4.1 General provisions
The IND considers a valid document for border crossing as evidence from which it must appear that the foreign national meets the age requirement as referred to in Article 3.43, paragraph 1, opening words and under (b), of the Aliens Decree (Vreemdelingenbesluit) and Article 3.24, paragraph 1, of the Aliens Regulation (Voorschrift Vreemdelingen).
The IND considers an extract from the BRP, demonstrating that the foreign national is registered at the same address as the host family and demonstrating the family composition, as evidence that the foreign national is residing in a host family consisting of at least two persons.
4.2 WHS/WHP
The IND considers as evidence, from which it must appear that the timely departure of the foreign national from the Netherlands as referred to in Article 3.43, paragraph 1, opening words and under (d), of the Aliens Decree (Vreemdelingenbesluit) is guaranteed:
a return ticket; or
evidence demonstrating that the foreign national possesses means of support to purchase a return ticket.
4.3 Au pair
Exchange programme
Reference is made to Article 1.14, subparagraph b, of the Aliens Decree (Vreemdelingenbesluit) and paragraphs B2/2.2 and B2/2.3 of the Aliens Act Implementation Guidelines (Vreemdelingencirculaire). The au pair who wishes to reside in the Netherlands in the context of cultural exchange shall be represented by a private exchange organisation recognised as a sponsor.
The private exchange organisation recognised as a sponsor must have an exchange programme approved by the IND. The exchange programme to be assessed by the IND and the application for a residence permit for cultural exchange shall be submitted on behalf of the au pair by a private exchange organisation recognised as a sponsor.
The exchange programme applies to all foreign nationals for whom the exchange organisation, recognised as a sponsor (referent), applies for residence in the Netherlands. If the exchange organisation recognised as a sponsor (referent) wishes to amend the exchange programme, the exchange programme must be re-approved by the IND.
Schedule of the day
The IND considers the daily schedule for light household duties, agreed upon and signed between the host family and the foreign national, as evidence intended to demonstrate that the foreign national meets the condition as referred to in Article 3.24, third paragraph, opening words and under (d), of the Aliens Regulation (Voorschrift Vreemdelingen). A daily schedule must be drawn up for all seven days of the week. The daily schedule must be signed by the host family and the foreign national. The daily schedule shall include at a minimum:
how many hours per day the foreign national will perform light household duties;
what activities the foreign national will perform;
which days the foreign national is free; and
who acts or act as an alternative for the performance of light household activities.
The daily schedule is only valid during the stay of the foreign national in the Netherlands.
4.4 Private exchange organisations
Exchange programme
Reference is made to Article 1.14, subparagraph b, of the Aliens Decree (Vreemdelingenbesluit) and paragraphs B2/2.2 and B2/2.3 of the Aliens Act Implementation Guidelines (Vreemdelingencirculaire). The private exchange organisation recognised as a sponsor must have an exchange programme approved by the IND. The exchange programme to be assessed by the IND and the application for a residence permit for cultural exchange shall be submitted by a private exchange organisation recognised as a sponsor.
The exchange programme applies to all foreign nationals for whom the exchange organisation, recognised as a sponsor, applies for residence in the Netherlands. If the exchange organisation recognised as a sponsor wishes to amend the exchange programme, the exchange programme must be approved anew by the IND.
4.5 European Voluntary Service
The IND considers an agreement signed by the exchange organisation and the foreign national as evidence which must demonstrate that the foreign national satisfies the condition as referred to in Article 3.43, fourth paragraph, of the Aliens Decree (Vreemdelingenbesluit). The agreement must include the components from Article 3.24, fifth paragraph, of the Aliens Regulation (Voorschrift Vreemdelingen).
4.6 Au pair
4.1 Algemeen
De IND beschouwt een geldig document voor grensoverschrijding als bewijsmiddel waaruit moet blijken dat de vreemdeling voldoet aan de leeftijdseis als bedoeld in artikel 3.43, eerste lid, aanhef en onder b, Vb en artikel 3.24, eerste lid, VV.
