An appeal stays the operation, unless the order has been declared provisionally enforceable.
This declaration of enforceability notwithstanding appeal may also be granted on appeal. Notwithstanding the declaration of enforceability notwithstanding appeal in the first instance, the higher court may order the suspension of the operation.
An appeal lodged against an interlocutory order (tussenbeschikking) against which no appeal lies pursuant to Article 358, paragraph 3, shall not suspend the operation thereof.
Hoger beroep schorst de werking, tenzij de beschikking uitvoerbaar bij voorraad is verklaard.
Deze uitvoerbaarverklaring bij voorraad kan ook in hoger beroep geschieden. Niettegenstaande de uitvoerbaarverklaring bij voorraad in eerste aanleg kan de hogere rechter schorsing van de werking bevelen.
Het hoger beroep ingesteld tegen een tussenbeschikking waartegen ingevolge artikel 358, derde lid, geen hoger beroep openstaat, schorst de werking niet.
