding society.
If the foreign national relies solely on gender expression, which is distinct from gender identity, the IND shall assess whether the forms of expression are so fundamental to the identity that the foreign national cannot be expected to adapt to the norms and customs prevailing in the country of origin as referred to in C3/3.2.5.2 Vc.
The IND shall investigate the gender identity and/or the gender expression of the foreign national on the basis of the assessment framework of paragraphs C3/4.3 and C3/4.4 Vc. The circumstance that the foreign national cannot express his gender identity and/or gender expression in his country of origin in the same manner as in the Netherlands does not, in itself, constitute sufficient grounds to assume that there is a well-founded fear of persecution. Not every infringement of the right to express gender identity and/or gender expression constitutes an act of persecution within the meaning of the Refugee Convention.
For the assessment of whether an infringement of this right constitutes an act of persecution, the IND examines whether the foreign national has a well-founded fear of being persecuted in their country of origin. Article 9 of the Qualification Directive describes what is understood by acts of persecution. These must be so severe in nature or occur so frequently that they constitute a serious violation of fundamental human rights or be an accumulation of various measures, including human rights violations, which are sufficiently severe to affect an individual in a similar manner.
The IND considers discrimination by the authorities and by fellow citizens as an act of persecution if the foreign national, due to the discrimination, is so severely restricted in his means of subsistence that it is impossible for him to function in a societal and social capacity. For the assessment of whether discrimination is of such a severe nature that it constitutes persecution, the IND applies the assessment framework of paragraph C3/3.2.6 Vc.
The IND shall, with due observance of Article 9 of the Qualification Regulation, grant an asylum residence permit on the basis of Article 29, paragraph 1, of the Aliens Act (Vw) to a foreign national on the basis of their gender identity and/or gender expression, if at least one of the following situations is in any case present:
the foreign national has demonstrated that, on account of their (imputed) gender identity and/or gender expression, they are at risk of being subjected to acts of violence and/or discrimination which are so serious as to constitute a severe violation of fundamental human rights;
criminal provisions apply in the country of origin in the context of gender identity and/or gender expression, these criminal provisions are actually enforced by the authorities in practice, and there is a certain severity of the criminal provision; or
the authorities of or other actors in the country of origin implement, on the basis of (imputed) gender identity and/or gender expression, measures that are discriminatory or are implemented in a discriminatory manner. These measures are, in themselves or in combination (cumulatively), sufficiently serious.
Ad a
If there are acts of violence and/or discrimination directed at the foreign national on the grounds of gender identity and/or gender expression in the country of origin, the acts, individually or in conjunction with other acts, must be sufficiently serious to constitute an act of persecution, and no protection against such acts must be available from the authorities or international organisations, as referred to in paragraph C3/3.4 Vc.
Ad a and b
In the event that the foreign national demonstrates that upon return to the country of origin he will be detained for a reason other than his gender identity and/or gender expression, he must demonstrate that he faces a real risk in detention of being subjected to serious (sexual) violence because of his gender identity and/or gender expression, against which the (detention) authorities cannot or will not offer protection. In this regard, the IND shall take into account whether the situation will arise where the foreign national is detained with persons of a sex that does not correspond to his gender identity. If a common crime is concerned, it must be assessed whether there is a threat to public order. For this purpose, the assessment framework as referred to in paragraph C4/3.6 Vc shall apply.
Ad b and c.
The IND investigates whether the foreign national, upon return, would be compelled under threat (of violence) by an actor to perform a certain form of labour (such as sex work) and whether this is related to their gender identity and/or gender expression, as a result of which they face discriminatory or disproportionate punishment due to this form of labour. In the situation where there is a case of (a form of) discrimination, the assessment framework, as referred to in paragraph C3/3.2.6 Vc, shall apply.
Ad c.
The mere fact that no possibilities exist to have the gender adjusted in official documents (legal recognition), or that this is subject to the condition that a gender reassignment has taken place, is in itself insufficient to assume a well-founded fear of persecution. This is without prejudice to the fact that the consequences for the foreign national of being unable to adjust the gender may lead to measures which, individually or cumulatively, are so serious that such treatment reaches the threshold of persecution.
In assessing whether there is a case of penal provisions and/or discriminatory measures relating to gender identity or gender expression, the IND shall, in any event, take into account:
the scale on which criminal prosecution on the basis of gender identity and/or gender expression occurs;
the application of the imposed (prison) sentences;
the (prior) police and criminal procedural investigation; and
the consequences of the criminalisation and the penal provisions for the social position of gender-diverse individuals.
If gender expression or the manifestation of gender identity, other than the prevailing norms in the country of origin, is punishable by law (or if other penal provisions apply thereto), the foreign national shall not be expected to invoke protection, or be deemed able to invoke protection, in accordance with Article 7 of the Qualification Directive.
The IND shall include in its assessment whether there is discriminatory treatment in the country of origin on the grounds of gender identity and/or gender expression. If the country of origin criminalises gender expression or the expression of a gender identity other than that assigned to the foreign national at birth, the IND shall assess how this is handled in practice and weigh this against the personal situation of the foreign national.
If the foreign national makes it plausible that they are excluded, in whole or in part, from access to healthcare in the country of origin on the basis of their gender identity and/or gender expression, the IND shall investigate whether this leads to serious consequences. The IND shall assess this in conjunction with the question of whether there is a discriminatory treatment or measure which, in combination with other measures, is sufficiently serious to constitute persecution. The mere fact that no gender-affirming care is available does not in itself constitute a reason to assume a well-founded fear of persecution.
In the assessment of the individual situation of the foreign national, the starting point is that the foreign national is not required to conceal their gender identity in their country of origin, even in the situation where the foreign national concealed their gender identity prior to their departure from the country of origin. The IND investigates the manner in which the foreign national expresses their gender identity in the Netherlands and how the foreign national intends to express it in their country of origin. This may also concern gender expression. The foreign national must demonstrate that this expression leads to an act of persecution. In those cases, the IND, in principle, assumes in the assessment of the risk of persecution that the immediate environment as mentioned above is aware or may become aware of the gender identity and/or gender expression.
If the foreign national relies on both their gender identity and gender expression as well as their sexual orientation, paragraph C3/3.2.5.2.2 Vc regarding sexual orientation shall also apply.
3.2.5.3 Political opinion (Article 10, paragraph 1, opening words and under (e), Qualification Regulation)
Article 10, paragraph 1, opening words and under (e), of the Qualification Regulation determines what must be understood by the ground of persecution ‘political opinion’.
The first question that the IND must answer when a foreign national puts forward their political opinion as a ground for asylum is whether there is indeed a case of a political opinion. A political opinion may consist of a view, thought, or opinion directed against the authorities of the country of origin. This does not necessarily have to concern a deeply rooted political opinion.
The strength of the conviction plays no role in the question of whether there is a political conviction, but remains relevant in the assessment of whether the foreign national faces a risk upon return.
The IND assesses whether the strength of the political conviction and any activities performed by the foreign national to express that conviction have resulted in the foreign national attracting or potentially attracting the negative attention of the authorities of the country of origin and what the consequences thereof would be. This assessment takes place on the basis of the individual statements of the foreign national in combination with the available general information regarding the situation in the country of origin.
Furthermore, in the assessment of the fear, the IND involves which activities motivated by the alleged political opinion and found plausible the foreign national would wish to perform upon return or how the foreign national would otherwise wish to express his view, opinion or thought, and what the consequences thereof would be.
The circumstance that the foreign national is unable to express his political conviction in his country of origin in the same manner as in the Netherlands constitutes insufficient grounds to grant the foreign national an asylum residence permit on the basis of Article 29, paragraph 1, of the Aliens Act (Vreemdelingenwet).
The IND shall, in any event, take into account the following when assessing the application for a residence permit:
the strength of the political conviction of the foreign national;
the manner in which he has expressed his political opinion, regardless of whether those activities took place in his country of origin, in the Netherlands or elsewhere, and whether it is plausible that the foreign national will also express or continue to express his political opinion after return; and
whether the foreign national has previously encountered problems from the authorities, whether or not on account of his political opinion;
The IND assesses, even in the absence of a political opinion, whether the political activities or expressions performed by the foreign national in their country of origin, the Netherlands, or elsewhere have become or will become known to the authorities and, as such, on the basis of an imputed political opinion, constitute sufficient grounds to assume a well-founded fear of persecution upon return.
3.2.6 Discrimination (within the meaning of Article 9 of the Qualification Directive)
The IND shall designate discrimination against the foreign national by the authorities and by fellow citizens as an act of persecution within the meaning of Article 9 of the Qualification Directive, if the foreign national, due to the discrimination, is so severely restricted in his means of subsistence that it is impossible for him to function in a societal and social capacity.
Discrimination against the foreign national in the country of origin may lead to exclusion from medical care. The IND shall grant a residence permit for asylum on the basis of Article 29, first paragraph, of the Aliens Act (Vw), on the grounds of exclusion from medical care, to the foreign national who meets all of the following conditions:
the foreign national will, upon return to the country of origin, experience full or partial exclusion from medical care;
the foreign national will suffer serious medical consequences as a result of the exclusion from medical care; and
the exclusion from medical care takes place on the basis of one of the grounds of Article 10 of the Qualification Regulation.
The IND assesses the question of whether there are serious medical consequences on the basis of the criteria in Chapter B8 Vc. The IND includes in the question of whether there is an exclusion of medical care on the basis of one of the grounds of Article 10 of the Qualification Directive:
the circumstance that the foreign national does not have access to medical care for reasons other than exclusion due to discrimination; or
the availability of treatment options in the country of origin.
3.2.7 Prosecution for refusal to perform military service or desertion (within the meaning of Article 9, paragraph 2, opening words and point (e), of the Qualification Regulation)
If the foreign national asserts to fear persecution on account of refusal of military service or desertion, the IND first assesses whether the foreign national has refused military service or has deserted because he feared otherwise having to participate in war crimes (see Article 9, paragraph 2, introductory wording and point (e), of the Qualification Regulation). Only if this is not the case does the IND assess whether refusal of military service or desertion leads to disproportionate or discriminatory punishment, or whether it arises from insurmountable conscientious objections due to a religion or other deep-rooted conviction. The fact that that foreign national refuses to perform his military service or has deserted and in connection therewith is punished with a prison sentence or dismissal from the army, is in itself insufficient for the IND to designate as an act of persecution.
The IND grants, applying Article 9, paragraph 2, opening words and under (e), of the Qualification Regulation and in accordance with the foregoing, an asylum residence permit on the basis of Article 29, paragraph 1, of the Vw to the foreign national who invokes a refusal to perform military service or desertion, if the foreign national meets at least one of the following conditions:
The foreign national has, in accordance with Article 9, paragraph 2, introductory wording and point (e), of the Qualification Regulation, plausibly demonstrated a fear of persecution or punishment due to refusal of military service during a conflict, where the performance of military service involves the commission of criminal offences or acts that fall under the exclusion clause of Article 1F of the Refugee Convention (Article 12, paragraphs 2 to 5 inclusive, of the Qualification Regulation). In the assessment of the plausibility, the IND takes into account all circumstances of the case, in particular the situation in the country of origin at the relevant time and the personal situation of the foreign national. In doing so, the IND applies the following three cumulative conditions:
The foreign national must demonstrate that there is an armed conflict in which war crimes are being committed or that there is a very high probability that such crimes will be committed. The foreign national shall substantiate this with concrete information regarding the war crimes committed. In the absence of such information, the IND shall, in principle, assume that there is a high probability that war crimes are being committed if the international community has condemned an armed conflict as being contrary to the basic principles of humane conduct or as being contrary to the fundamental norms applicable during an armed conflict. The same shall apply if judgments have been rendered by the competent international judicial bodies (International Criminal Court, UN tribunals) regarding violations of fundamental norms committed during the conflict. The foreign national bears a heavier burden of proof to demonstrate that war crimes are being committed during the armed conflict if the country of origin carries out the military actions in question pursuant to a UN mandate or on the basis of international consensus. In such cases, the IND shall, in principle, not consider it plausible that the country of origin is committing war crimes or that there is a high probability thereof. The foreign national also bears a heavier burden of proof to demonstrate that war crimes are being committed during the armed conflict if the authorities in the country of origin do not find war crimes committed by their own military units acceptable and actively prosecute them (under criminal law).
The foreign national must belong to the military personnel, including logistical or support personnel. He must demonstrate that it is plausible that he held or would have to perform a function and tasks through which he directly participates in these war crimes or would (have to) provide indispensable support for the preparation or execution of these war crimes. The IND takes into account the scale on which war crimes are committed when determining whether it is plausible that the foreign national will be guilty thereof if a foreign national has been called up for military service but does not yet know what his tasks will be. In addition, the IND assesses in this light what the personal involvement of the foreign national in the commission of war crimes will be.
The foreign national must demonstrate that refusal to perform military service (or desertion) is, in his situation, the sole means to avoid participation in war crimes. The foreign national cannot invoke protection on the basis of Article 9, paragraph 2, opening words and under (e), of the Qualification Regulation, if he has another means to that end. If the foreign national has the possibility within the military to be exempted on the grounds of conscientious objection, and he has not made use thereof, he cannot therefore rely on protection on the basis of this provision. In this regard, the IND also considers whether the foreign national entered military service voluntarily and whether he extended his service. In doing so, the IND takes into account the situation as it existed at the time of voluntary enlistment or extension of the enlistment. The IND therefore considers to what extent it was already clear or should have been clear to the foreign national at that time that there was an armed conflict in which war crimes were being committed and that he would participate therein by virtue of that voluntary enlistment.
The foreign national has a well-founded fear of disproportionate or discriminatory punishment, execution of the sentence, or other discriminatory treatment due to their refusal to perform military service or desertion based on one of the grounds of Article 10 of the Qualification Regulation. For this category, the standard policy applies as set out above in this paragraph. In such a case, the IND assesses the severity of the treatment which the foreign national fears on the basis of the refusal to perform military service or desertion (see Article 9, paragraph 2, opening words and under (b) and (c), of the Qualification Regulation).
The foreign national has serious, insurmountable conscientious objections based on his religious or other deeply rooted convictions, which have led to his refusal of military service or desertion, whereas no possibility existed for the foreign national to perform a non-military service as an alternative to his military service. Furthermore, there is a real risk that the failure to perform military service will lead to the imposition of a disproportionately severe (punitive) measure or to the imposition of a combination of various measures which, in conjunction, can be qualified as a disproportionate punishment. This also applies if the foreign national has a well-founded fear of being deployed in a conflict against his own people or family.
