Pursuant to Article 3.51, paragraph 4, of the Aliens Decree (Vreemdelingenbesluit) in conjunction with Article 3.24aa, paragraph 2, opening words and under (k), of the Aliens Act Implementation Guidelines (Voorschrift Vreemdelingen), the IND shall grant a residence permit to the foreign national if:
The foreign national is still admitted to the witness protection programme of the National Unit of the Police; and
The foreign national still satisfies the general conditions for admission of Article 16, first paragraph of the Aliens Act (Vreemdelingenwet), with the exception of subcategories c and k.
Op grond van artikel 3.51, vierde lid, Vb jo artikel 3.24aa, tweede lid, aanhef en onder k, VV verleent de IND een verblijfsvergunning aan de vreemdeling als:
De vreemdeling nog immer is opgenomen in het getuigenbeschermingsprogramma van de Politie Landelijke eenheid; en
De vreemdeling nog immer voldoet aan de algemene toelatingsvoorwaarden van artikel 16, eerste lid Vw, met uitzondering van de subcategorie c en k.
