2.1 General
If the foreign national indicates a desire to lodge an application for asylum (Article 26 Procedures Regulation), the registration and lodging of the application for asylum shall follow (Articles 27 and 28 Procedures Regulation). Depending on where the foreign national has reported and whether the Screening Regulation is applicable, one of the procedures described below shall follow.
2.2 Asylum application on the territory and Screening Regulation is applicable
If the foreign national is present on the territory and falls under the Screening Regulation, the registration process in the ‘Reception and Preparation of Asylum Application’ phase (hereinafter: the OVA-phase) shall be followed as described in paragraph A6/1 Vc. The foreign national shall lodge the asylum application with an IND official immediately following this OVA-phase. The Ter Apel application centre has been designated as a screening location within the meaning of Article 8, paragraph 1, of the Screening Regulation. The registration and lodging of the asylum application (Articles 27 and 28 of the Procedures Regulation) shall take place consecutively.
After signing the asylum application, the foreign national shall receive (a copy of) the following documents:
the signed asylum application;
an acknowledgement of receipt of the submitted documents (if applicable);
the imposed instruction to be available as referred to in Article 55 of the Aliens Act (Vreemdelingenwet) (Model M117-C);
leaflets providing information; and
return of the original documents found to be authentic (if applicable).
2.3 Foreign national who does not fall under the scope of the Screening Regulation
Pursuant to Article 9, paragraph 2, introductory words and under (a) of the Procedures Regulation, a foreign national who does not fall under the scope of the Screening Regulation shall provide the information as referred to in Article 27, paragraph 1 of the Procedures Regulation. This information is collected during the OVA-phase.
The IND shall perform the following acts in the context of the registration and the filing of the asylum application:
identification and verification of the identity of the applicant;
registration of biometric data; and
safety check
Paragraph A6/4.3 of the Aliens Circular (Vreemdelingencirculaire) shall apply mutatis mutandis to these parts.
The foreign national signs the asylum application in the presence of an IND official.
After signing the asylum application, the foreign national shall receive (a copy of) the following documents:
the signed asylum application;
an acknowledgement of receipt of the submitted documents (if applicable);
the imposed instruction to be available as referred to in Article 55 of the Aliens Act (Vreemdelingenwet) (Model M117-C);
folders containing information provision; and
return of the original documents found to be authentic (if applicable).
2.4 Other asylum application
By way of derogation from the rules regarding the submission of an asylum application as described in paragraphs C1/2.2 and 2.3 of the Aliens Circular (Vreemdelingencirculaire), separate policy rules apply to the foreign national:
who has indicated at the external border the intention to lodge an application and in respect of whom the decision regarding the refusal of entry has been postponed (see paragraphs C1/3.1 and C2/2 Vc); or
who wishes to lodge a second or subsequent asylum application (see paragraph C2/5 Vc); or
who wishes to submit a last-minute application (see paragraph C2/5.4 Vc); or
who submits an application from within administrative detention for foreign nationals (see paragraphs C1/3.4 and C2/4 Vc); or
who submits an application from within the criminal justice chain (VRIS) (see paragraph C1/3.5 Vc).
The IND classifies the application for an asylum residence permit which is submitted at a time or location other than that designated by the IND, or in a manner other than that described above, as an incomplete application. An incomplete application does not cause the time limits of the asylum procedure to commence (see Article 35 of the Procedures Regulation).
2.1 Algemeen
Als de vreemdeling te kennen geeft een asielaanvraag in te willen dienen (artikel 26 Procedureverordening) volgt de registratie en indiening van de asielaanvraag (artikel 27 en 28 Procedureverordening). Afhankelijk van waar de vreemdeling zich heeft gemeld en of de Screeningsverordening van toepassing is, volgt een van de hieronder beschreven procedures.
2.2 Asielaanvraag op het grondgebied en Screeningsverordening is van toepassing
Als de vreemdeling zich op het grondgebied bevindt en onder de Screeningsverordening valt, wordt het registratieproces in fase ‘Ontvangst en Voorbereiden Asielaanvraag’ (verder: de OVA-fase) gevolgd zoals beschreven in paragraaf A6/1 Vc. De vreemdeling dient de asielaanvraag direct aansluitend op deze OVA-fase in bij een IND-medewerker. Het aanmeldcentrum Ter Apel is aangewezen als screeningslocatie in de zin van artikel 8 lid 1 Screeningsverordening. De registratie en indiening van de asielaanvraag (artikel 27 en 28 Procedureverordening) vinden aansluitend op elkaar plaats.
Na het ondertekenen van de asielaanvraag ontvangt de vreemdeling (een kopie van) de volgende documenten:
de ondertekende asielaanvraag;
een ontvangstbevestiging van de ingeleverde documenten (indien van toepassing);
de opgelegde aanwijzing om beschikbaar te zijn als bedoeld in artikel 55 Vw (Model M117-C);
folders met informatievoorziening; en
retour van de echt bevonden brondocumenten (indien van toepassing).
2.3 Vreemdeling die niet onder de werking van de Screeningsverordening valt
Op grond van artikel 9, tweede lid, aanhef en onder a Procedureverordening verschaft de vreemdeling die niet onder de werking van de Screeningsverordening valt, de informatie als bedoeld in artikel 27, eerste lid Procedureverordening. Deze informatie wordt opgehaald tijdens de OVA-fase.
De IND zal in het kader van de registratie en de indiening van de asielaanvraag de volgende handelingen uitvoeren:
identificatie en verificatie van de identiteit van de aanvrager;
registratie van biometrische gegevens; en
veiligheidscontrole
De paragraaf A6/4.3 Vc zijn op deze onderdelen van overeenkomstige toepassing.
De vreemdeling ondertekent de asielaanvraag in aanwezigheid van een IND-medewerker.
Na het ondertekenen van de asielaanvraag ontvangt de vreemdeling (een kopie van) de volgende documenten:
de ondertekende asielaanvraag;
een ontvangstbevestiging van de ingeleverde documenten (indien van toepassing);
de opgelegde aanwijzing om beschikbaar te zijn als bedoeld in artikel 55 Vw (Model M117-C);
folders met informatievoorziening; en
retour van de echt bevonden brondocumenten (indien van toepassing).
2.4 Asielaanvraag overig
In afwijking van de regels over het indienen van een asielaanvraag zoals beschreven in de paragrafen C1/2.2 en 2.3 Vc gelden aparte beleidsregels voor de vreemdeling:
die aan de buitengrens heeft aangegeven een aanvraag te willen indienen en aan wie het besluit omtrent de toegangsweigering is uitgesteld (zie paragrafen C1/3.1 en C2/2 Vc); of
die een tweede of volgende asielaanvraag wil indienen (zie paragraaf C2/5 Vc); of
die een lastminuteaanvraag wil indienen (zie paragraaf C2/5.4 Vc); of
die vanuit vreemdelingenbewaring een aanvraag indient (zie paragrafen C1/3.4 en C2/4 Vc); of
die vanuit de strafrechtketen (VRIS) een aanvraag indient (zie paragraaf C1/3.5 Vc).
De IND merkt de aanvraag voor een verblijfsvergunning asiel die op een ander dan het door de IND aangewezen moment of locatie of op een andere dan de hierboven beschreven wijze wordt ingediend, aan als een onvolledige aanvraag. Een onvolledige aanvraag doet de termijnen van de asielprocedure niet aanvangen (zie artikel 35 ProcedureVerordening).