3.2.8 If the UNHCR has recognised the foreign national as a Convention Refugee
The IND assesses all applications for an asylum residence permit individually and on the basis of the applicable asylum policy, even if the foreign national has previously been recognised as a Convention refugee by the UNHCR on individual grounds.
The IND shall provide the foreign national with the opportunity to submit information regarding the UNHCR recognition during the procedure and shall recognisably include this information in the decision-making process.
3.2.9 Common offences
The IND shall not grant an asylum residence permit on the basis of Article 29, paragraph 1, or Article 29a, paragraph 1, Vw, if all of the following conditions apply:
the foreign national fears punishment in his country of origin on account of a common crime;
fear of punishment for a common crime (commuun delict) constitutes the sole basis of the alien's application for an asylum residence permit.
An ordinary offence is an offence that cannot be traced back to one of the grounds of Article 10 of the Qualification Regulation, and without there being a disproportionate or discriminatory measure on account of one of the grounds of Article 10 of the Qualification Regulation.
The common crime must be included in the substantive assessment and the question of whether there is a threat to public order. In this regard, see paragraph C4/3.6 Vc.
3.3 Granting of subsidiary protection status on the basis of Article 18 of the Qualification Regulation and granting of a residence permit for asylum on the basis of Article 29a, paragraph 1, of the Aliens Act (Vreemdelingenwet)
3.3.1 Serious harm as referred to in Article 15 of the Qualification Regulation
The IND grants an asylum residence permit pursuant to Article 29a, paragraph 1, of the Vw if, upon the removal of the foreign national from the Netherlands, there is a real risk of serious harm within the meaning of Article 15 of the Qualification Regulation.
The real risk of serious harm may be present at the time of the foreign national's departure from the country of origin, but may also arise after the foreign national's departure from the country of origin (see Article 5 Qualification Regulation and paragraph C3/3.1.4 Vc).
The IND shall not grant an asylum residence permit on the basis of Article 29a, paragraph 1, of the Aliens Act (Vreemdelingenwet), if Article 17 of the Qualification Regulation (Kwalificatieverordening) is applicable.
Article 15 of the Qualification Regulation sets out what serious harm may consist of, namely:
death penalty or execution;
torture, inhuman or degrading treatment or punishment; or
serious and individual threat to a civilian's life or person by reason of indiscriminate violence in situations of international or internal armed conflict.
In the assessment, it is of importance that all relevant elements relating to the individual situation and the general situation in the country of origin are first examined, before it is determined whether the risk falls under Article 15, introductory wording and under (a), (b) or (c) of the Qualification Regulation.
For the establishment of a real risk of serious harm on the basis of Article 15, introductory description and under (a) and (b), of the Qualification Regulation, a fully individual assessment is required. Country information may give cause to assume systematic exposure with regard to a group or to designate groups as having a risk profile as included in paragraph C3/2.4 of the Aliens Circular (Vreemdelingencirculaire).
With regard to the individualisation requirement under Article 15, introductory wording and point (c), of the Qualification Regulation, reference is made to paragraph C3/3.3.3 Vc.
In paragraph C3/3.3.2 Vc, serious harm is described as referred to in Article 15, opening words and points (a) and (b), of the Qualification Regulation. The subjects described thereunder are:
systematic exposure (paragraph C3/3.3.2.1 Vc);
medical circumstances (paragraph C3/3.3.2.2 Vc); and
obstacle to return (terugkeerbeletsel)
In paragraph C3/3.3.3 Vc, serious harm is described as referred to in Article 15, opening words and point (c), of the Qualification Regulation.
3.3.2 Article 15, opening words and under a and b, Qualification Regulation
3.3.2.1 Systematic exposure
If the foreign national belongs to a group that is systematically exposed to a real risk of serious harm as referred to in Article 15, introductory description and under (a) and (b), of the Qualification Regulation, the individualisation requirement is limited to demonstrating that the person belongs to that group. In the case of systematic exposure, there must be evidence of targeted violence against the group concerned.
The Minister shall assess, on the basis of the situation in a country of origin, whether there is systematic exposure to serious harm as referred to in Article 15, opening words and points (a) and (b), of the Qualification Regulation. It may be set out in the country-specific policy whether there is systematic exposure with respect to a group in a particular country.
3.3.2.2 Medical circumstances
Expulsion of the foreign national may, in connection with the medical situation, lead to a violation of Article 3 ECHR under exceptional circumstances. The IND assesses whether there is a violation of Article 3 ECHR due to medical reasons within the framework of the ex officio assessment of whether a postponement of departure must be granted pursuant to Article 64 of the Aliens Act (Vreemdelingenwet).
In this situation, no asylum residence permit shall be granted on the basis of Article 29a of the Aliens Act (Vreemdelingenwet). If no ex officio assessment takes place, but the asylum decision must also be designated as a return decision, the IND shall—within the framework of that return decision—likewise assess whether there is a violation of Article 3 of the ECHR due to medical reasons.
3.3.2.3 Bar to return
If the IND rejects an application for an asylum residence permit or withdraws an asylum residence permit, there may be an impediment to return. As a rule, the IND assesses whether there is a situation in which the foreign national, upon return to the country of origin:
faces the risk of prosecution, as referred to in Article 29, paragraph 1, of the Aliens Act (Vreemdelingenwet) or;
faces a real risk of serious harm, as referred to in Article 29a, paragraph 1, of the Aliens Act (Vreemdelingenwet).
If Article 1F of the Refugee Convention is applicable (Article 12, paragraphs 2 to 5 inclusive, Qualification Regulation), it shall not be assessed whether there is a risk of persecution.
If one of the aforementioned situations occurs or if there is a violation of Article 3 ECHR due to medical reasons and there is no other country to which the foreign national can return, the IND shall not issue a return decision. The IND shall then state in the decision that the foreign national must depart from the Netherlands independently, but will not be deported to the country of origin. The IND shall not specify a final period for departure in the decision.
If, due to an impediment to return, no return decision and consequently no entry ban can be issued, the IND shall assess whether a decision for an alert (signalering) may be imposed. Paragraph A4/4 of the Aliens Circular (Vc) sets forth the conditions for imposing a decision for an alert on the grounds of a threat to public order or national security.
If it is established at a later stage that the foreign national no longer has a fear of persecution or serious harm, or that Article 3 ECHR no longer precludes the deportation of the foreign national, the IND shall issue a return decision and, where applicable, shall impose a decision on signaling, a declaration of undesirability and/or an entry ban. The IND shall notify the foreign national of this decision. The foreign national may exercise legal remedies against this decision.
3.3.3 Article 15, opening words and under (c), Qualification Regulation
3.3.3.1 General provisions
The IND may grant an asylum residence permit on the basis of Article 29a, paragraph 1, of the Aliens Act (Vreemdelingenwet) if there is a real risk of serious harm pursuant to Article 15, introductory description and under (c), of the Qualification Regulation.
3.3.3.2 International or domestic armed conflict and indiscriminate violence
The Minister may, on the basis of available country information, determine whether there is a situation of indiscriminate violence in a particular country or territory within the framework of an international or internal armed conflict. An international or internal armed conflict exists if the regular armed forces of a state are opposed to one or more armed groups, or when two or more armed groups are opposed to each other.
If the Minister has determined that there is an international or internal armed conflict within the meaning of Article 15, opening words and under (c), of the Qualification Directive, the Minister shall determine, on the basis of available country information, whether this conflict leads to indiscriminate violence and, if there is indiscriminate violence, on what scale this indiscriminate violence occurs.
In assessing the intensity of the indiscriminate violence, at least the following elements shall be weighed globally and in conjunction with one another:
the question of whether parties to the conflict employ methods of warfare that increase the risk of civilian casualties or target civilians;
the question whether the use of those methods is widespread among the warring parties;
the question of whether the violence is widespread or local;
the question of whether a safety structure is present;
the intensity of the armed confrontations and the level of organisation of the armed forces involved; and
the numbers of deaths, injuries and displaced persons among the civilian population as a result of the conflict.
Other (significant) indicators pointing to the fact that indiscriminate violence as a result of the armed conflict results in serious and individual threats against civilians may be involved in the assessment of whether there is a real risk of serious harm.
Humanitarian circumstances that are the direct or indirect consequence of the acts and/or omissions of an actor of serious harm who is a party to an armed conflict must be included as a relevant circumstance in this global assessment. Poor humanitarian circumstances resulting from the climate and natural phenomena, such as drought and floods, are not relevant in this context.
3.3.3.3 Gradations of arbitrary violence as a result of an international or internal armed conflict
The Minister may, in his assessment, establish gradations of arbitrary violence:
exceptional level of indiscriminate violence;
a relatively higher level of indiscriminate violence; or
relatively lower level of arbitrary violence.
Apart from these gradations, a situation exists in which no assessment within the meaning of Article 15, opening words and under (c), of the Qualification Directive takes place, because there is no armed conflict or there is no indiscriminate violence as a result of an armed conflict. In that case, the foreign national cannot, for that reason alone, qualify for a residence permit as referred to in Article 29a, paragraph 1, of the Aliens Act (Vreemdelingenwet).
Ad a. Exceptional level of arbitrary violence
There is an exceptional degree of indiscriminate violence if the overall situation of violence in the context of an international or internal armed conflict in the country of origin or in a specific area of this country is such that it is assumed that a foreign national, solely by virtue of his presence in that territory, faces a real risk of a serious and individual threat to his life or person. The requirement of individualisation of the foreign national is limited in these cases to originating from the country or specific area where such an exceptional degree of indiscriminate violence exists.
Ad b and c Relatively higher level and relatively lower level of arbitrary violence
If there is a relatively higher level or a relatively lower level of arbitrary violence, then the mere presence of the foreign national in the area concerned is in itself no longer sufficient to assume a real risk of serious harm.
In that case, the foreign national must demonstrate, on the basis of his individual situation and personal circumstances, that:
these circumstances lead to an increased risk of becoming a victim of indiscriminate violence; and
precisely the foreign national, specifically due to these circumstances, faces a real risk of becoming a victim of arbitrary violence.
These circumstances may relate in particular to private, professional or family life. This does not, however, mean that the presence of risk-increasing factors alone makes a real risk of serious harm plausible.
As the level of indiscriminate violence is lower, relatively more significant individual circumstances will be required to assume a real risk. At a relatively lower level of indiscriminate violence, the risk-increasing circumstances put forward by the foreign national will therefore have to carry more weight in order to be able to assume a real risk.
After a foreign national has presented his personal characteristics and individual circumstances and, where necessary, has made them plausible, the IND shall assess those circumstances in light of the security situation in the area from which the foreign national originates.
This means that only after the foreign national has put forward the relevant elements relating to the individual situation and the general situation in the country of origin, shall the IND determine that the risk may fall under Article 15, opening words and subparagraph (c), of the Qualification Regulation.
In this regard, the IND shall make a reasoned assessment and consider whether the foreign national has demonstrated that it is plausible that the relevant elements actually result in an increased risk of serious harm and that, as a result of these circumstances, the foreign national in particular runs a real risk of becoming a victim of indiscriminate violence.
In assessing the risk upon return, the IND may, depending on the individual case, take into account whether the foreign national can avoid harm upon return.
Hulpmiddel
The gradations outlined above are intended solely as an indicative tool for the IND. These gradations indicate in broad terms how the situation of indiscriminate violence in a (part of a) country of origin is assessed. The policy-based determination of the gradation of violence for the various countries thus aims to ensure that the IND incorporates the level of violence prevailing in a country into the assessment in a uniform manner. In that assessment, however, the individual circumstances put forward by the foreign national are paramount to the question of whether it has been made plausible that those circumstances increase the risk of becoming a victim of indiscriminate violence.
Previously suffered serious harm
In addition, the IND must take into account that the foreign national had already experienced violence prior to his departure from his country (see also Article 4, paragraph 4, of the Qualification Regulation). In this regard, it is irrelevant whether the previously experienced violence was the result of indiscriminate violence or of targeted violence. In this context, the IND assesses whether the previously experienced violence, in combination with the individual situation and personal circumstances of a foreign national and in light of the security situation, can lead to an increased risk of indiscriminate violence.
Country policy
In the country-specific policy in Chapter C10 Vc, it can be determined whether one of the gradations is applicable in the country or area concerned.
3.4 Actors of protection and internal protection alternative
3.4.1 Actors of protection
3.4.1.1 Protection by authorities
Article 7 of the Qualification Regulation describes what is understood by actors of protection. The IND shall not grant an asylum residence permit on the basis of Article 29 or 29a of the Aliens Act (Vreemdelingenwet), if actors of protection are able and willing to offer protection to the foreign national.
The IND assumes that protection of the foreign national by the authorities in the country of origin as referred to in Article 7, paragraph 1, opening words and under a, of the Qualification Regulation is not possible, if the threat to the foreign national originates from the authorities in the country of origin. There are two exceptions to this main rule:
the threat to the foreign national originates from a person or a group that forms part of the authorities, but a superior of that person or group is able and willing to act against the person or group causing the threat. In that case, the foreign national must seek the protection of that superior; or
the threat to the foreign national originates from local authorities, but the central authorities are willing and able to provide protection. In that case, the IND expects the foreign national to seek protection from the central authority.
In both exceptional situations, the IND finds that protection of the foreign national by the authorities in the country of origin is possible.
3.4.1.2 Protection by stable, established non-governmental organisations
The IND considers in any event the following organisations as stable, established non-governmental organisations, including international organisations within the meaning of Article 7, paragraph 1, opening words and under (b), of the Qualification Regulation:
UN; and
NAVO.
3.4.1.3 Protection effective and of a non-temporary nature (Article 7, paragraph 2, Qualification Regulation)
The IND considers the protection of the foreign national as referred to in Article 7, paragraph 1, of the Qualification Regulation to be in any case of a non-temporary nature, if there are no concrete indications that the effective protection of the foreign national against persecution or serious harm by the authorities and/or stable, established non-state actors will end within the foreseeable future.
Article 7, paragraph 2, of the Qualification Regulation indicates that actors of protection must take reasonable measures to prevent persecution or the suffering of serious harm. The actor of protection is not required to provide a full and conclusive guarantee against the threat of persecution or serious harm. The foreign national must have access to this protection.
3.4.1.4 Burden of proof
The IND first investigates whether protection is possible in general. In doing so, the IND makes use of general information from objective sources regarding the country of origin (see also Article 7, paragraphs 2 and 3, of the Qualification Regulation).
