Article 6ter
in forceThe countries of the Union agree to refuse or to invalidate the registration, and to prohibit by appropriate measures the use, without authorization by the competent authorities, either as trademarks or as elements of such trademarks, of armorial bearings, flags, and other State emblems of the countries of the Union, official signs and hallmarks indicating control and warranty adopted by them, as well as any imitation from a heraldic point of view.
The provisions contained above under letter (a) shall likewise apply to armorial bearings, flags and other emblems, initials or names of international intergovernmental organizations of which one or more countries of the Union are members, with the exception of those armorial bearings, flags and other emblems, initials or names that are already the subject of international agreements in force intended to ensure their protection.
No country of the Union shall be required to apply the provisions contained under letter b above to the prejudice of the holders of rights acquired in good faith in the country concerned prior to the entry into force of this Convention. The countries of the Union shall not be required to apply the aforementioned provisions where the use or registration, as referred to under letter a above, is not of such a nature as to suggest to the public that a connection exists between the organization in question and the armorial bearings, flags, emblems, initials or names, or if such use or registration is likely not to be of such a nature as to mislead the public as to the existence of a connection between the user and the organization.
The prohibition of official control and guarantee marks and stamps shall only be applicable in cases where the marks containing them are intended to be used on identical or similar goods.
The countries of the Union agree, for the application of these provisions, to communicate to each other, through the intermediary of the International Bureau, the list of State emblems and official signs and hallmarks of control and warranty which they desire, or may hereafter desire, to place wholly or within certain limits under the protection of this Article, and all subsequent modifications of such list. Each country of the Union shall in due course make the lists so communicated available to the public. This communication is, however, not required in respect of State flags.
The provisions contained in point (b) of the first paragraph of this article shall only apply to armorial bearings, flags and other emblems, abbreviations or names of international intergovernmental organizations which these organizations have communicated to the countries of the Union through the intermediary of the International Bureau.
Each country of the Union shall, within a period of twelve months from the receipt of the notification, be able to have its objections, if any, transmitted to the country concerned or to the relevant international intergovernmental organisation, through the intermediary of the International Bureau.
With regard to national flags, the measures referred to in paragraph 1 shall only be applied to marks registered after the sixth of November 1925.
With regard to state emblems, other than flags, with regard to official signs and hallmarks of the countries of the Union, and with regard to armorial bearings, flags and other emblems, initials or names of international intergovernmental organizations, these provisions shall apply only to marks registered more than two months after receipt of the notification referred to in paragraph 3 above.
In the event of bad faith, the countries shall have the authority to cancel even those trademarks which were registered prior to the sixth of November 1925 and which contain state emblems, signs, and hallmarks.
Nationals of any country who may be entitled to use the state emblems, signs, and stamps of their country shall be permitted to use them, even if there should be a resemblance to those of another country.
The countries of the Union undertake to prohibit the use in trade, without authorization, of the state emblems of the other countries of the Union, where such use is of a nature to cause confusion as to the origin of the goods.
The preceding provisions shall not prevent the countries from exercising the power to refuse or invalidate, by application of Article 6quinquies, letter B, item 3°, trademarks which contain, without authorization, armorial bearings, flags, and other State emblems, or official signs and hallmarks adopted by a country of the Union, as well as the distinctive signs of international intergovernmental organizations referred to in the first paragraph.
De landen der Unie komen overeen om te weigeren of nietig te verklaren de inschrijving, en door daartoe passende maatregelen te verbieden het gebruik, zonder goedkeuring der bevoegde machten, hetzij als fabrieks- of handelsmerken, hetzij als bestanddeel van die merken, van wapens, vlaggen en andere staatsemblemen van de landen der Unie, van officiële door die landen aangenomen controle- en waarborgtekens en -stempels, zomede iedere nabootsing, bezien uit heraldisch oogpunt.
De bepalingen, hierboven onder letter a vervat, zijn eveneens van toepassing op wapens, vlaggen en andere emblemen, initialen of benamingen van internationale intergouvernementele organisaties, waarvan één of meer landen der Unie lid zijn, met uitzondering van die wapens, vlaggen en andere emblemen, initialen of benamingen, welke reeds het onderwerp hebben uitgemaakt van van kracht zijnde internationale overeenkomsten welke er toe strekken om hun bescherming te verzekeren.
