The procedure referred to in Article 6b.1 applies to the preparation of a decision by the Authority for Consumers and Markets to impose, maintain or withdraw an obligation as referred to in a ministerial regulation established on the basis of Article 6a.11.
The Authority for Consumers and Markets shall submit a draft of a decision as referred to in the first paragraph to the European Commission and the national regulatory authorities of other Member States.
The Authority for Consumers and Markets shall not proceed to adopt a decision as referred to in the first paragraph until the European Commission has granted its approval for this purpose in accordance with Article 68(3) of Directive (EU) 2018/1972. In doing so, the Authority for Consumers and Markets shall take into account the comments made by the national regulatory authorities of other Member States.
Op de voorbereiding van een besluit van de Autoriteit Consument en Markt tot het opleggen, instandhouden of intrekken van een verplichting als bedoeld in een op basis van artikel 6a.11 tot stand gekomen ministeriële regeling is de procedure, bedoeld in artikel 6b.1 van toepassing.
De Autoriteit Consument en Markt legt een ontwerp van een besluit als bedoeld in het eerste lid voor aan de Europese Commissie en de nationale regelgevende instanties van andere lidstaten.
De Autoriteit Consument en Markt gaat niet over tot het nemen van een besluit als bedoeld in het eerste lid dan nadat de Europese Commissie daartoe overeenkomstig artikel 68, derde lid, van richtlijn (EU) 2018/1972 toestemming heeft gegeven. De Autoriteit Consument en Markt houdt daarbij rekening met de door de nationale regelgevende instanties van andere lidstaten gemaakte opmerkingen.