If the IND has determined that protection is possible, it is subsequently for the foreign national to render it plausible that a petition for protection to the actors of protection in his individual case must be deemed futile in advance or even dangerous. If the foreign national does not render the latter plausible, only the unsuccessful invocation of protection by him can lead to the conclusion that it has been rendered plausible that those authorities are not willing or able to provide protection.
The IND shall, in assessing whether the actors of protection in the country of origin are able and willing to provide effective protection, involve in any event:
the individual statements of the foreign national, including the statement that no protection is being offered;
the circumstance that the foreign national has demonstrated that he has unsuccessfully invoked the protection of the actors of protection; and
information regarding the general situation in the country of origin on the basis of official reports (ambtsberichten) from the Minister of Foreign Affairs and reports from international organisations (see also Article 7, paragraphs 2 and 3, of the Qualification Regulation).
3.4.2 Internal protection alternative
Article 8 of the Qualification Regulation governs what is understood by an internal protection alternative.
The IND shall not grant an asylum residence permit on the basis of Article 29 or 29a of the Vw if the IND concludes that an internal protection alternative as referred to in Article 8, paragraph 1, of the Qualification Regulation is available to the foreign national.
Pursuant to Article 8, paragraph 3, of the Qualification Regulation, the IND only proceeds to the question of whether there is an internal protection alternative once it has been established that there is a well-founded fear of persecution or a real risk of serious harm. In that case, the IND must investigate and demonstrate that a foreign national does not require international protection due to the existence of an internal protection alternative. In principle, an internal protection alternative is not deemed to exist if the state or state officials are the actors of persecution or serious harm. An exception to this may be made if it is clearly established that the authority of the actor concerned is clearly limited to a specific geographical area or when the state itself only has control over certain parts of the country.
If the IND reaches the conclusion that an internal protection alternative is available, the foreign national shall be given the opportunity to submit evidence and elements demonstrating that the internal protection alternative is not available to him. If the foreign national has not been questioned on this matter during the interview and has not been given the opportunity to provide evidence thereof, the foreign national must still be offered that opportunity. The IND shall take into account the evidence and elements submitted by the foreign national when deciding on the petition (application) for international protection.
In the investigation into the existence of an internal protection alternative, the IND assesses whether the foreign national can settle in a part of the country other than where he fears persecution or runs a real risk of serious harm.
In addition to the requirement that the threat must not exist in another part of the country, it is also of importance that the foreign national will not encounter a new threat in the other part of the country. If it is plausible that the foreign national also has reason to fear persecution or acts as referred to in Article 29 or 29a of the Vw in the other area, the IND shall assess whether the foreign national can invoke protection against the threat in that area (see paragraph C3/3.4.1 Vc).
It follows from Article 8, paragraph 1, of the Qualification Directive that the foreign national must be able to travel in a safe and lawful manner to and gain access to the territory where he is deemed to be able to invoke internal protection.
The protection afforded to the foreign national within the territory does not have to be the same as the protection the foreign national would have received in the Netherlands.
In assessing the existence of an internal protection alternative, the IND shall in any event take into account:
whether the foreign national can establish themselves in the territory and lead a life under circumstances which, measured by local standards, are to be regarded as normal;
whether the foreign national in the territory concerned is not disadvantaged in the exercise of essential rights in comparison to the rest of the population;
or whether the living conditions in the area concerned in general are not such that this in itself can lead to a humanitarian emergency;
the personal circumstances of the foreign national regarding factors such as health, age, gender, including gender identity, sexual orientation, ethnic origin and membership of a national minority; and
whether the foreign national would be able to provide for his own basic needs.
The fact that the circumstances in the area are less favourable than in the alien's original area of residence is an insufficient reason for the IND not to raise an internal protection alternative.
The IND assesses, having regard to Article 8, paragraph 4 of the Qualification Directive, on the basis of accurate and up-to-date information available from relevant sources concerning the country of origin, whether an internal protection alternative is present in the individual case of the foreign national.
In the country-specific asylum policy, the Minister may, on the basis of available accurate and up-to-date information from relevant sources and with due observance of the stated conditions, determine in advance or exclude the existence of an internal protection alternative.
3.5 Return to the country of origin
The IND shall, in principle, not grant an asylum residence permit on the basis of Article 29 or 29a of the Aliens Act (Vreemdelingenwet) if there are concrete indications that the foreign national has returned to the country of origin after submitting his petition for international protection.
3.1 Algemeen
3.1.1 Beoordeling feiten en omstandigheden
De IND beoordeelt de aanvraag voor een verblijfsvergunning asiel met inachtneming van artikel 4 Kwalificatieverordening en artikel 34 Procedureverordening.
3.1.2 Daden van vervolging
Artikel 9 Kwalificatieverordening beschrijft wat wordt verstaan onder daden van vervolging.
3.1.3 Actoren van vervolging en ernstige schade
Artikel 6 Kwalificatieverordening beschrijft wat wordt verstaan onder actoren van vervolging of ernstige schade.
3.1.4 Toepassing van artikel 5 Kwalificatieverordening (ter plaatse ontstane behoefte aan internationale bescherming)
Op grond van artikel 5 Kwalificatieverordening kan de IND een verblijfsvergunning asiel verlenen aan de vreemdeling, die aannemelijk gemaakt heeft een gegronde vrees voor vervolging of een reëel risico op het lijden van ernstige schade te hebben vanwege:
gebeurtenissen die hebben plaatsgevonden nadat de verzoeker het land van herkomst heeft verlaten; of
activiteiten die de verzoeker na het verlaten van zijn of haar land van herkomst heeft verricht, met name wanneer wordt vastgesteld dat de betrokken activiteiten de uitdrukking en de voortzetting vormen van overtuigingen, opvattingen of strekkingen die de betrokkene in het land van herkomst aanhing.
De behoefte aan internationale bescherming wordt aangeduid als ter plaatse ontstaan.
De IND beoordeelt op basis van algemeen beschikbare informatie, door de vreemdeling afgelegde verklaringen en eventueel ondersteunend bewijs of de vreemdeling problemen staan te wachten bij terugkeer en of die problemen zo ernstig zijn dat deze moeten worden beschouwd als daden van vervolging dan wel aanleiding geven om een reëel risico op ernstige schade aan te nemen. Wat betreft de vraag of van de vreemdeling terughoudendheid mag worden verwacht, wordt verwezen naar hetgeen hieronder wordt beschreven ten aanzien van politieke overtuiging, godsdienst en seksuele gerichtheid en genderaspecten.
Ook indien de activiteiten van de vreemdeling, die de vreemdeling heeft ondernomen na zijn vertrek uit het land van herkomst, niet volgen op activiteiten die de vreemdeling al in het land van herkomst heeft ondernomen vóór zijn vertrek kan de vreemdeling een ter plaatse ontstane behoefte hebben aan bescherming (zie ook artikel 5, eerste lid, aanhef en onder b, Kwalificatieverordening). Hiervan kan sprake zijn, als de vreemdeling voldoet aan de volgende voorwaarden:
de autoriteiten in het land van herkomst zijn bekend met, of de vreemdeling heeft aannemelijk gemaakt dat de autoriteiten in het land van herkomst op de hoogte zullen raken van, de activiteiten van de vreemdeling; en
de activiteiten leveren een gegronde vrees voor vervolging op dan wel een reëel risico op ernstige schade.
3.1.5 Misbruik van recht
De vreemdeling die geacht wordt een gegronde vrees te hebben voor vervolging of een reëel risico te lopen op ernstige schade, kan een verblijfsvergunning asiel onthouden worden als de vreemdeling de omstandigheden waarop het risico van vervolging of ernstige schade berust, zelf veroorzaakt heeft nadat hij het land van herkomst heeft verlaten met als enig of voornaamste doel de voorwaarden te creëren om in aanmerking te komen voor internationale bescherming (zie artikel 5, tweede lid, Kwalificatieverordening).
De IND moet motiveren uit welke feiten en omstandigheden volgt dat is voldaan aan de objectieve en subjectieve vereisten, waardoor aannemelijk is dat de vreemdeling voor zichzelf kunstmatig de voorwaarden heeft geschapen, alleen met als enig of voornaamste doel om zo in aanmerking te kunnen komen voor internationale bescherming. De enkele omstandigheid dat de gebeurtenissen na het verlaten van het land van herkomst plaatsvinden, is op zichzelf nog geen reden om artikel 5, tweede lid, Kwalificatieverordening toe te passen.
De toepassing van artikel 5, tweede lid, Kwalificatieverordening en het daarmee onthouden van een verblijfsvergunning asiel kan geen afbreuk doen aan het beginsel van non-refoulement zoals vastgelegd in artikel 3 EVRM en de artikelen 4 en 19, tweede lid, EU Handvest.
3.1.6 Aanvraag voor een verblijfsvergunning asiel bij een Nederlandse diplomatieke of consulaire vertegenwoordiging
De IND neemt geen aanvraag in behandeling voor een verblijfsvergunning asiel van een vreemdeling, die zich voor bescherming meldt bij een Nederlandse diplomatieke of consulaire vertegenwoordiging in zijn land van herkomst of een derde land. De vreemdeling wordt door de medewerker van de Nederlandse diplomatieke of consulaire vertegenwoordiging doorverwezen naar de autoriteiten van het derde land, waar de vreemdeling zich bevindt of naar de UNHCR of UNDP.
3.2 Verlening verblijfsvergunning asiel op grond van artikel 29, eerste lid (vluchtelingenstatus)
3.2.1 Algemeen
Artikel 3 onder 5, Kwalificatieverordening regelt wat wordt verstaan onder een ‘vluchteling’.
Artikel 13 Kwalificatieverordening in combinatie met artikel 24 Kwalificatieverordening bepaalt dat een verblijfstitel moet worden verleend zolang een vreemdeling de vluchtelingenstatus heeft. Artikel 14, tweede lid, Kwalificatieverordening regelt dat de IND, in bepaalde situaties, kan beslissen geen vluchtelingstatus te verlenen. De verlening van een verblijfsvergunning asiel is geregeld in artikel 29 Vw.
3.2.2 De uitsluitingsgronden van het Vluchtelingenverdrag
Een vreemdeling wordt uitgesloten van erkenning als vluchteling op grond van artikel 12 Kwalificatieverordening in de volgende gevallen:
als artikel 1D van het Vluchtelingenverdrag van toepassing is (artikel 12, eerste lid, aanhef en onder a, Kwalificatieverordening);
als artikel 1E van het Vluchtelingenverdrag van toepassing is (artikel 12, eerste lid, aanhef en onder b, Kwalificatieverordening); of
als artikel 1F van het Vluchtelingenverdrag van toepassing is (12, tweede tot en met vijfde lid, Kwalificatieverordening).
De IND verleent aan de vreemdeling geen verblijfsvergunning asiel, als één van deze uitsluitingsgronden zich voordoet.
3.2.2.1 Artikel 1D Vluchtelingenverdrag
De IND verleent de vreemdeling geen verblijfsvergunning asiel op grond van artikel 29, eerste lid, Vw, als hij onder de reikwijdte van artikel 1D Vluchtelingenverdrag valt. Wel toetst de IND door aan artikel 29a, eerste lid, Vw.
Artikel 1D Vluchtelingenverdrag is in de huidige praktijk van toepassing op de (staatloze) Palestijnse vluchteling die onder het mandaat van de UNRWA valt. Het mandaat van de UNRWA is van toepassing op vijf gebieden: Libanon, Jordanië, Syrië, de Westelijke Jordaanoever (de Westbank) en de Gazastrook.
Om in aanmerking te komen voor hulp van UNRWA moet een persoon:
voldoen aan de definitie van een Palestijnse vluchteling onder het mandaat van UNRWA; en
in één van deze vijf gebieden aanwezig zijn.
Voor de vreemdeling die niet onder het mandaat van UNRWA valt, is het reguliere asielbeleid van toepassing.
In twee opeenvolgende stappen beoordeelt de IND of een Palestijnse vluchteling, afkomstig uit één van de vijf UNRWA-mandaatgebieden, wordt uitgesloten van vluchtelingschap. Deze stappen zijn:
de Palestijnse vluchteling heeft direct voorafgaand aan of kort vóór het indienen van de asielaanvraag daadwerkelijk de door de UNRWA geboden hulp ingeroepen (of genoten); en
de hulp is opgehouden door redenen buiten de invloed en onafhankelijk van de wil van de vreemdeling.
Ad 1
Artikel 1D moet zodanig strikt worden uitgelegd dat het geen betrekking heeft op personen die enkel voor bescherming of bijstand van de UNRWA in aanmerking kwamen of komen, maar die niet hebben ingeroepen.
Ook is het van belang te beoordelen of de vreemdeling daadwerkelijk kort voor het indienen van de asielaanvraag de bescherming of bijstand van de UNRWA heeft ingeroepen of genoten. Enkel deze vreemdelingen vallen namelijk onder de reikwijdte van artikel 1D.
De beoordeling of en in hoeverre de vreemdeling bijstand heeft genoten van de UNRWA, is een individuele beoordeling, waarbij relevant is waaruit de bescherming of bijstand van de UNRWA in het individuele geval van de vreemdeling bestond.
Voor het aannemen van eerder genoten (of ingeroepen) bescherming of bijstand, is een registratie bij UNRWA geen vereiste. Het is echter wel een sterke indicatie dat de vreemdeling onder de reikwijdte van dat artikel valt.
Ad 2
Van belang is of de vreemdeling het mandaatgebied vrijwillig of gedwongen heeft verlaten, maar ook of de omstandigheden inmiddels zijn veranderd.
Er zijn twee situaties denkbaar waarin de bescherming of bijstand beschouwd wordt als opgehouden buiten de invloed van de vreemdeling:
UNRWA kan niet aan het mandaat voldoen: indien er sprake is van de opheffing van het orgaan dat de bescherming of de bijstand verleent, dan wel sprake is van een situatie waarin het betreffende orgaan in de onmogelijkheid verkeert zijn opdracht te volbrengen; en
de vreemdeling is genoodzaakt het mandaatgebied te verlaten: indien er sprake is van omstandigheden buiten de wil van de betrokken persoon, die hem ertoe dwingen het gebied waarin het UNRWA werkzaam is, te verlaten.
De beoordeling betreft een ex-nunc onderzoek. Er kan dus niet volstaan worden met een beoordeling van de situatie bij vertrek uit het land van gebruikelijk verblijf.
