Our Minister shall, after consultation with the Authority for Consumers and Markets, establish numbering plans in which, at a minimum, the destination of the numbers included therein is indicated. Furthermore, a numbering plan may:
it shall be determined that the same number may be assigned to multiple applicants;
for the protection of the consumer, a maximum may be set for the rate of a number included in the numbering plan.
Section 3.4 of the General Administrative Law Act applies to the preparation of a numbering plan.
The second paragraph does not apply if the numbering plan to be established relates solely to:
the expansion of numbering capacity, which is the result of an allocation of numbers to the Netherlands by an international organisation,
the implementation of a decision of the European Parliament and of the Council of the European Union, of the Council of the European Union or of the European Commission, or
other amendments which are of a minor nature and in respect of which the numbering plan provides that Article 4.1, paragraph 2, does not apply to such an amendment.
It is prohibited:
to use numbers other than the numbers included in that numbering plan for a destination specified in a numbering plan, unless the numbering plan provides that this prohibition does not apply, and
to use a number that is included in a numbering plan for a purpose other than the purpose for which that number is included in that plan, unless the use of that number for the other purpose does not prejudice the use of that number for the purpose specified in the numbering plan.
Onze Minister stelt, na overleg met de Autoriteit Consument en Markt, nummerplannen vast waarin in ieder geval de bestemming van de daarin opgenomen nummers wordt aangegeven. In een nummerplan kan voorts:
worden bepaald dat eenzelfde nummer aan meerdere aanvragers kan worden toegekend;
ter bescherming van de consument een maximum worden gesteld aan het tarief van een in het nummerplan opgenomen nummer.
Op de voorbereiding van een nummerplan is afdeling 3.4 van de Algemene wet bestuursrecht van toepassing.
Het tweede lid is niet van toepassing indien het vast te stellen nummerplan slechts betrekking heeft op:
het uitbreiden van nummercapaciteit, welke het gevolg is van een toewijzing van nummers aan Nederland door een internationale organisatie,
de implementatie van een besluit van het Europees Parlement en de Raad van de Europese Unie, van de Raad van de Europese Unie of van de Europese Commissie, of
overige wijzigingen die van ondergeschikte aard zijn en waarvan in het nummerplan is opgenomen dat op een dergelijke wijziging artikel 4.1, tweede lid, niet van toepassing is.
Het is verboden:
voor een bestemming die voorkomt in een nummerplan andere nummers te gebruiken dan de nummers die in dat plan voor die bestemming zijn opgenomen, tenzij in het nummerplan is bepaald dat dit verbod niet van toepassing is, en
om een nummer dat voorkomt in een nummerplan voor een andere bestemming te gebruiken dan de bestemming waarvoor dat nummer in dat plan is opgenomen, tenzij het gebruik van dat nummer voor de andere bestemming geen afbreuk doet aan het gebruik van dat nummer voor de bestemming, genoemd in het nummerplan.
