1).

The countries of the Union undertake to accept for filing and to protect collective marks belonging to associations the existence of which is not contrary to the law of the country of origin, even if such associations do not possess an industrial or commercial establishment.

2).

Each country shall be free to prescribe the special conditions under which a collective mark shall be protected, and it may refuse protection if this mark is contrary to the public interest.

3).

In the meantime, the protection of these marks shall not be refused to a community, the existence of which is not contrary to the law of the country of origin, on the ground that it is not established in the country where protection is claimed, or that it is not constituted according to the legislation of that country.

De landen der Unie verbinden zich tot het depot toe te laten en te beschermen de collectieve merken, die aan gemeenschappen toebehoren, welker bestaan niet strijdig is met de wet van het land van oorsprong, zelfs al bezitten die gemeenschappen niet een inrichting van nijverheid of handel.

2).

Elk land zal vrij zijn in het stellen van bijzondere voorwaarden waaronder een collectief merk zal worden beschermd, en het zal de bescherming kunnen weigeren, indien dit merk strijdig is met het algemeen belang.

3).

Intussen zal de bescherming van deze merken niet kunnen worden geweigerd aan een gemeenschap, welker bestaan niet strijdig is met de wet van het land van oorsprong, op grond van het feit, dat zij niet gevestigd is in het land, waar de bescherming wordt gevraagd, of dat zij niet is opgericht overeenkomstig de wetgeving van dit land.