Ad a
De beoordeling of UNRWA aan het mandaat kan voldoen, is in beginsel een individuele. De bescherming of bijstand moet met name worden geacht te zijn opgehouden wanneer de UNRWA niet in staat is een specifieke verzoeker waardige levensomstandigheden en een minimum aan veiligheid te waarborgen, rekening houdend met eventuele kwetsbaarheden. Daarbij moet worden gedacht aan levensomstandigheden die de vreemdeling niet garanderen dat, overeenkomstig de opdracht van de UNRWA, wordt voldaan aan basisbehoeften op het gebied van gezondheidszorg, onderwijs en levensonderhoud.
Daarnaast is de situatie denkbaar dat de UNRWA aan geen enkele (staatloze) Palestijnse menswaardige levensomstandigheden of minimale veiligheid kan garanderen. Dit is aan de orde als in het betreffende werkgebied elke staatloze Palestijn terechtkomt in een situatie van zeer verregaande materiële deprivatie die hem niet in staat stelt om te voorzien in zijn meest elementaire behoeften zoals eten, zich wassen en beschikken over woonruimte.
Het is in beginsel aan de vreemdeling om aannemelijk te maken dat hij de door hem ontvangen bescherming of bijstand die hij eerder heeft ontvangen, niet opnieuw kan inroepen.
Ad b
Het gaat hier primair om de vraag of de vreemdeling het gebied vrijwillig heeft verlaten. Als de vreemdeling niet buiten zijn wil gedwongen is geweest het gebied te verlaten, is niet aannemelijk dat de bescherming of bijstand is opgehouden buiten de invloed van de vreemdeling.
Van gedwongen vertrek kan onder andere sprake zijn als de vreemdeling:
op basis van individuele omstandigheden heeft te vrezen voor vervolging;
vreest voor ernstige schade, bijvoorbeeld vanwege een situatie als bedoeld in artikel 15, aanhef en onder c, Kwalificatieverordening.
Ook als er na vertrek uit het land van herkomst omstandigheden zijn ontstaan waardoor de vreemdeling zich niet naar het mandaatgebied kan begeven, kan aangenomen worden dat de bescherming of bijstand is opgehouden buiten de invloed van de vreemdeling. In het geval van vrijwillig vertrek is het aan de vreemdeling om dat aannemelijk te maken.
Als sprake is van onvrijwillig vertrek maar nadien zijn de levensomstandigheden in het betreffende mandaatgebied verbeterd, dan kan dat ook bij de beoordeling worden betrokken. Dat kan (alsnog) leiden tot uitsluiting op grond van artikel 1D van het Verdrag. De bewijslast ligt bij de IND.
Feitelijke toegankelijkheid
In het kader van de toepassing van artikel 1D van het Vluchtelingenverdrag hoeft de IND, bij de beoordeling van de asielaanvraag, niet te beoordelen of de vreemdeling toegang kan krijgen tot het UNRWA-gebied waar hij eerder heeft verbleven.
Bij de vraag of de vreemdeling bescherming of bijstand van UNRWA kan krijgen in een ander mandaatgebied dan het mandaatgebied waar hij zijn werkelijke verblijfplaats had, speelt de feitelijke toegankelijkheid wel een rol. Als de vreemdeling niet wordt toegelaten tot het andere mandaatgebied, kan hem niet tegengeworpen worden dat hij daar de bescherming of bijstand van UNRWA kan inroepen.
Verblijfsvergunning asiel
De IND verleent een verblijfsvergunning asiel op grond van artikel 29, eerste lid, Vw als de vreemdeling:
kort voor het indienen van de asielaanvraag daadwerkelijk de door de UNRWA geboden hulp heeft ingeroepen (of genoten); en
de hulp is opgehouden door redenen buiten de invloed en onafhankelijk van de wil van de vreemdeling, zoals hierboven vermeld.
De IND verleent geen verblijfsvergunning asiel, als de vreemdeling:
beschikt over een nationaliteit; en
de bescherming van de eigen autoriteiten in kan roepen.
De IND verleent geen verblijfsvergunning asiel als de (staatloze) Palestijnse vreemdeling zich schuldig heeft gemaakt aan handelingen als bedoeld in de uitsluitingsgrond van artikel 1F Vluchtelingenverdrag.
3.2.2.2 Artikel 1E van het Vluchtelingenverdrag (artikel 12, eerste lid, aanhef en onder b, Kwalificatieverordening)
Dit artikel heeft betrekking op vreemdelingen die anders in aanmerking zouden komen voor de vluchtelingenstatus en die zijn opgevangen in een land waar hun de meeste rechten zijn toegekend die onderdanen gewoonlijk genieten, maar waar zij geen formeel staatsburgerschap hebben.
3.2.2.3 Artikel 1F van het Vluchtelingenverdrag (artikel 12, tweede tot en met vijfde lid, Kwalificatieverordening)
Artikel 12, tweede lid, Kwalificatieverordening regelt, dat een onderdaan van een derde land of staatloze wordt uitgesloten van de erkenning als vluchteling, als er ernstige redenen zijn om te veronderstellen dat een vreemdeling oorlogsmisdrijven of andere ernstige misdrijven heeft gepleegd. Dit komt overeen met de tekst van artikel 1F Vluchtelingenverdrag. Daarom wordt in de Vc nog steeds gesproken over artikel 1F Vluchtelingenverdrag (of kortweg 1F).
De IND verleent in dat geval de vreemdeling geen verblijfsvergunning asiel (zie paragraaf C4/3.6.2 Vc).
3.2.3 Groepsvervolging
Er is sprake van groepsvervolging, als in een land van herkomst een groep vreemdelingen systematisch wordt blootgesteld aan vervolging wegens een van de gronden van artikel 10 Kwalificatieverordening.
De minister kan een groep aanwijzen waarvoor sprake is van groepsvervolging. Situaties waarin sprake is van groepsvervolging worden opgenomen in het landgebonden beleid.
Ook voor de vreemdeling die zich beroept op groepsvervolging geldt het individualiseringsvereiste. De vreemdeling moet aannemelijk maken dat hij behoort tot de groep vreemdelingen voor wie groepsvervolging wordt aangenomen.
3.2.4 Risicoprofielen
Zoals in paragraaf C3/2.4 Vc is opgenomen kan de minister in verband met de situatie in een land risicoprofielen aanwijzen.
3.2.5 Uitgangspunten beoordeling gronden van vervolging in de zin van artikel 10 Kwalificatieverordening
De IND beoordeelt een aanvraag voor een verblijfsvergunning asiel met inachtneming van artikel 10 Kwalificatieverordening. De gronden voor vervolging worden hieronder nader uitgewerkt.
De IND verleent een verblijfsvergunning asiel op grond van artikel 29, eerste lid, Vw, als sprake is van daden van vervolging als bedoeld in artikel 9 Kwalificatieverordening.
In de paragrafen hieronder worden de volgende gronden uit artikel 10 Kwalificatieverordening nader uitgewerkt:
ras;
godsdienst;
nationaliteit;
sociale groep;
politieke overtuiging.
Voor de beoordeling van de gronden ras, dat met name de aspecten huidskleur, afkomst of het behoren tot een bepaalde etnische groep omvat, en nationaliteit wordt geen apart kader uitgewerkt. De beoordeling volgt de algemene systematiek.
3.2.5.1 Godsdienst (artikel 10, eerste lid, aanhef en onder b, Kwalificatieverordening)
Het begrip ‘godsdienst’ omvat een breed scala aan overtuigingen, met name theïstische, niet-theïstische en atheïstische (geloofs)overtuigingen. De omstandigheid dat de vreemdeling zijn godsdienst in zijn land van herkomst niet op dezelfde wijze kan uitoefenen als in Nederland vormt onvoldoende aanleiding om de vreemdeling in het bezit te stellen van een verblijfsvergunning asiel op grond van artikel 29, eerste lid, Vw.
Niet elke aantasting van het recht op godsdienstvrijheid zal dan ook een daad van vervolging in de zin van artikel 10 Kwalificatieverordening vormen. Bij de beoordeling of een aantasting van het recht op godsdienstvrijheid een daad van vervolging vormt, moet de IND, gelet op de persoonlijke situatie van de vreemdeling tegen de achtergrond van hetgeen uit algemene informatie bekend is, onderzoeken of deze om redenen van de uitoefening van die vrijheid in zijn land van herkomst een werkelijk gevaar loopt om te worden vervolgd.
De IND weegt bij de beoordeling van de aanvraag voor een verblijfsvergunning asiel in ieder geval mee dat:
de vreemdeling, die een geloofsovertuiging aanhangt, de uitingen van zijn geloofsovertuiging in zijn land van herkomst niet verborgen hoeft te houden, ook niet in de situatie dat de vreemdeling voorafgaand aan zijn vertrek uit het land van herkomst zijn geloofsovertuiging verborgen heeft gehouden; en
van de vreemdeling niet wordt verwacht dat hij afziet van godsdienstige handelingen, die voor hem persoonlijk bijzonder belangrijk zijn om zijn godsdienstige identiteit te bewaren, om vervolging te voorkomen.
De IND beoordeelt of de maatregelen en sancties die tegen de vreemdeling zullen worden genomen als hij bij terugkeer naar zijn land van herkomst bepaalde – voor zijn godsdienstige identiteit bijzondere belangrijke – handelingen verricht voldoende zwaarwegend zijn om te spreken van vervolging.
Ook als de vreemdeling aannemelijk maakt dat hij bij terugkeer zich gedwongen voelt om zijn geloofsovertuiging terughoudend uit te oefenen vanwege de risico’s die hij anders loopt, kan sprake zijn van vervolging in de zin van artikel 10 Kwalificatieverordening.
3.2.5.2 Sociale groep (artikel 10, eerste lid, aanhef en onder d, Kwalificatieverordening)
Bij de beoordeling van de gronden in de zin van artikel 10 Kwalificatieverordening wordt rekening gehouden met de omstandigheid dat sprake is van een sociale groep. Een groep wordt geacht een sociale groep te vormen als leden van een groep in ieder geval aan twee cumulatieve voorwaarden voldoen.
Ten eerste moeten de leden van een sociale groep aan ten minste één van de volgende voorwaarden voldoen:
een aangeboren kenmerk vertonen;
een gemeenschappelijke achtergrond hebben die niet gewijzigd kan worden; of
een kenmerk of geloof delen dat voor de identiteit van de betrokkenen dermate fundamenteel is, dat niet mag worden geëist dat zij dit opgeven.
Ten tweede moet de sociale groep in het land van herkomst een eigen identiteit hebben, omdat zij – in haar directe omgeving – als afwijkend wordt beschouwd.
Het individualiseringsvereiste als opgenomen in paragraaf C3/2.3 Vc is van toepassing. Daarnaast is ook paragraaf C3/4 Vc (beoordelen van de asielaanvraag) van toepassing.
3.2.5.2.1 Vrouwen
Vrouwen in het algemeen, als ook een beperkte groep vrouwen, die een bepaald gemeenschappelijk kenmerk delen, kunnen, afhankelijk van de omstandigheden in het land van herkomst of in een bepaald gebied in dat land, aangemerkt worden als sociale groep.
De volgende elementen kunnen met name van belang zijn voor de beoordeling of bij vrouwen sprake is van een sociale groep:
culturele, religieuze of traditionele normen (zoals genitale verminking, gedwongen sterilisatie of gedwongen abortus);
onttrekking van vrouwen aan of weigering van een gedwongen huwelijk of het verbreken van een huwelijk; of
het bestaan van huiselijk, seksueel en/of eergerelateerd geweld.
Daarbij zal worden beoordeeld of de groep waar de vrouw toe behoort in het land van herkomst een eigen identiteit heeft, omdat deze groep in haar directe omgeving als afwijkend wordt beschouwd.
De minister kan in de context van specifiek landenbeleid vaststellen of (een groep) vrouwen behoort/behoren tot een sociale groep. Als hiervan sprake is, wordt dat ook opgenomen in het landenbeleid van hoofdstuk C9 Vc.
Voor zover (een specifieke groep) vrouwen behoren tot een sociale groep, dan kan onder andere gendergerelateerd geweld tegen deze vrouwen leiden tot de conclusie dat sprake is van erkenning als vluchteling als bedoeld in artikel 13 Kwalificatieverordening, als dat geweld kan worden aangemerkt als daad van vervolging zoals bedoeld in artikel 9 Kwalificatieverordening. Op de vraag of een vrouw als lid van een sociale groep in aanmerking komt voor een verblijfsvergunning asiel op grond van artikel 29, eerste lid, Vw is het individualiseringsvereiste zoals beschreven in paragraaf C3/2.3 Vc onverkort van toepassing. Op individuele basis zal beoordeeld moeten worden of zij daadwerkelijk te vrezen heeft voor daden van vervolging vanwege het behoren tot een sociale groep.
Vereenzelviging met de fundamentele waarde van gelijkheid tussen vrouwen en mannen
Vrouwen, die zich daadwerkelijk vereenzelvigen met de fundamentele waarde van gelijkheid tussen vrouwen en mannen (verder: vereenzelviging) kunnen al naar gelang de omstandigheden in het land van herkomst behoren tot een ‘sociale groep’. Daarbij is van belang dat het gestelde in paragraaf C3/3.2.5.2 Vc ook van toepassing is op de vraag of een vrouw die een beroep doet op vereenzelviging behoort tot een sociale groep.
Het behoren tot deze sociale groep kan een grond zijn om aan te nemen dat er sprake is van erkenning als vluchteling als bedoeld in artikel 13 Kwalificatieverordening. Het is aan de vrouw die een beroep doet op vereenzelviging om aannemelijk te maken dat hier in haar persoonlijke situatie sprake van is.
De IND toetst aan de hand van een ‘drietrapsbeoordeling’ of een vrouw aannemelijk heeft gemaakt dat er sprake is van gegronde vrees voor vervolging door het behoren tot een sociale groep vanwege vereenzelviging:
vaststellen van de vereenzelviging in het individuele geval;
vaststellen of de groep waartoe de vrouw stelt te behoren, in het land van herkomst een eigen identiteit heeft, omdat deze groep in haar directe omgeving als afwijkend wordt beschouwd; en
vaststellen of er sprake is van gegronde vrees voor daden van vervolging als gevolg hiervan.
Ad 1.
De IND moet eerst vaststellen of de vrouw in haar individuele geval aannemelijk heeft gemaakt dat de vereenzelviging is te herleiden naar de fundamentele waarde, die de vrouw hecht aan de gelijkheid tussen vrouwen en mannen.
Bij de vraag of sprake is van vereenzelviging valt te denken aan het maken van zelfstandige en onafhankelijke keuzes die bepalend zijn voor haar identiteit op gebied van onderwijs en beroepsloopbaan, de mogelijkheid om economisch onafhankelijk te worden door buitenshuis te werken, de beslissing om alleen of in gezinsverband te wonen en de partnerkeuze.
