The arbitral tribunal shall decide in accordance with the rules of law.
In the event that the parties have made a choice of law, the arbitral tribunal shall decide in accordance with the rules of law designated by the parties. If such a choice of law has not been made, the arbitral tribunal shall decide according to the rules of law which it considers appropriate.
The arbitral tribunal shall decide as amiable compositeurs (als goede mannen naar billijkheid) if the parties have by agreement so instructed it.
In all cases, the arbitral tribunal shall take into account the applicable trade usages.
Het scheidsgerecht beslist naar de regelen des rechts.
Ingeval de partijen een rechtskeuze hebben gedaan, beslist het scheidsgerecht naar de door de partijen aangewezen regelen des rechts. Indien een dergelijke rechtskeuze niet heeft plaatsgevonden, beslist het scheidsgerecht volgens de regelen des rechts die het in aanmerking acht te komen.
Het scheidsgerecht beslist als goede personen naar billijkheid, indien de partijen het daartoe bij overeenkomst opdracht hebben gegeven.
In alle gevallen houdt het scheidsgerecht rekening met de toepasselijke handelsgebruiken.
