Section 3.4 of the General Administrative Law Act applies to the preparation of a decision by the Authority for Consumers and Markets as referred to in Articles 6.2, 6.3, 6.3a, 6.4, 6a.2, 6a.3, 6a.4a up to and including 6a.4d, and Article 6a.4f, 6b.2, paragraph 5, point (a).
By way of derogation from the first paragraph, the Authority for Consumers and Markets may decide not to apply the procedure referred to in the first paragraph if the decision does not have significant consequences for the relevant market.
If it concerns a decision on an application, Article 3:18 of the General Administrative Law Act does not apply.
Section 3.4 of the General Administrative Law Act (Algemene wet bestuursrecht) shall apply mutatis mutandis to a petition as referred to in Article 6a.4e, paragraph 1, unless it is clear in advance that the petition does not satisfy the conditions applicable thereto.
Op de voorbereiding van een besluit van de Autoriteit Consument en Markt als bedoeld in de artikelen 6.2, 6.3, 6.3a, 6.4, 6a.2, 6a.3, 6a.4a tot en met 6a.4d en artikel 6a.4f6b.2, vijfde lid, onderdeel a, is afdeling 3.4 van de Algemene wet bestuursrecht van toepassing.
In afwijking van het eerste lid kan de Autoriteit Consument en Markt besluiten om de in het eerste lid bedoelde procedure niet toe te passen indien het besluit geen aanzienlijke gevolgen heeft voor de desbetreffende markt.
Indien het een besluit op aanvraag betreft, is artikel 3:18 van de Algemene wet bestuursrecht niet van toepassing.
Op een verzoek als bedoeld in artikel 6a.4e, eerste lid, is afdeling 3.4, van de Algemene wet bestuursrecht van overeenkomstige toepassing, tenzij op voorhand duidelijk is dat het verzoek niet aan de daarvoor geldende voorwaarden voldoet.