De IND beschouwt een afschrift uit de BRP waaruit blijkt dat de vreemdeling staat ingeschreven op hetzelfde adres als het gastgezin en waaruit de gezinssamenstelling blijkt als bewijsmiddel dat de vreemdeling in een gastgezin verblijft bestaande uit ten minste twee personen.
4.2 WHS/WHP
De IND beschouwt als bewijsmiddel, waaruit moet blijken dat het tijdige vertrek van de vreemdeling uit Nederland als bedoeld in artikel 3.43, eerste lid, aanhef en onder d, Vb is gewaarborgd:
een retourticket; of
bewijsmiddelen waaruit blijkt dat de vreemdeling over middelen van bestaan beschikt om een retourticket aan te schaffen.
4.3 Au pair
Uitwisselingsprogramma
Verwezen wordt naar artikel 1.14, sub b, Vb en de paragrafen B2/2.2 en B2/2.3 Vc. De au pair die in het kader van culturele uitwisseling in Nederland wenst te verblijven laat zich door een als referent erkende particuliere uitwisselingsorganisatie vertegenwoordigen.
De als referent erkende particuliere uitwisselingsorganisatie moet over een door de IND goedgekeurd uitwisselingsprogramma beschikken. Het door de IND te beoordelen uitwisselingsprogramma en de aanvraag voor een verblijfsvergunning culturele uitwisseling wordt in naam van de au pair door een als referent erkende particuliere uitwisselingsorganisatie ingediend.
Het uitwisselingsprogramma geldt voor alle vreemdelingen voor wie de als referent erkende uitwisselingsorganisatie verblijf in Nederland aanvraagt. Als de als referent erkende uitwisselingsorganisatie het uitwisselingsprogramma wenst aan te passen, moet het uitwisselingsprogramma opnieuw goedgekeurd worden door de IND.
Dagindeling
De IND beschouwt de tussen het gastgezin en de vreemdeling overeengekomen en ondertekende dagindeling voor de lichte huishoudelijke werkzaamheden als bewijsmiddel waaruit moet blijken dat de vreemdeling voldoet aan de voorwaarde zoals bedoeld in artikel 3.24, derde lid, aanhef en onder d, VV. Voor alle zeven dagen van de week dient een dagindeling te worden opgesteld. De dagindeling moet door het gastgezin en de vreemdeling zijn ondertekend. In de dagindeling wordt minimaal opgenomen:
hoeveel uur per dag de vreemdeling lichte huishoudelijke werkzaamheden gaat verrichten;
welke werkzaamheden de vreemdeling gaat verrichten;
welke dagen de vreemdeling vrij is; en
wie er als alternatief fungeert of fungeren voor het verrichten van lichte huishoudelijke werkzaamheden.
De dagindeling is alleen geldig gedurende het verblijf van de vreemdeling in Nederland.
4.4 Particuliere uitwisselingsorganisaties
Uitwisselingsprogramma
Verwezen wordt naar artikel 1.14, sub b, Vb en de paragrafen B2/2.2 en B2/2.3 Vc. De als referent erkende particuliere uitwisselingsorganisatie moet over een door de IND goedgekeurd uitwisselingsprogramma beschikken. Het door de IND te beoordelen uitwisselingsprogramma en de aanvraag voor een verblijfsvergunning culturele uitwisseling wordt door een als referent erkende particuliere uitwisselingsorganisatie ingediend.

4.5 Europees vrijwilligerswerk
De IND beschouwt een door de uitwisselingsorganisatie en de vreemdeling ondertekende overeenkomst als bewijsmiddel waaruit moet blijken dat de vreemdeling voldoet aan de voorwaarde als bedoeld in artikel 3.43, vierde lid, Vb. In de overeenkomst moeten de onderdelen uit artikel 3.24, vijfde lid, VV zijn opgenomen.
