The court shall stay the proceedings as long as the claimant has not paid the court fee and the period referred to in Article 3, paragraph 3, of the Civil Cases Court Fees Act (Wet griffierechten burgerlijke zaken) is still running.
If the claimant has not paid the court fee in a timely manner, the court shall dismiss the defendant from the proceedings and order the claimant to pay the costs. Before the court proceeds to do so, it shall provide the claimant with the opportunity to express their views regarding the failure to pay the due court fee in a timely manner.
The court shall disregard the first and second paragraphs, first sentence, in whole or in part, if it is of the opinion that the application of that provision, having regard to the interest of one or more of the parties in access to the court, would lead to an unfairness of a predominant nature.
No remedy shall lie against decisions pursuant to the second and third paragraphs.
De rechter houdt de zaak aan zolang de eiser het griffierecht niet heeft voldaan en de termijn genoemd in artikel 3, derde lid, van de Wet griffierechten burgerlijke zaken nog loopt.
Indien de eiser het griffierecht niet tijdig heeft voldaan, ontslaat de rechter de gedaagde van de instantie, met veroordeling van de eiser in de kosten. Voordat de rechter hiertoe overgaat, stelt hij eiser in de gelegenheid zich uit te laten over het niet tijdig voldoen van het verschuldigde griffierecht.
De rechter laat het eerste en tweede lid, eerste volzin, geheel of ten dele buiten toepassing, indien hij van oordeel is dat de toepassing van die bepaling, gelet op het belang van één of meer van de partijen bij toegang tot de rechter, zal leiden tot een onbillijkheid van overwegende aard.
Tegen beslissingen ingevolge het tweede en derde lid staat geen hogere voorziening open.
