In the event of an appeal against an interlocutory judgment, the appellate court, when it affirms the judgment, shall remit the case to the court of first instance to be decided on the merits.
Nevertheless, the court of appeal may dispose of the main case in the highest instance itself upon the unanimous request of the parties or if the proceedings are ready for judgment.
In geval van beroep van een tussenvonnis verwijst de rechter in beroep, wanneer hij het vonnis bekrachtigt, de zaak naar de rechter in eerste aanleg om op de hoofdzaak te worden beslist.
Niettemin kan de rechter in beroep de hoofdzaak in het hoogste ressort zelf afdoen op eenstemmig verlangen van partijen of indien het geding in staat van wijzen is.