Bij de beoordeling of sprake is van vereenzelviging betrekt de IND in ieder geval:
of de vrouw aannemelijk heeft gemaakt dat de vereenzelviging fundamenteel is voor de identiteit of morele integriteit van de vrouw;
aannemelijk is gemaakt dat deze vereenzelviging dermate fundamenteel is, dat van haar niet mag worden geëist dat zij dit opgeeft;
de wijze waarop de vrouw hier in haar dagelijkse leven invulling aan geeft en in het verleden heeft gegeven; en
de wijze waarop de vrouw hier invulling aan wenst te geven bij terugkeer naar land van herkomst.
Daarbij geldt dat als de vrouw nog weinig tot geen invulling aan de vereenzelviging geeft of heeft gegeven van de vrouw verwacht mag worden dat zij kan uitleggen waarom dit het geval is en waarom de vereenzelviging desondanks fundamenteel is voor haar identiteit.
Voor de vrouw die een beroep doet op vereenzelviging geldt dat de gestelde vereenzelviging niet uit politieke of religieuze motieven hoeft voort te komen. Voor zover hier in de praktijk wel sprake van is, wordt verwezen naar paragrafen C3/3.2.5.1 en C3/3.2.5.3 Vc.
Als de IND heeft geoordeeld dat van een geloofwaardige vereenzelviging sprake is, wordt overgegaan tot de volgende stap in de beoordeling.
Ad 2.
Vervolgens beoordeelt de IND of de vrouw als gevolg van de vereenzelviging kan behoren tot een sociale groep. Om als sociale groep aangemerkt te worden, moet de vrouw aannemelijk maken dat zij behoort tot een groep die als gevolg van de vereenzelviging een eigen identiteit heeft, omdat zij als afwijkend wordt beschouwd in de directe omgeving in het land van herkomst.
Dit met name als gevolg van de sociale, morele of juridische normen die in het land van herkomst gelden.
De IND beoordeelt de aannemelijkheid van de verklaringen van de vrouw over waarom de groep als afwijkend wordt beschouwd, in samenhang met de beschikbare landeninformatie.
Ad 3.
Vervolgens beoordeelt de IND of sprake is van een gegronde vrees voor vervolging vanwege het (toegedicht) behoren tot een sociale groep vanwege vereenzelviging. De IND beoordeelt de vrees voor vervolging aan de hand van door de vrouw verstrekte verklaringen en bewijsmiddelen over wat zij bij terugkeer naar het land van herkomst stelt te vrezen te hebben.
Dat een reden om vanwege vereenzelviging te worden vervolgd kan worden vermeden door zich terughoudend op te stellen, wordt in dit verband niet aan de vrouw tegengeworpen. Van de vrouw mag namelijk niet worden verlangd dat zij een vereenzelviging die fundamenteel is, opgeeft.
Genitale verminking
De IND verleent een vrouw, die zich beroept op een vrees voor genitale verminking, een verblijfsvergunning asiel op grond van artikel 29, eerste lid, Vw, als wordt voldaan aan alle volgende voorwaarden:
er is een gegronde vrees op genitale verminking;
artikel 7 Kwalificatieverordening is niet van toepassing; en
artikel 8 Kwalificatieverordening is niet van toepassing.
De IND beoordeelt op basis van de individuele verklaringen van de vreemdeling of de vreemdeling in aanmerking komt voor een verblijfsvergunning asiel op grond van artikel 29, eerste lid, Vw vanwege een gegronde vrees op genitale verminking bij vrouwen.
De IND weegt daarbij de algemene informatie over genitale verminking bij vrouwen in het land van herkomst mee. Dit kan bijvoorbeeld blijken uit een ambtsbericht van de Minister van Buitenlandse Zaken.
Voor zover de ouder van een meisje dat of vrouw die te vrezen heeft voor genitale verminking, stelt in aanmerking te komen voor bescherming op grond van een (toegedichte) overtuiging, kan beoordeeld worden of de ouder zelfstandig in aanmerking komt voor een verblijfsvergunning asiel op grond van een religieuze overtuiging, het behoren tot een sociale groep en/of een politieke overtuiging.
De IND verleent in ieder geval geen verblijfsvergunning asiel op grond van artikel 29 eerste lid, Vw, vanwege een beroep op een vrees voor genitale verminking (van een familielid) aan de ouder die de genitale verminking zelf uitvoert of de uitvoering ervan mogelijk maakt.
3.2.5.2.2 Seksuele gerichtheid
De IND kan een vreemdeling aanmerken als lid van een sociale groep als hij behoort tot de groep die als gemeenschappelijk kenmerk (toegedichte) seksuele gerichtheid heeft.
Seksuele gerichtheid gaat in elk geval over iemands seksuele en/of emotionele en/of intieme aantrekking tot een ander persoon. Daarbij zal de IND beoordelen of deze groep in het land van herkomst een eigen identiteit heeft, omdat deze groep in de directe omgeving als afwijkend van de heteroseksuele norm wordt beschouwd.
De IND onderzoekt de seksuele gerichtheid van de vreemdeling en zijn uiting daarvan aan de hand van het beoordelingskader van de paragrafen C3/4.3 en C3/4.4 Vc. De omstandigheid dat de vreemdeling zijn seksuele gerichtheid in zijn land van herkomst niet op dezelfde wijze kan uiten als in Nederland vormt op zichzelf onvoldoende aanleiding om aan te nemen dat er sprake is van gegronde vrees voor vervolging. Niet elke aantasting van het recht op het uiten van de seksuele gerichtheid vormt een daad van vervolging in de zin het Vluchtelingenverdrag. Voor de beoordeling of een aantasting van dit recht een daad van vervolging vormt, moet de IND onderzoeken of de vreemdeling in zijn land van herkomst gegronde vrees heeft om vervolgd te worden.
De IND verleent met inachtneming van artikel 9 Kwalificatieverordening een verblijfsvergunning asiel op grond van artikel 29, eerste lid, Vw aan een vreemdeling op grond van zijn seksuele gerichtheid, in ieder geval als sprake is van ten minste een van de volgende situaties:
de vreemdeling heeft aannemelijk gemaakt dat hij vanwege zijn (toegedichte) seksuele gerichtheid dreigt te worden blootgesteld aan daden van geweld, die zo ernstig zijn dat deze daden van geweld een ernstige schending van de grondrechten van de mens vormen;
in het land van herkomst gelden strafbepalingen op grond van de seksuele gerichtheid, deze strafrechtelijke bepalingen worden in de praktijk door de autoriteiten daadwerkelijk ten uitvoer gelegd en er is sprake van een zeker gewicht van de strafbepaling; of
de autoriteiten van het land van herkomst voeren op grond van de (toegedichte) seksuele gerichtheid maatregelen uit die discriminerend zijn of op een discriminerende wijze worden uitgevoerd. Deze maatregelen zijn op zichzelf of in samenstel (cumulatief) voldoende ernstig.
Bij de beoordeling of sprake is van strafbepalingen en/of discriminerende maatregelen die zien op de seksuele gerichtheid betrekt de IND in ieder geval:
de schaal waarop strafrechtelijke vervolging vanwege de seksuele gerichtheid voorkomt;
de toepassing van opgelegde (gevangenis)straffen;
het (voorafgaande) politie- en strafvorderlijk onderzoek; en
de gevolgen van de strafbaarstelling voor de maatschappelijke positie van deze groep.
Als de seksuele gerichtheid of seksuele handelingen strafbaar is/zijn in het land van herkomst wordt niet van de vreemdeling verwacht dat hij bescherming inroept of in kan roepen conform artikel 7 Kwalificatieverordening.
Bij de beoordeling van de individuele situatie van de vreemdeling geldt het uitgangspunt dat de vreemdeling zijn seksuele gerichtheid in zijn land van herkomst niet verborgen hoeft te houden, ook niet in de situatie dat de vreemdeling voorafgaand aan zijn vertrek uit het land van herkomst zijn seksuele gerichtheid verborgen heeft gehouden. De IND onderzoekt op welke wijze de vreemdeling zijn seksuele gerichtheid in Nederland uit en hoe de vreemdeling voornemens is deze in zijn land van herkomst te uiten. De vreemdeling moet aannemelijk maken dat deze uiting leidt tot een daad van vervolging.
De IND verlangt van de vreemdeling geen terughoudendheid bij de invulling van zijn seksuele gerichtheid en hanteert om die reden, bij de beoordeling van het risico op vervolging, steeds een zekere ‘ondergrens’. De ondergrens houdt in het feitelijk uiten van de eigen geaardheid en relaties aangaan op een manier die niet wezenlijk anders is dan van heteroseksuelen in het betreffende land van herkomst is geaccepteerd. De IND verwacht in die uiting geen terughoudendheid. In die gevallen gaat de IND er in beginsel bij de beoordeling van het risico op vervolging van uit dat de directe omgeving, zoals hierboven benoemd, op de hoogte is of kan geraken van de seksuele gerichtheid. De IND beoordeelt vervolgens of de uiting conform de ondergrens tot vervolging zou leiden.
Als de vreemdeling aangeeft zijn seksuele gerichtheid te willen uiten op een wijze die verder gaat dan deze ‘ondergrens’ toetst de IND de geloofwaardigheid van deze uiting en toetst de IND de wijze waarop de vreemdeling voornemens is in zijn land van herkomst zijn seksuele gerichtheid te uiten. In de situatie dat de seksuele gerichtheid wel geloofwaardig wordt geacht maar de verdergaande wijze waarop de vreemdeling deze wil uiten niet, gaat de IND na of het invulling geven aan de seksuele gerichtheid conform de ‘ondergrens’ tot vervolging zou leiden. In die situatie kan de vreemdeling in aanmerking komen voor een asielvergunning, ook als een deel van de verklaring (het uiten van de gerichtheid op een wijze die verder gaat dan de ‘ondergrens’) als niet aannemelijk wordt beschouwd.
De IND betrekt bij de beoordeling of in het land van herkomst sprake is van discriminatoire behandeling vanwege de seksuele gerichtheid, afgezet tegen de aldaar geldende normen en gebruiken. Indien in het land van herkomst sprake is van strafbaarstelling van seksuele gerichtheid of seksuele handelingen beoordeelt de IND hoe daar in de praktijk mee wordt omgegaan en zet dit af tegen de persoonlijke situatie van de vreemdeling.
Als de vreemdeling zich beroept op zowel zijn seksuele gerichtheid als zijn genderidentiteit en/of genderexpressie, is paragraaf C3/3.2.5.2.3 Vc ook van toepassing.
3.2.5.2.3 Genderidentiteit en genderexpressie
De IND kan een vreemdeling als lid van een sociale groep aanmerken als hij behoort tot de groep die als gemeenschappelijk kenmerk heeft dat de diepgevoelde, persoonlijke beleving van zijn gender en/of zijn lichaam niet of niet eenduidig overeenkomt met het geslacht dat hij bij de geboorte (toegewezen) heeft gekregen, of dit aan hem wordt toegedicht. Het kan hierbij ook gaan om genderexpressie. Genderexpressie ziet op de manier waarop de vreemdeling zijn gender presenteert door middel van fysieke verschijning – inclusief maar niet beperkt tot kleding, kapsels, accessoires, cosmetica – en manieren, spraak, gedragspatronen, namen en persoonlijke referenties. Dit hoeft niet overeen te komen met de genderidentiteit. Daarbij zal de IND beoordelen of deze groep in het land van herkomst een eigen identiteit heeft, omdat deze groep in de directe omgeving als afwijkend wordt beschouwd.
Indien de vreemdeling zich enkel beroept op genderexpressie, wat los staat van de genderidentiteit, beoordeelt de IND of de vormen van expressie dermate fundamenteel zijn voor de identiteit waardoor niet mag worden verwacht dat de vreemdeling zich aanpast naar de in het land van herkomst geldende normen en gebruiken zoals bedoeld in C3/3.2.5.2 Vc.
De IND onderzoekt de genderidentiteit en/of de genderexpressie van de vreemdeling aan de hand van het beoordelingskader van paragrafen C3/4.3 en C3/4.4 Vc. De omstandigheid dat de vreemdeling zijn genderidentiteit en/of genderexpressie in zijn land van herkomst niet op dezelfde wijze kan uiten als in Nederland vormt op zichzelf onvoldoende aanleiding om aan te nemen dat er sprake is van gegronde vrees voor vervolging. Niet elke aantasting van het recht op het uiten van de genderidentiteit en/of de genderexpressie vormt een daad van vervolging in de zin van het Vluchtelingenverdrag.
Voor de beoordeling of een aantasting van dit recht een daad van vervolging vormt, onderzoekt de IND of de vreemdeling in zijn land van herkomst gegronde vrees heeft om vervolgd te worden. Artikel 9 Kwalificatieverordening beschrijft wat verstaan wordt onder daden van vervolging. Deze moeten zo ernstig van aard zijn of zo vaak voorkomen dat zij een ernstige schending vormen van de grondrechten van de mens of een samenstel zijn van verschillende maatregelen, waaronder mensenrechtenschendingen, die voldoende ernstig zijn om iemand op een soortgelijke wijze te treffen.
De IND merkt discriminatie door de autoriteiten en door medeburgers aan als daad van vervolging, als de vreemdeling vanwege de discriminatie zo ernstig wordt beperkt in zijn bestaansmogelijkheden dat hij onmogelijk op maatschappelijk en sociaal gebied kan functioneren. De IND hanteert voor de beoordeling of sprake is van discriminatie die dermate ernstig is dat sprake is van vervolging, het beoordelingskader van paragraaf C3/3.2.6 Vc.
De IND verleent, met inachtneming van artikel 9 Kwalificatieverordening, een verblijfsvergunning asiel op grond van artikel 29, eerste lid, Vw aan een vreemdeling op grond van zijn genderidentiteit en/of genderexpressie, als in ieder geval sprake is van ten minste een van de volgende situaties:
de vreemdeling heeft aannemelijk gemaakt dat deze vanwege zijn (toegedichte) genderidentiteit en/of genderexpressie dreigt te worden blootgesteld aan daden van geweld en/of discriminatie, die zo ernstig zijn dat deze daden een ernstige schending van de grondrechten van de mens vormen;
in het land van herkomst gelden strafbepalingen in het kader van genderidentiteit en/of genderexpressie, deze strafrechtelijke bepalingen worden in de praktijk door de autoriteiten daadwerkelijk ten uitvoer gelegd, en er is sprake van een zeker gewicht van de strafbepaling; of
de autoriteiten van of andere actoren in het land van herkomst voeren op grond van (toegedichte) genderidentiteit en/of genderexpressie maatregelen uit die discriminerend zijn of op een discrimineerde wijze worden uitgevoerd. Deze maatregelen zijn op zichzelf of in samenstel (cumulatief) voldoende ernstig.
