in forceGeneral provisions · The Public Prosecution Service and the Procurator General at the Supreme Court
The Public Prosecution Service is authorised to inspect all documents relating to a case and to be present at every hearing.
The Public Prosecution Service may, at the request of the court or a party, introduce documents in its possession into the proceedings. If such a request is not granted, reasons shall be provided therefor.
In cases before the Supreme Court (Hoge Raad), the first and second paragraphs shall apply, on the understanding that any reference to the public prosecution service (openbaar ministerie) shall be read as the Procurator General at the Supreme Court.
Het openbaar ministerie is bevoegd alle op een zaak betrekking hebbende bescheiden in te zien en op elke zitting tegenwoordig te zijn.
Het openbaar ministerie kan op verzoek van de rechter of een partij bescheiden waarover het beschikt, in de procedure brengen. Indien een zodanig verzoek niet wordt ingewilligd, wordt dit gemotiveerd.
In zaken bij de Hoge Raad zijn het eerste en het tweede lid van toepassing, met dien verstande dat voor het openbaar ministerie wordt gelezen: de procureur-generaal bij de Hoge Raad.
