The cases in the original action and in the counterclaim shall be concluded simultaneously and decided in one and the same final judgment, unless the court is of the opinion that the case in the original action or that in the counterclaim can be disposed of earlier.
The cases shall be split if, in either of the cases, the court orders that the proceedings be continued in accordance with the rules governing the petition procedure (verzoekschriftprocedure), or if the court refers the case pursuant to Article 71 or declares itself to lack absolute jurisdiction.
De zaken in conventie en in reconventie worden tegelijk voldongen en bij een en hetzelfde eindvonnis beslist, tenzij de rechter van oordeel is dat de zaak in conventie of die in reconventie vroeger kan worden afgedaan.
De zaken worden gesplitst indien in één van beide zaken de rechter beveelt dat de procedure wordt voortgezet volgens de regels die gelden voor de verzoekschriftprocedure dan wel de rechter met toepassing van artikel 71 verwijst of zich absoluut onbevoegd verklaart.