Ad a
Als er sprake is van op de vreemdeling gerichte daden van geweld en/of discriminatie vanwege de genderidentiteit en/of genderexpressie in het land van herkomst moeten de daden, op zichzelf of in samenhang met andere daden dusdanig ernstig zijn dat er sprake is van een daad van vervolging en moet er geen bescherming mogelijk zijn hiertegen van de autoriteiten of internationale organisaties, zoals bedoeld in paragraaf C3/3.4 Vc.
Ad a en b
In het voorkomende geval dat de vreemdeling aannemelijk maakt dat hij bij terugkeer naar het land van herkomst wordt gedetineerd om een reden anders dan zijn genderidentiteit en/of genderexpressie, moet hij aannemelijk maken in detentie een reëel risico te lopen om te worden blootgesteld aan ernstig (seksueel) geweld vanwege zijn genderidentiteit en/of genderexpressie waartegen de (detentie)autoriteiten geen bescherming kunnen of willen bieden. Daarbij betrekt de IND of de situatie zich zal voordoen dat de vreemdeling gedetineerd wordt met personen van een geslacht dat niet overeenkomt met zijn genderidentiteit. Indien sprake is van een commuun delict dient daarbij wel beoordeeld te worden of er sprake is van een gevaar voor de openbare orde. Hiervoor is het beoordelingskader zoals bedoeld in paragraaf C4/3.6 Vc van toepassing.
Ad b en c.
De IND onderzoekt of de vreemdeling bij terugkeer onder dreiging (van geweld) door een actor wordt gedwongen een bepaalde vorm van arbeid (zoals sekswerk) te verrichten en dit verband houdt met zijn genderidentiteit en/of genderexpressie waardoor hem een discriminatoire of onevenredige bestraffing vanwege deze vorm van arbeid te wachten staat. In de situatie dat er sprake is van (een vorm van) discriminatie is het beoordelingskader, zoals bedoeld in paragraaf C3/3.2.6 Vc, van toepassing.
Ad c.
Het enkele feit dat er geen mogelijkheden bestaan om het geslacht aan te laten passen in officiële documenten (wettelijke erkenning), of dat hieraan de voorwaarde wordt gesteld dat er een geslachtsverandering heeft plaatsgevonden, is op zichzelf onvoldoende om een gegronde vrees voor vervolging aan te nemen. Dat laat onverlet dat de gevolgen van het niet kunnen aanpassen van het geslacht voor de vreemdeling kunnen leiden tot maatregelen die, op zichzelf staand of in samenstel, dermate ernstig zijn dat deze behandeling de lat van vervolging haalt.
Bij de beoordeling of sprake is van strafbepalingen en/of discriminerende maatregelen die zien op de genderidentiteit of genderexpressie betrekt de IND in ieder geval:
de schaal waarop strafrechtelijke vervolging vanwege de genderidentiteit en/of genderexpressie voorkomt;
de toepassing van de opgelegde (gevangenis)straffen;
het (voorafgaande) politie- en strafvorderlijk onderzoek; en
de gevolgen van de strafbaarstelling en de strafbepalingen voor de maatschappelijke positie van genderdiversen.
Als genderexpressie of het uiten van de genderidentiteit, anders dan de geldende normen in het land van herkomst, strafbaar is (of hier andere strafbepalingen voor gelden), wordt niet van de vreemdeling verwacht dat hij bescherming inroept of in kan roepen conform artikel 7 Kwalificatieverordening.
De IND betrekt bij de beoordeling of in het land van herkomst sprake is van discriminatoire behandeling vanwege de genderidentiteit en/of genderexpressie. Als in het land van herkomst sprake is van strafbaarstelling van de genderexpressie of het uiten van de genderidentiteit anders dan de vreemdeling bij de geboorte heeft gekregen, beoordeelt de IND hoe daar in de praktijk mee wordt omgegaan en zet dit af tegen de persoonlijke situatie van de vreemdeling.
Als de vreemdeling aannemelijk maakt geheel of gedeeltelijk uitgesloten te worden van toegang tot de gezondheidszorg in het land van herkomst op basis van zijn genderidentiteit en/of genderexpressie, onderzoekt de IND of dit leidt tot ernstige consequenties. Dit beoordeelt de IND in samenhang met de vraag of sprake is van een discriminatoire behandeling of maatregel die in samenstel met andere maatregelen voldoende ernstig is dat sprake is van vervolging. Het enkele feit dat er geen genderbevestigende zorg beschikbaar is, is op zichzelf geen reden om een gegronde vrees voor vervolging aan te nemen.
Bij de beoordeling van de individuele situatie van de vreemdeling geldt het uitgangspunt dat de vreemdeling zijn genderidentiteit in zijn land van herkomst niet verborgen hoeft te houden, ook niet in de situatie dat de vreemdeling voorafgaand aan zijn vertrek uit het land van herkomst zijn genderidentiteit verborgen heeft gehouden. De IND onderzoekt op welke wijze de vreemdeling zijn genderidentiteit in Nederland uit en hoe de vreemdeling voornemens is deze in zijn land van herkomst te uiten. Het kan hier ook gaan om de genderexpressie. De vreemdeling moet aannemelijk maken dat deze uiting leidt tot een daad van vervolging. In die gevallen gaat de IND er in beginsel bij de beoordeling van het risico op vervolging van uit dat de directe omgeving zoals hierboven benoemd op de hoogte is of kan geraken van de genderidentiteit en/of genderexpressie.
Als de vreemdeling zich beroept op zowel zijn genderidentiteit en genderexpressie als zijn seksuele gerichtheid, is paragraaf C3/3.2.5.2.2 Vc over seksuele gerichtheid ook van toepassing.
3.2.5.3 Politieke overtuiging (artikel 10, eerste lid, aanhef en onder e, Kwalificatieverordening)
Artikel 10, eerste lid, aanhef en onder e, Kwalificatieverordening bepaalt wat moet worden verstaan onder de vervolgingsgrond ‘politieke overtuiging’.
De eerste vraag die de IND moet beantwoorden als een vreemdeling zijn politieke overtuiging als asielmotief naar voren brengt, is of er daadwerkelijk sprake is van een politieke overtuiging. Een politieke overtuiging kan bestaan uit een opvatting, gedachte of mening, gericht tegen de autoriteiten van het land van herkomst. Het hoeft hier niet te gaan om een diepgewortelde politieke overtuiging.
De sterkte van de overtuiging speelt geen rol bij de vraag of er sprake is van een politieke overtuiging, maar is nog wel relevant in de beoordeling of de vreemdeling een risico loopt bij terugkeer.
De IND beoordeelt of de sterkte van de politieke overtuiging en de eventueel door de vreemdeling verrichte activiteiten om die overtuiging uit te dragen ertoe heeft geleid dat de vreemdeling de negatieve belangstelling van de autoriteiten van het land van herkomst heeft gewekt of kan wekken en wat de gevolgen daarvan zouden zijn. Deze beoordeling vindt plaats op basis van de individuele verklaringen van de vreemdeling in combinatie met de beschikbare algemene informatie over de situatie in het land van herkomst.
Verder betrekt de IND bij de beoordeling van de vrees welke door de gestelde politieke overtuiging gemotiveerde en aannemelijk bevonden activiteiten de vreemdeling bij terugkeer zou willen verrichten of hoe de vreemdeling anderszins zijn opvatting, mening of gedachte zou willen uiten, en wat de gevolgen daarvan zouden zijn.
De omstandigheid dat de vreemdeling in zijn land van herkomst niet op dezelfde wijze uiting kan geven aan zijn politieke overtuiging als in Nederland vormt onvoldoende aanleiding om de vreemdeling in het bezit te stellen van een verblijfsvergunning asiel op grond van artikel 29, eerste lid, Vw.
De IND weegt bij de beoordeling van de aanvraag om een verblijfsvergunning in ieder geval mee:
de sterkte van de politieke overtuiging van de vreemdeling;
de wijze waarop hij uiting heeft gegeven aan zijn politieke overtuiging, ongeacht of die activiteiten in zijn land van herkomst, in Nederland of elders hebben plaatsgevonden, en of aannemelijk is dat de vreemdeling ook na terugkeer uiting gaat of blijft geven aan zijn politieke overtuiging; en
of de vreemdeling eerder problemen heeft ondervonden van de zijde van de autoriteiten al dan niet vanwege zijn politieke overtuiging;
De IND beoordeelt, ook als er geen sprake is van een politieke overtuiging, of de door de vreemdeling in zijn land van herkomst, Nederland of elders verrichte politieke activiteiten of uitingen bij de autoriteiten bekend zijn geraakt of zullen geraken en daarmee vanwege een toegedichte politieke overtuiging voldoende aanleiding vormen om gegronde vrees voor vervolging bij terugkeer aan te nemen.
3.2.6 Discriminatie (in de zin van artikel 9 Kwalificatieverordening)
De IND merkt discriminatie van de vreemdeling door de autoriteiten en door medeburgers aan als daad van vervolging in de zin van artikel 9 Kwalificatieverordening, als de vreemdeling vanwege de discriminatie zo ernstig wordt beperkt in zijn bestaansmogelijkheden dat hij onmogelijk op maatschappelijk en sociaal gebied kan functioneren.
Discriminatie van de vreemdeling in het land van herkomst kan leiden tot uitsluiting van medische zorg. De IND verleent een verblijfsvergunning asiel op grond van artikel 29 eerste lid, Vw, op grond van uitsluiting van medische zorg, aan de vreemdeling die voldoet aan alle volgende voorwaarden:
de vreemdeling zal bij terugkeer naar het land van herkomst geheel of gedeeltelijke uitsluiting van medische zorg ondervinden;
de vreemdeling zal als gevolg van de uitsluiting van de medische zorg ernstige medische consequenties ondervinden; en
de uitsluiting van medische zorg vindt plaats op basis van één van de gronden van artikel 10 Kwalificatieverordening.
De IND beoordeelt de vraag of sprake is van ernstige medische consequenties aan de hand van de criteria in hoofdstuk B8 Vc. De IND betrekt bij de vraag of sprake is van uitsluiting van medische zorg op basis van één van de gronden van artikel 10 Kwalificatieverordening:
de omstandigheid dat de vreemdeling geen toegang heeft tot de medische zorg om andere redenen dan uitsluiting vanwege discriminatie; of
de beschikbaarheid van de behandelingsmogelijkheden in het land van herkomst.
3.2.7 Vervolging wegens dienstweigering of desertie (in de zin van artikel 9, tweede lid, aanhef en onder e, Kwalificatieverordening)
Als de vreemdeling stelt te vrezen te hebben voor vervolging wegens dienstweigering of desertie toetst de IND eerst of de vreemdeling dienst heeft geweigerd of is gedeserteerd omdat hij vreesde anders te moeten deelnemen aan oorlogsmisdrijven (zie artikel 9, tweede lid, aanhef en onder e, Kwalificatieverordening). Pas als daarvan geen sprake is, toetst de IND of dienstweigering of desertie leidt tot onevenredige of discriminatoire bestraffing dan wel of deze voortkomt uit onoverkomelijke gewetensbezwaren vanwege een godsdienst of andere diepgewortelde overtuiging. Het feit dat die vreemdeling weigert zijn militaire dienst te vervullen of is gedeserteerd en in verband hiermee bestraft wordt met een gevangenisstraf of ontslag uit het leger, is voor de IND op zichzelf onvoldoende om als daad van vervolging aan te merken.
De IND verleent, onder toepassing van artikel 9, tweede lid, aanhef en onder e, Kwalificatieverordening en overeenkomstig vorenstaande, een verblijfsvergunning asiel op grond van artikel 29, eerste lid, Vw aan de vreemdeling die zich beroept op dienstweigering of desertie, als de vreemdeling voldoet aan tenminste één van de volgende voorwaarden:
De vreemdeling heeft, overeenkomstig artikel 9, tweede lid, aanhef en onder e, Kwalificatieverordening aannemelijk gemaakt te vrezen voor vervolging of bestraffing wegens dienstweigering tijdens een conflict, wanneer het vervullen van militaire dienst het plegen van strafbare feiten of handelingen inhoudt die onder de uitsluitingsclausule van artikel 1F van het Vluchtelingenverdrag (artikel 12, tweede tot en met vijfde lid, Kwalificatieverordening) vallen. De IND betrekt bij de beoordeling van de aannemelijkheid alle omstandigheden van het geval, met name de situatie in het land van herkomst op het betreffende moment en de persoonlijke situatie van de vreemdeling. De IND hanteert hierbij de volgende drie cumulatieve voorwaarden:
De vreemdeling dient aannemelijk te maken dat sprake is van een gewapend conflict waarbij oorlogsmisdrijven worden begaan dan wel de kans zeer groot is dat dergelijke misdrijven worden begaan. De vreemdeling onderbouwt dit met concrete informatie over de gepleegde oorlogsmisdrijven. Is deze informatie er niet, dan neemt de IND in beginsel aan dat de kans groot is dat oorlogsmisdrijven worden gepleegd als de internationale gemeenschap een gewapend conflict heeft veroordeeld als strijdig met de grondbeginselen van humaan gedrag of als strijdig met de fundamentele normen die gelden tijdens een gewapend conflict. Ditzelfde geldt als door de bevoegde internationale rechtsprekende instanties (International Criminal Court, VN-tribunalen) uitspraken zijn gedaan over schendingen van fundamentele normen begaan tijdens het conflict. De vreemdeling heeft een zwaardere bewijslast om aannemelijk te maken dat er oorlogsmisdrijven worden gepleegd tijdens het gewapend conflict als het land van herkomst de betreffende militaire acties uitvoert krachtens een mandaat van de VN dan wel op basis van internationale consensus. Dan vindt de IND in beginsel niet aannemelijk dat het land van herkomst oorlogsmisdrijven pleegt dan wel dat de kans daarop groot is. De vreemdeling heeft ook een zwaardere bewijslast om aannemelijk te maken dat er oorlogsmisdrijven worden gepleegd tijdens het gewapend conflict als de autoriteiten in het land van herkomst oorlogsmisdrijven, gepleegd door eigen legeronderdelen, niet aanvaardbaar vinden en deze actief (strafrechtelijk) vervolgen.