Geen land der Unie zal gehouden zijn de bepalingen, hierboven onder letter b vervat, toe te passen ten nadele van de houders van vóór het in werking treden van dit verdrag in het betrokken land te goeder trouw verkregen rechten. De landen der Unie zijn niet gehouden bedoelde bepalingen toe te passen, wanneer het gebruik en de inschrijving, als hierboven onder letter a bedoeld, niet van zodanige aard is dat bij het publiek de indruk wordt gewekt, dat er een verband bestaat tussen de organisatie in kwestie en de wapens, vlaggen, emblemen, initialen of benamingen, of indien het gebruik of de inschrijving waarschijnlijk niet van zodanige aard is dat het publiek misleid wordt omtrent het bestaan van een verband tussen de gebruiker en de organisatie.
Het verbod van officiële controle- en waarborgtekens en -stempels zal alleen toepasselijk zijn in de gevallen, waarin de merken, die deze bevatten, bestemd zijn om gebruikt te worden op gelijke of gelijksoortige waren.
De landen der Unie komen overeen, voor de toepassing van deze bepalingen, elkander wederkerig mede te delen, door tussenkomst van het Internationaal Bureau, de lijst van staatsemblemen en officiële controle- en waarborgtekens en -stempels welke zij, zonder beperking of binnen zekere grenzen, onder de bescherming van dit artikel wensen of zullen wensen te brengen, evenals alle latere in deze lijst aangebrachte wijzigingen. Elk land der Unie zal te gelegener tijd de medegedeelde lijsten ter beschikking van het publiek stellen. Deze mededeling is echter niet verplicht ten aanzien van staatsvlaggen.
De bepalingen, vervat in letter b van het eerste lid van dit artikel zijn slechts van toepassing op wapens, vlaggen en andere emblemen, initialen of benamingen van internationale intergouvernementele organisaties, die deze organisaties door bemiddeling van het Internationaal Bureau aan de landen der Unie hebben medegedeeld.
Elk land der Unie zal binnen een termijn van twaalf maanden van de ontvangst der kennisgeving af, door bemiddeling van het Internationaal Bureau, aan het betrokken land of aan de desbetreffende internationale intergouvernementele organisatie zijn eventuele bezwaren kunnen doen overbrengen.
Ten aanzien van staatsvlaggen zullen de maatregelen, bedoeld in lid 1, alleen worden toegepast op de merken, ingeschreven na de zesde november 1925.
Ten aanzien van de staatsemblemen, andere dan vlaggen, ten aanzien van officiële tekens en stempels van de landen der Unie en ten aanzien van wapens, vlaggen en andere emblemen, initialen of benamingen van internationale intergouvernementele organisaties, zullen deze bepalingen slechts toepasselijk zijn op de merken, ingeschreven meer dan twee maanden na ontvangst van de kennisgeving, in lid 3 hierboven bedoeld.
In geval van kwade trouw zullen de landen de bevoegdheid hebben om zelfs de merken, welke vóór de zesde november 1925 zijn ingeschreven en staatsemblemen, tekens en stempels bevatten, te doen doorhalen.
De onderdanen van elk land die gerechtigd mochten zijn om gebruik te maken van de staatsemblemen, tekens en stempels van hun land, zullen deze mogen bezigen, zelfs indien er gelijkenis ware met die van een ander land.
De landen der Unie verbinden zich het gebruik in de handel, zonder verkregen toestemming, van de staatswapens van de andere landen der Unie te verbieden, wanneer door dit gebruik omtrent de oorsprong der waren verwarring zal kunnen ontstaan.
De voorafgaande bepalingen verhinderen niet het gebruik maken, door de landen, van de bevoegdheid om door toepassing van artikel 6quinquies, letter B, onder 3°, de merken, welke zonder verkregen toestemming wapens, vlaggen en andere staatsemblemen of officiële tekens en stempels, aangenomen door een land der Unie, bevatten, alsmede de in het eerste lid genoemde onderscheidingstekens van de internationale intergouvernementele organisaties, te weigeren of nietig te verklaren.