De vreemdeling moet behoren tot het militaire personeel, met inbegrip van het logistieke of ondersteunende personeel. Hij dient aannemelijk te maken dat hij een functie en taken had of deze zou moeten vervullen, waardoor hij direct deelneemt aan deze oorlogsmisdrijven dan wel onontbeerlijke ondersteuning zou (moeten) bieden aan de voorbereiding of uitvoering van deze oorlogsmisdrijven. De IND betrekt de schaal waarop oorlogsmisdrijven worden begaan bij de vraag of het aannemelijk is dat de vreemdeling zich daaraan schuldig zal maken als een vreemdeling is opgeroepen voor het verrichten van militaire dienst, maar nog niet weet wat zijn taken zullen zijn. Daarnaast beoordeelt de IND in dit licht wat de persoonlijke betrokkenheid van de vreemdeling bij het begaan van oorlogsmisdrijven zal zijn.
De vreemdeling dient aannemelijk te maken dat dienstweigering (of desertie) in zijn situatie het enige middel is om deelname aan oorlogsmisdrijven te voorkomen. De vreemdeling kan bescherming op grond van artikel 9, tweede lid, aanhef en onder e, Kwalificatieverordening niet inroepen, als hij een ander middel daartoe heeft. Als de vreemdeling binnen het leger de mogelijkheid heeft om op grond van gewetensbezwaren vrijgesteld te worden, en hij daarvan geen gebruik heeft gemaakt, kan hij dus geen beroep doen op bescherming op grond van deze bepaling. Hierbij betrekt de IND ook of de vreemdeling vrijwillig in dienst is getreden en of hij zijn dienst heeft verlengd. Hierbij houdt de IND rekening met de situatie, zoals deze op het moment van vrijwillige dienstneming of verlenging van de dienstneming bestond. De IND betrekt dus in hoeverre het de vreemdeling toen al duidelijk was of had moeten zijn dat sprake was van een gewapend conflict, waarbij oorlogsmisdrijven werden gepleegd en hij door die vrijwillige dienstneming daar deel aan zou gaan nemen.
De vreemdeling heeft een gegronde vrees voor een onevenredige of discriminatoire bestraffing, tenuitvoerlegging van de straf, of een andere discriminatoire behandeling vanwege zijn dienstweigering of desertie op basis van een van de gronden van artikel 10 Kwalificatieverordening. Voor deze categorie geldt dat het gewone beleid van toepassing is, zoals hierboven in deze paragraaf uiteengezet is. De IND beoordeelt in zo’n geval de ernst van de behandeling, waarvoor de vreemdeling te vrezen heeft op grond van de dienstweigering of desertie (zie artikel 9, tweede lid, aanhef en onder b en c, Kwalificatieverordening).
De vreemdeling heeft ernstige, onoverkomelijke gewetensbezwaren vanwege zijn godsdienstige of andere diepgewortelde overtuiging, die geleid hebben tot zijn dienstweigering of desertie, terwijl er voor de vreemdeling geen mogelijkheid bestond om ter vervanging van zijn militaire dienst een niet-militaire dienstplicht te vervullen. Er is bovendien een reële kans dat het niet vervullen van de militaire dienstplicht leidt tot oplegging van een onevenredige zware (straf)maatregel of tot oplegging van een samenstel van verschillende maatregelen, die in samenhang kunnen worden aangemerkt als een onevenredige bestraffing. Dit geldt ook als de vreemdeling gegronde vrees heeft in een conflict te worden ingezet tegen zijn eigen volk of familie.
3.2.8 Als de UNHCR de vreemdeling heeft erkend als Verdragsvluchteling
De IND toetst alle aanvragen voor een verblijfsvergunning asiel individueel en op basis van het toepasselijke asielbeleid, ook als de vreemdeling eerder door de UNHCR op individuele gronden is erkend als Verdragsvluchteling.
De IND geeft de vreemdeling gelegenheid om informatie inzake de UNHCR erkenning gedurende de procedure in te brengen en betrekt deze informatie kenbaar bij de besluitvorming.
3.2.9 Commune delicten
De IND verleent geen verblijfsvergunning asiel op grond van artikel 29, eerste lid, of artikel 29a, eerste lid, Vw, indien alle volgende voorwaarden van toepassing zijn:
de vreemdeling vreest bestraffing in zijn land van herkomst vanwege een commuun delict;
de vrees voor bestraffing vanwege een commuun delict vormt de enige grondslag van de aanvraag van de vreemdeling om een verblijfsvergunning asiel.
Een commuun delict is een delict dat niet kan worden herleid tot één van de gronden van artikel 10 Kwalificatieverordening, en zonder dat daarbij sprake is van een onevenredige of discriminatoire maatregel vanwege een van de gronden van artikel 10 Kwalificatieverordening.
Het commune delict dient wel betrokken te worden bij de inhoudelijke beoordeling en de vraag of sprake is van een gevaar voor de openbare orde. Zie hiervoor paragraaf C4/3.6 Vc.
3.3 Verlening van de subsidiairebeschermingsstatus op grond van artikel 18 Kwalificatieverordening en verlening verblijfsvergunning asiel op grond van artikel 29a, eerste lid, Vw
3.3.1 Ernstige schade als bedoeld in artikel 15 Kwalificatieverordening
De IND verleent een verblijfsvergunning asiel op grond van artikel 29a, eerste lid, Vw als bij de verwijdering van de vreemdeling uit Nederland sprake is van een reëel risico op ernstige schade in de zin van artikel 15 Kwalificatieverordening.
Het reëel risico op ernstige schade kan aanwezig zijn op het moment van het vertrek van de vreemdeling uit het land van herkomst, maar kan ook ontstaan na vertrek van de vreemdeling uit het land van herkomst (zie artikel 5 Kwalificatieverordening en paragraaf C3/3.1.4 Vc).
De IND verleent geen verblijfsvergunning asiel op grond van artikel 29a, eerste lid, Vw, als artikel 17 Kwalificatieverordening van toepassing is.
In artikel 15 Kwalificatieverordening staat opgenomen, waar ernstige schade uit kan bestaan, namelijk:
doodstraf of executie;
folteringen, onmenselijke of vernederende behandelingen of bestraffingen; of
ernstige en individuele bedreiging van het leven of de persoon van een burger als gevolg van willekeurig geweld in het kader van een internationaal of binnenlands gewapend conflict.
Bij de beoordeling is het van belang dat eerst gekeken wordt naar alle relevante elementen die betrekking hebben op de individuele situatie en de algemene situatie in het land van herkomst, voordat wordt vastgesteld of het risico onder artikel 15, aanhef en onder a, b of c Kwalificatieverordening valt.
Voor het vaststellen van een reëel risico op ernstige schade op grond van artikel 15, aanhef en onder a en b, Kwalificatieverordening is een volledig individuele beoordeling vereist. Landeninformatie kan aanleiding geven om ten aanzien van een groep systematische blootstelling aan te nemen dan wel om groepen aan te merken als een risicoprofiel zoals in paragraaf C3/2.4 Vc is opgenomen.
Voor wat betreft het individualiseringsvereiste bij artikel 15, aanhef en onder c, Kwalificatieverordening wordt verwezen naar paragraaf C3/3.3.3 Vc.
In paragraaf C3/3.3.2 Vc staat ernstige schade beschreven als bedoeld in artikel 15, aanhef en onder a en b, Kwalificatieverordening. Daaronder staan beschreven de onderwerpen:
systematische blootstelling (paragraaf C3/3.3.2.1 Vc);
medische omstandigheden (paragraaf C3/3.3.2.2 Vc); en
terugkeerbeletsel (paragraaf C3/3.3.2.3 Vc).
In paragraaf C3/3.3.3 Vc staat ernstige schade beschreven als bedoeld in artikel 15, aanhef en onder c, Kwalificatieverordening.
3.3.2 Artikel 15, aanhef en onder a en b, Kwalificatieverordening
3.3.2.1 Systematische blootstelling
Als de vreemdeling behoort tot een groep die systematisch blootgesteld wordt aan een reëel risico op ernstige schade als bedoeld in artikel 15, aanhef en onder a en b, Kwalificatieverordening beperkt het individualiseringsvereiste zich tot het aannemelijk maken van het behoren tot de groep. Bij systematische blootstelling moet sprake zijn van gericht geweld tegen de betreffende groep.
De minister beoordeelt op grond van de situatie in een land van herkomst of sprake is van systematische blootstelling aan ernstige schade als bedoeld in artikel 15, aanhef en onder a en b, Kwalificatieverordening. In het landgebonden beleid kan worden opgenomen of er in een bepaald land ten aanzien van een groep sprake is van systematische blootstelling.
3.3.2.2 Medische omstandigheden
Uitzetting van de vreemdeling kan in verband met de medische situatie onder bijzondere omstandigheden leiden tot een schending van artikel 3 EVRM. De IND toetst of sprake is van schending van artikel 3 EVRM vanwege medische redenen in het kader van de ambtshalve toets of uitstel van vertrek verleend moet worden op grond van artikel 64 Vw.
Er zal in deze situatie geen verblijfsvergunning asiel op grond van artikel 29a, Vw verleend worden. Indien er geen ambtshalve toets plaatsvindt, maar het asielbesluit ook als terugkeerbesluit moet worden aangemerkt, toetst de IND – in het kader van dat terugkeerbesluit – eveneens of er sprake is van schending van artikel 3 EVRM vanwege medische redenen.
3.3.2.3 Terugkeerbeletsel
Als de IND een aanvraag om verblijfsvergunning asiel afwijst of een verblijfsvergunning asiel intrekt, kan er sprake zijn van een terugkeerbeletsel. De IND beoordeelt in de regel of sprake is van een situatie waarbij de vreemdeling bij terugkeer naar het land van herkomst:
risico loopt op vervolging, zoals bedoeld in artikel 29, eerste lid, Vw of;
reëel risico loopt op ernstige schade, zoals bedoeld in artikel 29a, eerste lid, Vw.
Als artikel 1F van het Vluchtelingenverdrag van toepassing is (artikel 12, tweede tot en met vijfde lid, Kwalificatieverordening) zal niet worden beoordeeld of er sprake is van risico op vervolging.
Als sprake is van één van bovengenoemde situaties of als er sprake is van schending van artikel 3 EVRM vanwege medische redenen en er is geen ander land waarnaar de vreemdeling kan terugkeren, neemt de IND geen terugkeerbesluit. De IND neemt dan in het besluit op dat de vreemdeling zelfstandig uit Nederland moet vertrekken, maar niet zal worden uitgezet naar het land van herkomst. De IND noemt in het besluit geen uiterste vertrektermijn.
Als vanwege een terugkeerbeletsel geen terugkeerbesluit en daarmee geen inreisverbod kan worden gegeven, beoordeelt de IND of een besluit tot signalering kan worden opgelegd. In paragraaf A4/4 Vc staan de voorwaarden vermeld om wegens een gevaar voor de openbare orde of de nationale veiligheid een besluit tot signalering op te leggen.
Als op een later moment wordt vastgesteld dat de vreemdeling niet langer te vrezen heeft voor vervolging of ernstige schade of dat artikel 3 EVRM zich niet meer verzet tegen uitzetting van de vreemdeling, neemt de IND een terugkeerbesluit en legt, als dat aan de orde is, een besluit tot signalering, een ongewenstverklaring en/of inreisverbod op. De IND maakt dit besluit kenbaar aan de vreemdeling. Hiertegen kan de vreemdeling rechtsmiddelen aanwenden.
3.3.3 Artikel 15, aanhef en onder c, Kwalificatieverordening
3.3.3.1 Algemeen
De IND kan een verblijfsvergunning asiel verlenen op grond van artikel 29a, eerste lid, Vw als sprake is van een reëel risico op ernstige schade vanwege artikel 15, aanhef en onder c, Kwalificatieverordening.
3.3.3.2 Internationaal of binnenlands gewapend conflict en willekeurig geweld
De minister kan op basis van de beschikbare landeninformatie vaststellen of in een bepaald land of gebied sprake is van willekeurig geweld in het kader van een internationaal of binnenlands gewapend conflict. Er is sprake van een internationaal of binnenlands gewapend conflict, als de reguliere strijdkrachten van een staat tegenover een of meer gewapende groepen staan of wanneer twee of meer gewapende groepen tegenover elkaar staan.
Als de minister heeft vastgesteld dat er sprake is van een internationaal of binnenlands gewapend conflict in de zin van artikel 15, aanhef en onder c, Kwalificatieverordening, stelt de minister op basis van de beschikbare landeninformatie vast of dit conflict leidt tot willekeurig geweld en als er sprake is van willekeurig geweld op welke schaal dit willekeurig geweld plaatsvindt.
Bij de beoordeling van de intensiteit van het willekeurig geweld, worden in ieder geval de volgende elementen globaal in samenhang gewogen:
de vraag of partijen bij het conflict oorlogsmethoden hanteren die de kans op burgerslachtoffers vergroten of burgers als doel nemen;
de vraag of het gebruik van die methoden wijdverbreid is bij de strijdende partijen;
de vraag of het geweld wijdverbreid is of plaatselijk;
de vraag of er een veiligheidsstructuur aanwezig is;
de intensiteit van de gewapende confrontaties en het organisatieniveau van de betrokken strijdkrachten; en
de aantallen doden, gewonden en ontheemden onder de burgerbevolking ten gevolge van de strijd.
Andere (belangrijke) indicatoren die erop wijzen dat willekeurig geweld als gevolg van het gewapend conflict resulteert in ernstige en individuele bedreigingen tegen burgers, kunnen worden betrokken bij de beoordeling of er sprake is van een reëel risico op ernstige schade.
Humanitaire omstandigheden die het directe of het indirecte gevolg zijn van het handelen en/of het nalaten van een actor van ernstige schade die partij is bij een gewapend conflict moeten als relevante omstandigheid in deze globale beoordeling worden betrokken. Slechte humanitaire omstandigheden als gevolg van het klimaat en natuurlijke fenomenen, zoals droogte en overstromingen, zijn in dit kader niet relevant.
3.3.3.3 Gradaties van willekeurig geweld als gevolg van een internationaal of binnenlands gewapend conflict
De minister kan bij zijn beoordeling gradaties van willekeurig geweld vaststellen:
uitzonderlijk niveau van willekeurig geweld;
relatief hoger niveau van willekeurig geweld; of
relatief lager niveau van willekeurig geweld.
Los van deze gradaties bestaat de situatie, waarin er geen beoordeling in de zin van artikel 15, aanhef en onder c, Kwalificatieverordening plaatsvindt, omdat er geen gewapend conflict is of er geen willekeurig geweld is als gevolg van een gewapend conflict. In dat geval kan de vreemdeling alleen daarom al niet op deze grond in aanmerking komen voor een verblijfsvergunning als bedoeld in artikel 29a, eerste lid Vw.
Ad a. Uitzonderlijk niveau van willekeurig geweld
Er is sprake van een uitzonderlijke mate van willekeurig geweld als de algehele geweldssituatie in het kader van een internationaal of binnenlands gewapend conflict in het land van herkomst of in een bepaald gebied in dit land zodanig is dat wordt aangenomen dat een vreemdeling enkel en alleen al door zijn aanwezigheid op dat grondgebied een reëel risico loopt op een ernstige en individuele bedreiging van zijn leven of persoon. Het individualiseringsvereiste van de vreemdeling beperkt zich in deze gevallen tot het afkomstig zijn uit het land of bepaald gebied, waar sprake is van deze uitzonderlijke mate van willekeurig geweld.
Ad b en c Relatief hoger niveau en relatief lager niveau van willekeurig geweld
Als er is sprake van een relatief hoger niveau of een relatief lager niveau van willekeurig geweld, dan is de enkele aanwezigheid van de vreemdeling in het betreffende gebied op zichzelf niet meer voldoende om een reëel risico op ernstige schade aan te nemen.
De vreemdeling moet in dat geval aan de hand van zijn individuele situatie en persoonlijke omstandigheden aannemelijk maken dat:
deze omstandigheden leiden tot een verhoogd risico om slachtoffer te worden van willekeurig geweld; en
juist de vreemdeling specifiek vanwege deze omstandigheden een reëel risico loopt om slachtoffer te worden van willekeurig geweld.
Deze omstandigheden kunnen met name zien op het privé, beroeps- of familieleven. Dit betekent overigens niet dat alleen al door de aanwezigheid van risico verhogende factoren een reëel risico op ernstige schade aannemelijk is.
Naarmate het niveau van willekeurig geweld lager is, zullen er relatief gewichtigere individuele omstandigheden vereist zijn om een reëel risico aan te nemen. Bij een relatief lager niveau van willekeurig geweld, zullen de door de vreemdeling naar voren gebrachte risico verhogende omstandigheden daarom meer gewicht moeten hebben om een reëel risico aan te kunnen nemen.
Nadat een vreemdeling zijn persoonlijke kenmerken en individuele omstandigheden naar voren heeft gebracht en waar nodig aannemelijk heeft gemaakt, beoordeelt de IND die omstandigheden in het licht van de veiligheidssituatie in het gebied waar de vreemdeling vandaan komt.
Dat betekent dat pas na het naar voren brengen door de vreemdeling van de relevante elementen die betrekking hebben op de individuele situatie en de algemene situatie in het land van herkomst, door de IND wordt vastgesteld dat het risico mogelijk onder artikel 15, aanhef en onder c, Kwalificatieverordening valt.
Daarbij maakt de IND een gemotiveerde beoordeling en betrekt of de vreemdeling aannemelijk heeft gemaakt dat de relevante elementen ook daadwerkelijk zorgen voor een verhoogd risico op ernstige schade én dat juist de vreemdeling als gevolg van deze omstandigheden een reëel risico loopt slachtoffer te worden van willekeurig geweld.
Bij de beoordeling van het risico bij terugkeer kan de IND, afhankelijk van het individuele geval, meewegen of de vreemdeling bij terugkeer schade kan ontlopen.
Hulpmiddel
De hiervoor geschetste gradaties zijn enkel bedoeld als indicatief hulpmiddel voor de IND. Deze gradaties geven in grote lijnen aan, hoe de situatie van willekeurig geweld in een (deel van een) land van herkomst wordt ingeschat. Het voor de diverse landen beleidsmatig vaststellen van de gradatie van het geweld heeft daarmee ten doel er voor te zorgen dat de IND op uniforme wijze het in een land heersende geweldsniveau bij de beoordeling betrekt. Bij die beoordeling staan echter de door de vreemdeling aangevoerde individuele omstandigheden voorop bij de vraag of aannemelijk is gemaakt dat die omstandigheden het risico verhogen slachtoffer te worden van willekeurig geweld.
Eerder ondervonden ernstige schade
Daarnaast moet de IND meewegen dat de vreemdeling vóór zijn vertrek uit zijn land eerder al geweld heeft ondervonden (zie ook artikel 4, vierde lid, Kwalificatieverordening). Daarbij doet het niet ter zake of het eerder ondervonden geweld het gevolg was van willekeurig geweld of van gericht geweld. De IND beoordeelt in dit verband of het eerder ondervonden geweld in combinatie met de individuele situatie en persoonlijke omstandigheden van een vreemdeling en in het licht van de veiligheidssituatie, tot een verhoogd risico op willekeurig geweld kan leiden.
Landenbeleid
In het landgebonden beleid in hoofdstuk C10 Vc kan worden vastgesteld of een van de gradaties aan de orde is in het betreffende land of gebied.
3.4 Actoren van bescherming en beschermingsalternatief
3.4.1 Actoren van bescherming
3.4.1.1 Bescherming door autoriteiten
Artikel 7 Kwalificatieverordening beschrijft wat wordt verstaan onder actoren van bescherming. De IND verleent geen verblijfsvergunning asiel op grond van artikel 29 of 29a Vw, als actoren van bescherming aan de vreemdeling bescherming kunnen en willen bieden.
De IND gaat ervan uit dat bescherming van de vreemdeling door de autoriteiten in het land van herkomst zoals bedoeld in artikel 7, eerste lid, aanhef en onder a, Kwalificatieverordening niet mogelijk is, als de dreiging voor de vreemdeling afkomstig is van de autoriteiten in het land van herkomst. Er zijn twee uitzonderingen op deze hoofdregel:
de dreiging voor de vreemdeling is afkomstig van een persoon of een groep die onderdeel uitmaakt van de autoriteiten, maar een meerdere van die persoon of groep kan en wil tegen de persoon of groep die de dreiging veroorzaakt optreden. In dat geval moet de vreemdeling de bescherming van die meerdere zoeken; of
de dreiging voor de vreemdeling is afkomstig van lokale autoriteiten, maar de centrale autoriteiten willen en kunnen bescherming bieden. In dat geval verwacht de IND dat de vreemdeling bescherming zoekt bij de centrale autoriteit.
In beide uitzonderingssituaties constateert de IND dat bescherming van de vreemdeling door de autoriteiten in het land van herkomst mogelijk is.
3.4.1.2 Bescherming door stabiele, gevestigde niet-overheidsinstanties
De IND beschouwt in ieder geval de volgende organisaties als stabiele, gevestigde niet-overheidsinstanties, waaronder inbegrepen internationale organisaties in de zin van artikel 7, eerste lid, aanhef en onder b, Kwalificatieverordening:
VN; en
NAVO.
3.4.1.3 Bescherming doeltreffend en niet-tijdelijk van aard (artikel 7, tweede lid, Kwalificatieverordening)
De IND beschouwt de bescherming van de vreemdeling als bedoeld in artikel 7, eerste lid, Kwalificatieverordening in ieder geval van niet-tijdelijke aard, als er geen concrete aanwijzingen zijn dat de doeltreffende bescherming van de vreemdeling tegen vervolging of ernstige schade door de autoriteiten en/of stabiele, gevestigde niet-overheidsinstanties binnen de voorzienbare toekomst zal eindigen.
Artikel 7, tweede lid, Kwalificatieverordening geeft aan dat actoren van bescherming redelijke maatregelen moeten treffen tot voorkoming van vervolging of het lijden van ernstige schade. De actor van bescherming hoeft geen volledige en sluitende garantie te bieden tegen dreigende vervolging of ernstige schade. De vreemdeling moet toegang tot deze bescherming hebben.
3.4.1.4 Bewijslast
De IND onderzoekt eerst of bescherming in zijn algemeenheid mogelijk is. De IND maakt hierbij gebruik van algemene informatie uit objectieve bron over het land van herkomst (zie ook artikel 7, tweede en derde lid, Kwalificatieverordening).
Als de IND heeft vastgesteld dat bescherming mogelijk is, is het vervolgens aan de vreemdeling om aannemelijk te maken dat een verzoek om bescherming bij de actoren van bescherming in zijn individuele geval bij voorbaat zinloos of zelfs gevaarlijk moet worden geacht. Als de vreemdeling dat laatste niet aannemelijk maakt, kan slechts het tevergeefs door hem inroepen van de bescherming leiden tot de conclusie dat aannemelijk is gemaakt dat die autoriteiten niet bereid of in staat zijn bescherming te bieden.
De IND betrekt bij de beoordeling of de actoren van bescherming in het land van herkomst in staat en bereid zijn effectieve bescherming te bieden in ieder geval:
de individuele verklaringen van de vreemdeling, waaronder de verklaring dat geen bescherming wordt geboden;
de omstandigheid dat de vreemdeling aannemelijk heeft gemaakt dat hij tevergeefs de bescherming van de actoren van bescherming heeft ingeroepen; en
informatie over de algemene situatie in het land van herkomst aan de hand van ambtsberichten van de Minister van Buitenlandse Zaken en rapporten van internationale organisaties (zie ook artikel 7, tweede en derde lid, Kwalificatieverordening).
3.4.2 Binnenlands beschermingsalternatief
Artikel 8 Kwalificatieverordening regelt wat wordt verstaan onder een binnenlands beschermingsalternatief.
De IND verleent geen verblijfsvergunning asiel op grond van artikel 29 of 29a, Vw, als de IND tot de conclusie komt dat een binnenlands beschermingsalternatief als bedoeld in artikel 8, eerste lid, Kwalificatieverordening voor de vreemdeling beschikbaar is.
Op grond van artikel 8, derde lid, Kwalificatieverordening komt de IND pas toe aan de vraag of sprake is van een binnenlands beschermingsalternatief als vastgesteld is dat er sprake is van gegronde vrees voor vervolging of een reëel risico op ernstige schade. In dat geval moet de IND onderzoeken en aannemelijk maken dat een vreemdeling geen internationale bescherming nodig heeft vanwege het bestaan van een binnenlands beschermingsalternatief. In beginsel wordt een binnenlands beschermingsalternatief niet geacht te bestaan als de staat of staatsfunctionarissen de actoren van vervolging of ernstige schade zijn. Daarop kan een uitzondering worden gemaakt als duidelijk vaststaat dat de bevoegdheid van de betreffende actor duidelijk beperkt is tot een specifiek geografisch gebied of wanneer de staat zelf slechts controle heeft over bepaalde delen van het land.
Als de IND tot de conclusie komt dat een binnenlands beschermingsalternatief beschikbaar is, dan krijgt de vreemdeling de mogelijkheid om bewijzen en elementen te overleggen, waaruit blijkt dat het binnenlands beschermingsalternatief voor hem niet beschikbaar is. Als de vreemdeling hier tijdens het gehoor niet op bevraagd is en niet de gelegenheid heeft gekregen bewijs over aan te leveren, zal de vreemdeling alsnog die mogelijkheid geboden moeten worden. De IND houdt bij de beslissing op het verzoek om internationale bescherming rekening met de door de vreemdeling overgelegde bewijzen en elementen.
Bij het onderzoek naar het bestaan van een binnenlandse beschermingsalternatief, beoordeelt de IND of de vreemdeling zich kan vestigen in een ander deel van het land, dan waar hij vervolging vreest of een reëel risico loopt op ernstig lijden.
Naast het vereiste dat de dreiging in een ander deel van het land niet mag bestaan, is het ook van belang dat de vreemdeling in het andere deel van het land geen nieuwe dreiging zal ondervinden. Als het aannemelijk is dat de vreemdeling in het andere gebied ook heeft te vrezen voor vervolging of voor daden als bedoeld in artikel 29 of 29a Vw dan beoordeelt de IND of de vreemdeling bescherming kan inroepen tegen de dreiging in dat gebied (zie paragraaf C3/3.4.1 Vc).
Uit artikel 8, eerste lid, Kwalificatieverordening volgt dat de vreemdeling op een veilige en wettige manier moet kunnen reizen naar en zich toegang moet kunnen verschaffen tot het gebied waar hij wordt geacht binnenlandse bescherming in te kunnen roepen.
De bescherming die de vreemdeling in het gebied krijgt, hoeft niet dezelfde te zijn als de bescherming die de vreemdeling in Nederland zou hebben gekregen.
Bij de beoordeling van het bestaan van een beschermingsalternatief betrekt de IND in ieder geval:
of de vreemdeling zich in het gebied kan vestigen en een leven kan leiden onder omstandigheden, die naar plaatselijke maatstaven gemeten als normaal zijn aan te merken;
of de vreemdeling in het betreffende gebied niet achtergesteld wordt in de uitoefening van essentiële rechten ten opzichte van de overige bevolking;
of de levensomstandigheden in het betreffende gebied in zijn algemeenheid niet zodanig zijn dat dit op zichzelf al kan leiden tot een humanitaire noodsituatie;
de persoonlijke omstandigheden van de vreemdeling wat betreft factoren zoals gezondheid, leeftijd, gender, inclusief genderidentiteit, seksuele gerichtheid, etnische afkomst en het behoren tot een nationale minderheid; en
of de vreemdeling in zijn eigen basisbehoeften zou kunnen voorzien.
Dat de omstandigheden in het gebied minder gunstig zijn dan in het oorspronkelijke woongebied van de vreemdeling is voor de IND onvoldoende reden om geen binnenlands beschermingsalternatief tegen te werpen.
De IND beoordeelt gelet op artikel 8, vierde lid Kwalificatieverordening aan de hand van de over het land van herkomst beschikbare nauwkeurige en actuele informatie uit relevante bronnen of een binnenlands beschermingsalternatief in de individuele zaak van de vreemdeling aanwezig is.
In het landgebonden asielbeleid kan de minister het bestaan van een binnenlands beschermingsalternatief op basis van de beschikbare nauwkeurige en actuele informatie uit relevante bronnen met inachtneming van de genoemde voorwaarden van tevoren vaststellen dan wel uitsluiten.
3.5 Terugkeer naar het land van herkomst
De IND verleent in beginsel geen verblijfsvergunning asiel op grond van artikel 29 of 29a Vw als er concrete aanwijzingen bestaan dat de vreemdeling na indiening van zijn verzoek om internationale bescherming naar het land van herkomst terug is geweest.
